Frontier Restoration will ONLY complete the work as outlined above or on a Supplemental Contract signed by property owner and approved by Frontier Restoration Management. Frontier Restoration will acquire required permits or the homeowner may acquire the permits. Frontier will supplement your insurance company for the cost or the property owner may do so. Penalties may include hnprisonmen4 fines, denial of insurance and civil damages. If Frontier Restoration is working with insurance proceeds, we will NOT provide any false information for the purpose of defrauding the insurance company. Frontier Restoration is not responsible for damage caused by improH - original construction, faulty framing, masonry, drywall cracks, bracing and/or roof decks or any type of damage, we are not responsible for decayed, rusty or any type of damaged siding, paint and sheetrock damage, or damages due to vibration when work is being completed. We are not responsible for damaged electrical cable, A/C, or plumbing lines that are installed within 6 inches of the roofline. Frontier Restoration is not responsible for resetting any satellite dishes for homeowner due to repairs on property or building; this is the property owner's responsibility. Frontier Restoration 'can' send a reliable company out to reset your satellite and you or the property owner will be liable for this payment either to the satellite company or to Frontier Restoration. Resident of property is advised to remove all pictures, mirrors, and/or other breakables from walls or shelves. Resident of property/property owner understands that there may be significant amounts of dust so you should cover any items as necessary that should be protected from such dust, dirt or pounding. Frontier Restoration is not responsible for any vegetation damage as this is considered a construction site. It is the property owner's / resident's responsibility to remove or cover all vegetation such as plants, hanging plants, any garden materials. It is the property owner's / resident's responsibility to move or cover all outdoor furniture, lighting fixtures, etc. that could be caused damage by construction on your property. It is the property owner's responsibility to notify Frontier Restoration of any deed restrictions. If the undersigned fails to pay Frontier Restoration any amounts due at time of completion or within 10 days from date of completion, the undersigned agrees to pay all costs involved in the collection of this debt, including fees for property lien costs, mechanic lien costs, and any costs associated with collections such as collection agency fees, sheriffs fees, subpoena fees, court costs, plus attorney fees along with finance charges at a rate of one and one-half percent (1.5%) per month, 18% PER ANNUM or the maximum allowed by the State of Colorado if any unpaid fees go to the courts system. Customer agrees to pay any and all costs of such action for collection of a debt owed to Frontier Restoration, LLC. 1. DEPOSITS / TRUST: Frontier Restoration ("Company") will hold in trust any payment received BEFORE materials are delivered or work is started on your home; however, PLEASE NOTE most of the time Company does not require any type of deposit, first payment is required when material is delivered to the property or work has been started on the property. Company will request their first insurance check or fust payment when material is delivered to your property or work has begun. Property owner may pay Supplier directly. 2. INSURANCE; Company maintains Workman's Compensation, and General / Auto Liability Insurance; these documents are available upon request. 3. 72 Hour Rescission: The signer of this contract has the right to rescind this contract and obtain a full refund of any deposit within 72 hours after entering the contract; if, upon request of signatory, work has begun prior to the 72 hour period ending amounts for the work performed will be paid to Company at our contractor costs and any and all materials will be paid for in full once delivered or put to use on the property. Frontier Restoration will have the right to keep any deposits. If payment is not made after work has started, Company has the legal right to place a Ren on this property. 4. CANCELLATION POLICY: If the property owner decides to cancel any portion of work agreed to after work has begun, property owner shall owe the Company for work begun + 10% of contract price, and Company may retain deposits to offset, 10% of the total contract price. 5. Property owner is responsible for full payment to Company for all custom and nm -returnable materials. 6. All proposals are subject to approval by the Management of Company and has the right to cancel this contract at any time. 7. This agreement constitutes the entire agreement between the parties. It may be changed only by executing a new contract signed by bah parties. Addendums are void ad initio. 8. Company is not responsible for any damage below the roof on roof repair jobs; liability is limited to the roof repair only. 9. Company is not responsible for internal structural strength. If you have any concerns or doubts about the strength of your roof substructure to include rafters, beans, etc. or other roof materials, it will he the property owes responsibility to either notify us, obtain an engineer's report, and have weakened conditions repaired before roof replacement or repairs are started. Company can nuke these repairs at an additional cost. Company is not responsible for property nor notifying Company of any such conditions. 10. Company shall have no responsibility for damages from fire, windstorm, other hazards, animal destruction, or Maher Nature/Acts of God. It. Property Owner is responsible for notifying, through writing, of any areas without allowable space for fasteners pursuant to manufactured roofing specs. Company is not responsible for any interior damage or nails that may show through inside the building. 