The proposed project will utilize the existing 3,476 square foot convenience store and rebrand it for 7 -Eleven. The two outdated existing fuel canopies, fuel islands and fuel tanks will be removed and replaced with updated equipment. The existing canopy on the south side will not be replaced, while a new fuel canopy will be constructed on the north side of the property. The property is zoned MU -N. Architecture and Orientation As mentioned previously, the existing 3,476 square foot CMU building will remain with enhancements but with no proposed building additions. The fagade of the building will be painted in natural earth tones. The existing fascia will be painted to match. The existing storefronts on the north and south sides of the building will be replaced, and glazing will be added to the west side of the building, adjacent to Wadsworth Boulevard, to provide more architectural interest. The building height will remain at 18' 6". A new trash enclosure is proposed, constructed of CMU and painted to match the building. The new canopy proposed on the north side of the building will feature a flat roof to limit the overall height to approximately 17' 6". The canopy columns shall be painted with the same architectural colors to tie it into the overall 7 -Eleven development and compliment the immediate surrounding structures. The site plan will be more pedestrian friendly with the fueling only on the north side. Landscaping and Screening The site will feature new landscaping that will serve as additional screening including ornamental grass, shrubs, sod, cobble, mulch and deciduous trees strategically placed along the street frontages, landscape islands, and buffer areas. Traffic and Safety The proposed development is a convenience store on the South East corner of 38th and Wadsworth. The use is not a destination, but serves the pass -by traffic and existing traffic counts and densities in the area. Because 7 - Eleven sells convenience and strives to be a benefit to the local community, it is imperative to 7 -Eleven that they are able to get their customers into and out of the development and maneuver on the site safely and efficiently. This is always a focus for 7 -Eleven in designing and laying out the site. The redevelopment will utilize the existing curb cut locations. Moving the fueling area to the north side and thus separating gas from the convenience parking on the south side, again, makes for a much more pedestrian friendly project. Lighting The entire exterior lighting package is LED Energy efficient focus lighting. The lighting appears bright when on the lot, especially under the canopy, and is designed for minimal spillover for the surrounding development. The lighting will meet the current code. Summary This project falls within the approved zoning for this parcel. The immediate trade area features limited convenience retail for the surrounding neighborhood. This project will permit the residents of the community along with surrounding neighborhoods and commuters to access fresh foods, salads, cut fruits, convenience goods, grocery items, retail services and gasoline. By providing these retail goods, amenities, and services, the community will be able to save time and travel to purchase convenience and emergency goods. Plan: Neighborhood Buffer Main Street (38th Avenue) Primary Commercial Corridor (Wadsworth Boulevard) Existing Site Conditions: The property is located at the southeast corner of 38th Avenue and Wadsworth Boulevard. The property is currently occupied by a Shell fueling station with convenience store and carwash. According to the Jefferson County Assessor, the structure was built in 1989, and sits on 41,624 square feet (0.956 acres) of land. The lot is platted as the Texaco Minor Subdivision. This property was part of the city -initiated rezoning of the 38th Avenue corridor in 2012 to Mixed Use Neighborhood (MU -N). The adjacent properties to the east are also zoned MU -N. The -properties to the north and west were part of a 2011 city -initiated rezoning of the Wadsworth Boulevard Corridor to Mixed Use Commercial (MU -C). The properties to the south are zoned Restricted Commercial (RC), Neighborhood Commercial (NC) and Residential -Three (R-3). Applicant/Owner Preliminary Proposal: The applicant is proposing to reutilize the existing convenience store on the property. It is proposed to tear down the existing canopy and gas pumps on the south side of the property. The gas pumps on the north side of the property will remain in place under a smaller, freestanding canopy. Increased landscaping, an upgraded fagade, and possibly more transparency for the existing structure will be added. N Will a neighborhood meeting need to be held prior to application submittal? No, a neighborhood meeting will not be required. Planning comments: The following items were discussed based on the applicant's proposal: Zoning & Use The property is zoned Mixed Use Neighborhood (MU -N). Motor fueling stations require a conditional use permit prior to operation in the MU -N zone district. This gas station was in operation well before the rezoning to MU -N in 2012, and has been in continual operation since. As such, the use of the property falls under Section 26-1103.B and 26-120.C.6 of the Municipal Code, which states that a nonconforming use which was in existence legally prior to a change in zoning may continue to