On 11/14/2018 the City of Wheat Ridge Building Division posted a Stop Work Notice or Notice of Violation on your
property at 6280 W. 45" Ave for interior remodel without permit.
As of this date, no permits have been issued to clear the Stop Work Notice or Notice of Violation. You must contact the
Building Division at 303-235-2855 and take necessary action to correct the violation by 07/26/2019 (10 business days of
this notice). No permits, licenses, or other entitlements may be issued by any City Department until this violation has been
cleared. Please contact the Building Division at 303-235-2855.
This letter also serves as notice that the Building Division intends to invoke certain administrative procedures as granted
by Chapter 5 of the Municipal Code of laws of the City of Wheat Ridge.
These possible procedures include, but are not limited to, the following:
1. The Recording of a Notice of City of Wheat Ridge Code Violation on your property with the County Recorder.
2. The issuance of a citation.
3. Formal enforcement action.
4. Administrative fees associated with the investigation and processing of the violation(s).
In order to abate the violation, you must obtain a permit, pay any associated fees and have the permit finaled.

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) requires an approved inspection
prior to installation of ANY roof coverings and is require on the entire roof when spaced
or board sheathing with ANY gap exceeding one half inch exists. Asphalt shingles are
required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and
water shield is required. Eave and rake metal is required. A ladder extending 3 feet above
the roof eave and secured in place is required to be provided for all roof inspections.
Roof ventilation is required to comply with applicable codes and/or manufacturer
installation instructions, whichever is more stringent. In order to pass a final inspection
of elastomeric or similar type roof coverings, a letter of inspection and approval from the
manufacturer technical representative stating that "the application of the roof at (project
address) has been applied in accordance with the installation instruction for (roof
material brand name) roof covering" is required to be on site at the time of final
inspection.

Additional work authorized by the homeowner but not included in the above description will be described in a separate addendum (Work Order Confirmation Form), Exceptional
Exteriors, LLC and the Client agree to the terms and conditions set forth on both front and back of this contract.
Exceptional Exteriors, LLC (hereinafter 'Exceptional Exteriors" and "EEL") will perform roof replacement and exterior repairs to the
Premises for the Client as approved and specified by Client's insurance company (collectively, the "Scope of Work") for the
replacement cost value (RCV) of the insurance claim. The only out of no k t co t to the Qiant i- th _ir ded _tih and any non-
recoverable depreciation where applicable as well as any agreed costs for any upgrades or additional work authorized by the Client
in writing. Supplemental claims and/or overhead and profit billed by EEL on behalf of the Client and approved by the Client's
insurance company for additional work or increases in costs, in addition to this contract shall also be deemed a part of this contract
as if contained herein. This contract will become binding upon execution and EEL shall receive all insurance proceeds, including
the deductible. Client agrees to provide EEL with all insurance communications, both written and verbal, and to authorize EEL to
negotiate with the insurance company on Client's behalf to secure the funds necessary to complete the contracted Scope of Work.
EEL shall hold in trust any payment received from the Client until EEL has delivered roofing materials at the Premises or
has performed a majority of the roofing work on the Premises.
1. All proposals are subject to approval of EEL management.
2. EEL will perform the Scope of Work in accordance with generally accepted roofing and construction guidelines, adhering to local
codes in effect at the time of construction.
3. EEL's standard payment terms are as follows: 50% when material is delivered and 50% when work is completed. Endorse and/or
make all checks payable to Exceptional Exteriors, LLC. Any joint checks issued by Client's insurance company shall be
immediately endorsed and tendered by Client to EEL
4. You have the right to rescind this contract and obtain a full refund of any deposit within 72 hours after entering the contract. If you
pian to use the proceeds of a property and casualty insurance policy to pay for the roofing work, you may also rescind this contract
within 72 hours after you receive written notice form the property and casualty insurer that your claim has been denied in whole or
in part. However, EEL is entitled to retain payments or deposits to compensate EEL for roofing work actually performed in a
workmanlike manner consistent with standard roofing industry practices. EEL cannot pay, waive, rebate, or promise to pay, waive,
rebate all or part of any insurance deductible applicable to the insurance claim for payment for roofing work on your property.
5. To rescind, send by certified mail or personally deliver a signed and dated copy of the cancelled contract within 72 hours of
contract signing, or 72 hours of written notice of denial of claim from the insurance carrier to the EEL address on this contract.
Client may also email a signed and dated copy of the cancelled contract to contactus@exexco.com.
6. All excess materials will remain the property of Exceptional Exteriors, LLC
7. Client is responsible for timely securing all required Homeowner's Association approvals of the roofing products and color(s).
8. EEL shall not be liable for failure of performance due to labor controversies, strike, fire, hail, weather, acts of God, inability to
obtain material from usual sources, or any other circumstances beyond EEL's control.
9. EEL shall not be responsible for any leaks or water damage below the roof line, or any damage caused by excessive wind, ice or
hail during the period of the warranty.
10. Replacement of code required materials/upgrades not covered in Client's insurance policy will be additionally charged to Client on
a labor and material basis.
11. EEL will not be held responsible for slight scratching or denting of gutters, oil droplets in the driveway, hairline fractures in
concrete, or damage to plants or shrubbery. Furthermore, EEL will not be held responsible for exterior damages such as broken
or fallen crown molding or fascia, or interior damages such as cracked plaster/sheet rock or nail pops.