12. Replacement of deteriorated decking, fascia board, roofjacks, ventilatws, flashing or other materials, unless otherwise stated in this contract, are not included and will be charged as an extra or supplement on a time and material basis. This will be supplemented to insurance company or will be invoiced to properly owner at time material is bought and placed on building. 13. Company is not responsible for any damages caused as a result of mold and/or mildew resulting from water penetration thin may develop as a result of the work performed. Properly owner agrees to indemnify and hold harmless Company and its agents, contractors, subamractms, assignees and employees from any and all claims for damages of any type that may result to us, our heirs, assignees, successes in interest, guests or invitees as a result of any act by Frontier Restoration, its agents, contractors, assignees and employees, including but not limited to those of negligence, that cause or contribute to mold/mildew and its abatement, removal or cost of repair/replacement. 14. Any suit or legal action regarding the work done by Company must be commenced no later than 30 days after the last day Company performed any type of work on said property on front of contract (this does not include any repairs after contract work has been completed or collection of amounts due and owing under this agreement). Any such suit shall be commenced in the state of Colorado in the county in which the subject property is located. 15. Company is not responsible for any type of pollution of any kind that may cause health hazards such w allergies, headaches or any other health issue of any kind to members of the household, visitors, hired contractors, or any other person who may be present at the time of construction or after construction. 16. Company is not responsible or liable for any type (solid, environmental, liquid or any other form of pollutant) of release or escape of pollution or pollutants that may arise or be released from the construction performed. Property owner will indemnify and hold Company harmless. 17. No painting, gullets, downspouts, windows, siding or any other type of work is included with this contract unless specifically noted and agreed upon in writing by an authorized Company representative. Management of Company has the authority to refuse any additional work agreed upon. 18. The company shall not be liable for failure of performances due to labor disputes, strikes, fire, weather, inability to obtain materials from usual sources or any other circumstances beyond the control of the company whether of a similar nature. 19. If any provisions of this agreement should be held to he invalid or onenlorceable, the validity, and the enforceability of the remaining provisions of this agreement shall not be affected thereby. 20. Any representations, statements, or other types of communications (such as email, phone conversations, or ANY type of communication), not written in this contract are agrmd to be immaterial and not to be relied on by either party, and do not survive the execwion of this contract. Company is NOT responsible for any type of promise (written er verbally) if nor in writing and signed by property owner and Company manag anent. 21. All materials delivered to the job site remain the property of Company until contract is paid in full. 22. These conditions shall be considered a pan of any contact entered into or authorized to precede, the same as if they were included therein. 23. In the evert that any dispute arises under this contract, or them is a problem with the work completed by Company, property owner agrees to allow Company an opportunity to cure such defects. In the event that Company is not allowed an opportunity to cure such defmi(s) then it shall not be liable for the cost of repair or damages resulting from such defects. Company shall not be liable fa any ecmwquential damages. Company must be notified within 15 days of work completion if there are any questions or disputes; if mitt is not provided Company will not be liable for any portion of any work that the property owner finds unsatisfactory. 24. Company is not responsible for damage to any landscaping materials, brushes, flowers, aces, stones of any kind. pottery, or other outside accessories or furniture. It is the property owner's responsibility to move, remove, or cover landscaping vegetation, outside accessories or furniture while construction is being performed. 25. It is the property owner's responsibility to remove items from interior walls or ceilings to prevent damage. 26. Company is ma responsible for damage to objects not properly attached to any pan of building, (i.e.: light fixtures, mirrors, paintings and other hanging items or items not hanging in the interior or exterior). 27. Property owner is responsible for all expenses incurred in bringing the current construction to code per city/county building department specifications ifna covered by properly owner's insurance policy. 28. Company is not responsible for any (1) faulty or deficiency in or of design. planning, supervision, inspection, construction, or observation of the construction of any improvement to real property (2) injury to real or personal property caused by any such faulty or deficiency. Any claims for any type of monetary relief or construction relief by the property owner, tenant, predecessor or any other person(s) 29. Property owner is responsible for maintaining the roof, gutters, and downspouts from any and all debris that may cause leakage or any other type of damage. Company will invoice the property owner, tenant or any other person who requests the presence of Company for inspection to leakage, fast running water, drainage or any other type of inspection if the inspection requested is not the responsibility or fault of Company. A minimum charge of $150.00 will be charged for this inspection... if Cornpany is required to perform a "fix" to the result of this request, property owner, tenant or other such person will be billed accordingly at no less than $95.00 per hour in addition to the inspection fee of $150.00.'this must be paid at dme of repair and inspection. 