operate. This right to continue operating without strict conformance with the zone district requirements is allowed unless: 1. The use is discontinued for 12 consecutive months; or, 2. The gross floor area expands more than 25% Copies of section 26-1103 and 26-120 will be attached with these notes for reference. As such, the property may continue to operate as a gas station and the site and building may be modified without the need for a conditional use permit, or meeting the design standards of the mixed- use zone districts. Development Standards New construction in the Mixed Use zone districts requires a variety of architectural and site design elements. However, as this building is existing, and major renovations and expansions (more than 50% of the value of the structure) will not be taking place, the reuse of this building by 7 -Eleven will not require compliance with the mixed use development standards. Landscaping A minimum of 15% of the site will need to be landscaped. A calculation of landscape coverage will need to be provided in the Site Plan, the process for which is detailed below. Buffers are not required between the site and its bordering properties to the south or east, as such the eastern drive aisle may be expanded, and the landscape area minimized, so long as the site as a whole can meet the minimum requirement of 15% landscaping. Landscaped buffers of at least 10' are required adjacent to both Wadsworth and West 38th Avenue. Utility Providers The City of Wheat Ridge is not a full-service city. The utility and service providers for this property include: • West Metro Fire Department, phone: 303-989-4307 • Wheat Ridge Water District, phone: 303-424-2844 • Wheat Ridge Sanitation District, phone: 303-424-7252 All land use applications will be sent out on referral to these agencies for comment; however, staff encourages potential applicants to contact service districts ahead of time. This may help to understand any design or infrastructure requirements and potential costs associated with the proposed project. Building Division comments: The building division was not present at the pre -application meeting. Please note that the City of Wheat Ridge has adopted and currently enforces the 2012 Edition of the International Codes and the 2014 Edition of the National Electrical Code. The City uses the ANSI 117.1-2009 Standard in determining requirements related to building accessibility. Work on the existing structure and canopy will require building permits, and upon completion, the issuance of a new certificate of occupancy. Public Works comments: The following items were discussed based on the applicant's proposal: The Environmental Assessment of the Wadsworth Corridor is in its initial stages, and as such, future impacts on this property are not fully known. It will be several years before the impacts of any decisions will impact the property, and as such the site design as it was presented, works for the time being. However, in the future, the Wadsworth Boulevard corridor reconstruction may impact the property by right-of-way acquisition. Review Process This request will require a site plan review. Site Plan Review The first step in the Site Plan Review process is the pre -application meeting. After the pre -application meeting, a formal application may be submitted. Applications must be submitted by appointment with a planner, and will not be accepted if they are incomplete. Upon submittal, a case manager will be assigned to handle the application, and will be the applicant's point of contact at the City for the duration of the site plan review process. The case manager will review the application, and once it is determined all submittal requirements are met, the application will be sent out on referral to outside service agencies (Xcel Energy, water district, fire district, etc.) and other City agencies (Public Works, Economic Development, etc.) for review. The referral period is 15 days, during which time the referral agencies and departments may submit comments on the application. These comments, as well as those from the case manager, will be forwarded to the applicant. Modifications to the site plan may be requires as a result of these comments. When all comments are addressed to the satisfaction of the case manager, the application will be forwarded to the Community Development Director for final decision. The Site Plan review process is administrative, which means there are no public hearings before City Council or Planning Commission. Please note: Approval of the Site Plan application does not mean that a building permit has been issued. Currently, the site is a shell gas station with a canopy that covers the building, 8 gas pumps, and a car wash. Our proposal is to create safer traffic flow into and out of the site, enhance the landscaping, and create a more traditional layout to service both pedestrians and vehicles. We would like to remove the canopy on the south side of the building and create parking on that side. We will be demolishing the car wash and creating a landscape buffer and parking. On the north side of the building, we will be removing the canopy from the building and then replacing with a new canopy that will not be connected to the building. We will not be changing the footprint of the building or the use. It will continue to operate as a gas station, but with fewer gas pumps.