30. Property owner agrees to indemnify and hold Company harmless for any injuries or illnem(es), that may occur at any job site to property owners, visitors, children, family members, neighbors, many contractors or subcontractors who are working om contracted property, playing on contracted property, or any person(s) watching or visiting contracted property, and damage to any vehicle on or near the property. 31. SHINGLE WARRANTIES ARE PROVIDED BY THE MANUFACTURER, HOMEOWNER IS RESPONSIBLE TO CONTACT MANUFACTURER FOR REGISTRATION OF THEIR SHINGLE WARRANTY; HOWEVER, WE CAN ASSIST IF YOU CONTACT US FOR ASSISTANCE. Damage caused by sun, snow, ice, hail, fallen trey branches, other fallen articles, collection of leaves, cones or needles, fire, lightning, windstorm, Floods, earthquakes or other phenomenon of the elements of nature, etc.( notify your insurance company immediately). 2. Structural settlement, failure, movement, cracking or excess deflection of the roof deek; defects or failure of materials used as a roof substrate, over which the roof system is applied; faulty condition of parapet walls, copings, chimneys, skylights, vents, supports or other pans of the building, vapor condensation beneath the root penetration fw pitch boxes, erosion, cracking and porosity of mortar and brick; dry rot; stoppage of roof drains and gutters, penetration of the roof from termites or any other insects, any type of rodents or any other animals; harmful chemicals, oils, acids and the like that come in contact with the roofing system and cause a leak or otherwise damage the roof system. If the roof fails to maintain a water -fight condition because of damage by reason litany of the foregoing, this warranty shall immediately become null and void for the balance of its term unless such damage required is repaired by Contractor at the expense of the Owner. 3. Accumulation of leaves or pine needles in gutters or roof valley produce what is known as a "water dam". A water dam can face water under the ronfing and produce leaks through the roof structure. These leaks can travel along roofjoints, etc., and produce interior damage at points far distant from the leak; therefore, provisions should be made for the removal of this debris. Water dams and ice dams are the responsibility of the property owner's maintenance to prevent damage, this pertains to the roof and gutters/downspouts, not Company. Weare not responsible for any type of damage or leaks caused by any animals, insects or nature. 4. Adequate ventilation will keep attic temperature close to those outside, helping to prevent the deck delamination at the roof and the formation of ice dams in guners and valleys. Adequate ventilation is essential to the life of Asphalt Shingles. Adequate ventilation (defined by FHA standards) consist of one square foot or more of open area for every 300 square feet or attic floor area 50% at or near the peak of the roof. 50% in the eaves or lower pan of the roof. Lack of ventilation (or inadequate ventilation) will result in moisture condensation and can cause rating of the wood deck and/or blistering or curling of asphalt shingles which is not a defect in the shingle but is a direct result of moisture being pulled through the shingle by the sun. 5. Installation or relocation of antennas or other equipment on the roof may cause leaks unless proper sealants are used at any point where screws or ahor anchoring devices enter the roof. Avoid unnecessary roof traffic, since it can greatly diminish the life of the roof. 6. leaking can occur in or around the chimney, unless it is periodically tuck -pointed. Normal settling of your house through the years will cause leaking conditions. In addition, the flashing compounds around the chimney and vent pipe areas require normal maintenance on a year-to-year basis. These areas should be inspected periodically for cracking or indication of weathering and should he reflashed accordingly. 7. Company will charge a minimum fee of $100.00 for any inspection requested that is unrelated or unwarranted by work performed by Company previously. If further repairs or work is required the property owner, tenant or other such person will he billed at no less than $125.00 per hour in addition to the inspection foe of $100.00. 8. Notification to Owner: During the term of these warranties, Owner must IMMEDIATELY notify Company by tekphone of any leaks or other warranty issues. Any other type of communication is unacceptable. If you have any concerns or doubts about the strength of your roof substructure to include rafters, beans, etc. or other roof materials, it will he the property owes responsibility to either notify us, obtain an engineer's report, and have weakened conditions repaired before roof replacement or repairs are started. Company can nuke these repairs at an additional cost. Company is not responsible for property nor notifying Company of any such conditions. 10. Company shall have no responsibility for damages from fire, windstorm, other hazards, animal destruction, or Maher Nature/Acts of God. It. Property Owner is responsible for notifying, through writing, of any areas without allowable space for fasteners pursuant to manufactured roofing specs. Company is not responsible for any interior damage or nails that may show through inside the building. 12. Replacement of deteriorated decking, fascia board, roofjacks, ventilatws, flashing or other materials, unless otherwise stated in this contract, are not included and will be charged as an extra or supplement on a time and material basis. This will be supplemented to insurance company or will be invoiced to properly owner at time material is bought and placed on building. 13. Company is not responsible for any damages caused as a result of mold and/or mildew resulting from water penetration thin may develop as a result of the work performed. Properly owner agrees to indemnify and hold harmless Company and its agents, contractors, subamractms, assignees and employees from any and all claims for damages of any type that may result to us, our heirs, assignees, successes in interest, guests or invitees as a result of any act by Frontier Restoration, its agents, contractors, assignees and employees, including but not limited to those of negligence, that cause or contribute to mold/mildew and its abatement, removal or cost of repair/replacement. 14. Any suit or legal action regarding the work done by Company must be commenced no later than 30 days after the last day Company performed any type of work on said property on front of contract (this does not include any repairs after contract work has been completed or collection of amounts due and owing under this agreement). Any such suit shall be commenced in the state of Colorado in the county in which the subject property is located. 15. Company is not responsible for any type of pollution of any kind that may cause health hazards such w allergies, headaches or any other health issue of any kind to members of the household, visitors, hired contractors, or any other person who may be present at the time of construction or after construction. 16. Company is not responsible or liable for any type (solid, environmental, liquid or any other form of pollutant) of release or escape of pollution or pollutants that may arise or be released from the construction performed. Property owner will indemnify and hold Company harmless. 17. No painting, gullets, downspouts, windows, siding or any other type of work is included with this contract unless specifically noted and agreed upon in writing by an authorized Company representative. Management of Company has the authority to refuse any additional work agreed upon. 18. The company shall not be liable for failure of performances due to labor disputes, strikes, fire, weather, inability to obtain materials from usual sources or any other circumstances beyond the control of the company whether of a similar nature. 19. If any provisions of this agreement should be held to he invalid or onenlorceable, the validity, and the enforceability of the remaining provisions of this agreement shall not be affected thereby. 20. Any representations, statements, or other types of communications (such as email, phone conversations, or ANY type of communication), not written in this contract are agrmd to be immaterial and not to be relied on by either party, and do not survive the execwion of this contract. Company is NOT responsible for any type of promise (written er verbally) if nor in writing and signed by property owner and Company manag anent. 21. All materials delivered to the job site remain the property of Company until contract is paid in full. 22. These conditions shall be considered a pan of any contact entered into or authorized to precede, the same as if they were included therein. 23. In the evert that any dispute arises under this contract, or them is a problem with the work completed by Company, property owner agrees to allow Company an opportunity to cure such defects. In the event that Company is not allowed an opportunity to cure such defmi(s) then it shall not be liable for the cost of repair or damages resulting from such defects. Company shall not be liable fa any ecmwquential damages. Company must be notified within 15 days of work completion if there are any questions or disputes; if mitt is not provided Company will not be liable for any portion of any work that the property owner finds unsatisfactory. 24. Company is not responsible for damage to any landscaping materials, brushes, flowers, aces, stones of any kind. pottery, or other outside accessories or furniture. It is the property owner's responsibility to move, remove, or cover landscaping vegetation, outside accessories or furniture while construction is being performed. 25. It is the property owner's responsibility to remove items from interior walls or ceilings to prevent damage. 26. Company is ma responsible for damage to objects not properly attached to any pan of building, (i.e.: light fixtures, mirrors, paintings and other hanging items or items not hanging in the interior or exterior). 27. Property owner is responsible for all expenses incurred in bringing the current construction to code per city/county building department specifications ifna covered by properly owner's insurance policy. 28. Company is not responsible for any (1) faulty or deficiency in or of design. planning, supervision, inspection, construction, or observation of the construction of any improvement to real property (2) injury to real or personal property caused by any such faulty or deficiency. Any claims for any type of monetary relief or construction relief by the property owner, tenant, predecessor or any other person(s) 29. Property owner is responsible for maintaining the roof, gutters, and downspouts from any and all debris that may cause leakage or any other type of damage. Company will invoice the property owner, tenant or any other person who requests the presence of Company for inspection to leakage, fast running water, drainage or any other type of inspection if the inspection requested is not the responsibility or fault of Company. A minimum charge of $150.00 will be charged for this inspection... if Cornpany is required to perform a "fix" to the result of this request, property owner, tenant or other such person will be billed accordingly at no less than $95.00 per hour in addition to the inspection fee of $150.00.'this must be paid at dme of repair and inspection. 30. Property owner agrees to indemnify and hold Company harmless for any injuries or illnem(es), that may occur at any job site to property owners, visitors, children, family members, neighbors, many contractors or subcontractors who are working om contracted property, playing on contracted property, or any person(s) watching or visiting contracted property, and damage to any vehicle on or near the property. 31. SHINGLE WARRANTIES ARE PROVIDED BY THE MANUFACTURER, HOMEOWNER IS RESPONSIBLE TO CONTACT MANUFACTURER FOR REGISTRATION OF THEIR SHINGLE WARRANTY; HOWEVER, WE CAN ASSIST IF YOU CONTACT US FOR ASSISTANCE. Damage caused by sun, snow, ice, hail, fallen trey branches, other fallen articles, collection of leaves, cones or needles, fire, lightning, windstorm, Floods, earthquakes or other phenomenon of the elements of nature, etc.( notify your insurance company immediately). 2. Structural settlement, failure, movement, cracking or excess deflection of the roof deek; defects or failure of materials used as a roof substrate, over which the roof system is applied; faulty condition of parapet walls, copings, chimneys, skylights, vents, supports or other pans of the building, vapor condensation beneath the root penetration fw pitch boxes, erosion, cracking and porosity of mortar and brick; dry rot; stoppage of roof drains and gutters, penetration of the roof from termites or any other insects, any type of rodents or any other animals; harmful chemicals, oils, acids and the like that come in contact with the roofing system and cause a leak or otherwise damage the roof system. If the roof fails to maintain a water -fight condition because of damage by reason litany of the foregoing, this warranty shall immediately become null and void for the balance of its term unless such damage required is repaired by Contractor at the expense of the Owner. 3. Accumulation of leaves or pine needles in gutters or roof valley produce what is known as a "water dam". A water dam can face water under the ronfing and produce leaks through the roof structure. These leaks can travel along roofjoints, etc., and produce interior damage at points far distant from the leak; therefore, provisions should be made for the removal of this debris. Water dams and ice dams are the responsibility of the property owner's maintenance to prevent damage, this pertains to the roof and gutters/downspouts, not Company. Weare not responsible for any type of damage or leaks caused by any animals, insects or nature. 4. Adequate ventilation will keep attic temperature close to those outside, helping to prevent the deck delamination at the roof and the formation of ice dams in guners and valleys. Adequate ventilation is essential to the life of Asphalt Shingles. Adequate ventilation (defined by FHA standards) consist of one square foot or more of open area for every 300 square feet or attic floor area 50% at or near the peak of the roof. 50% in the eaves or lower pan of the roof. Lack of ventilation (or inadequate ventilation) will result in moisture condensation and can cause rating of the wood deck and/or blistering or curling of asphalt shingles which is not a defect in the shingle but is a direct result of moisture being pulled through the shingle by the sun. 5. Installation or relocation of antennas or other equipment on the roof may cause leaks unless proper sealants are used at any point where screws or ahor anchoring devices enter the roof. Avoid unnecessary roof traffic, since it can greatly diminish the life of the roof. 6. leaking can occur in or around the chimney, unless it is periodically tuck -pointed. Normal settling of your house through the years will cause leaking conditions. In addition, the flashing compounds around the chimney and vent pipe areas require normal maintenance on a year-to-year basis. These areas should be inspected periodically for cracking or indication of weathering and should he reflashed accordingly. 7. Company will charge a minimum fee of $100.00 for any inspection requested that is unrelated or unwarranted by work performed by Company previously. If further repairs or work is required the property owner, tenant or other such person will he billed at no less than $125.00 per hour in addition to the inspection foe of $100.00. 8. Notification to Owner: During the term of these warranties, Owner must IMMEDIATELY notify Company by tekphone of any leaks or other warranty issues. Any other type of communication is unacceptable. Other events that win void warranties other than those listed above: (a) if Company is not notified via telephone of any issues with work completed by Company; (b) if any work is completed on the roof, gutters, downspouts, painting, or siding or other arras of property by any other company or contractor or private party or anyone without Bast notifying Company in writing and via telephone and not giving Company the opportunity to make the necessary repair application; (c) any other information on your separate warranty paperwork that nay void your warranty. Please ask Company's once for a copy of your workmanship warranty. These warranties are not transferrable to any other owner of this property except with the prior written consent of Company. Warranties are as follows: Painting is a 1 -year warranty for peeling only, fading has no warranty. Gutters/downspouts is a 1 -year warranty if maintained properly by property homeowner. Gutter Ice Dams, dirt, leaves and any other type of debris in or around the gutters are not the responsibility of Frontier Restoration. Siding installation is a 1 -year warranty, fading, breaking, cracking has no warranty. Windows, window beading and screen repiacernents have no warranty by Frontier Restoration. Frontier Restoration does not warranty any other type of replacements. Roofing Replacement is a 2 - 5 -year workmanship warranty unless otherwise specified, see front of contract.