13. This contract and all attachments hereto represent the entire contract between parties, and supersede all prior written or oral
contracts between the Client and EEL.
14. This contract cannot be changed, modified or terminated by any other contract unless the same is in writing and signed by the
party against whom enforcement of the change, modification or termination is sought.
15. This contract shall be binding upon the parties and their respective successors, heirs, legal representatives and permitted assigns.
16. If any one or more of the provisions contained in this contract shall for any reason be held invalid, illegal or unenforceable in any
respect, such invalidity, illegality or unenforceability shall not affect any of the other provisions hereof, and this contract shall be
construed as if such invalid, illegal or unenforceable provision had never been contained herein.
17. An account is past due when more than thirty (30) days have passed after the roofing work was completed. If an account is past
due by 60 days a late charge of $120 will occur. If an account goes to into collections, Client shall pay EEL interest at twenty-
one (21 %) percent per annum for all past due accounts. If Client does not pay all sums when due under this contract to EEL, then
Client agrees to pay all costs and fees incurred by EEL for its collection, including reasonable attorney fees and costs. EEL
reserves the right to place a mechanic's lien on Client's property for any default in the timely payment of amounts due under this
contract. . Client shall pay EEL interest at twenty-one (21%) percent per annum for all accounts 90 days past due.
18. The parties waive the right to a jury trial in any action or proceeding based upon or related to any aspect of the transaction in
connection with this contract, or any document executed or delivered in connection with such transaction.
19. Venue for any legal action brought pursuant to or involving this contract shaft be in the City and County of Denver, State of
Colorado, or any other location mutually agreeable to the parties.
20. All attachments to this contract shall be part of this contract and are incorporated herein by this reference.
21. it is the Client's sole responsibility to provide a safe -keeping area for all pets. EEL shalt not be responsible for gates left open
during or after its work.
22. After Client has paid all sums due under this contract, the inspection will be called in to the city/county/municipality and Client will
receive a five (5) year Workmanship Warranty for the roof and one (1) year for all other work. EEL must be notified of all Warranty
claims within five days of the discovery.

Effective December 1, 2014, asphalt shingle installations require an approved midroof
inspection, conducted when 25-75 percent of the roof covering is installed, prior to final
approval. Installation of roof sheathing (new or overlay) is required on the entire roof
when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and
mid -roofs may be called in at the same time, one hundred percent of the sheathing must be
complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required
to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield
is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave
and secured in place is required to be provided for all roof inspections. Roof ventilation
is required to comply with applicable codes and/or manufacturer installation instructions,
whichever is more stringent. In order to pass a final inspection of elastomeric or similar
type roof coverings, a letter of inspection and approval from the manufacturer technical
representative stating that "the application of the roof at (project address) has been
applied in accordance with the installation instruction for (roof material brand name)
roof covering" is required to be on site at the time of final inspection.

This application is exclusively for new permits for residential roofs and for licensed
contractors only. This type of permit is ONLY being processed online --do not come
to City Hall to submit an application in person. Permits are processed and issued in
the order they are received and due to the volume of requests, time to process 9T
varies and is subject to change. YOU WILL BE CONTACTED WHEN YOUR
PERMIT IS READY FOR PICK-UP AND WILL BE GIVEN A SPECIFIC DATE

EXHIBIT A - TERMS AND CONDITIONS
1. PARTIES. The name(s) provided in Customer information shall be referred to herein as "Customer'. Rocky Mountain Enterprises shall be referred to herein as `Contractor". This Contractor Agreement (the
"Agreement") is entered into between Customer and Contractor and is effective on the date it is signed by the last signatory. The Customer and the Contractor are referred to in this Agreement together as the
"Parties", "We", "Our", or "Us", or individually as a "Party'.
IL TERM AND TERMINATION BY CONTRACTOR.
A. Contract Term. The Contract Term shall be adjusted by the amounts stated in all Change Orders, if any. The Contract Term shall also be extended for a period of time equal to the time delay due to weather, acts of
God, labor disputes, fire, transportation and delivery delays, casualties, failure of Customer to obtain variances, land use permits, easements and utility assessments, and any other delay that is not caused solely by
Contractor or Contractors subcontractors, laborers, or suppliers. The Work shall be deemed to be substantially complete when Contractor has performed a majority of the Work ("Substantial Completion'). Time is not
of the essence except with the respect to Paragraph VI below. This Provision shall survive any termination of this Agreement.
8. Early Termination. Contractor may terminate this Agreement immediately without prior notice if: (1) Customer breaches any provision of the Agreement or any warranty or representation contained herein; or (ii)
Customer commits an act of fraud, dishonesty, or any act of negligent, reckless or willful misconduct.
III. BINDING EFFECT. If Customer intends to make payment from the proceeds of a casualty or property insurance policy, then this Agreement does not obligate Customer or Contractor in any way unless it is
approved by the Customers Insurance company and accepted by Contractor, in which case it shall become enforceable against and binding on Customer and Contractor. In the event that Customer subsequently elects
to take a cash payment from Its Insurance company and terminate this Agreement, such action shall be considered a material breach of this Agreement and Customer shall pay Contractor for all Work actually
performed by Contractor at a the rate of $150.00 per hour, plus all costs advanced by Contractor and/or its agents, subcontractors or sub consultants. By signing this Agreement Customer authorizes Contractor to
pursue Customers best interest for roofing replacement or repair at a "Price Agreeable" to Customers Insurance company and Contractor with no additional cost to the Customer other than the insurance deductible
and the costs for labor and materials necessary for any Customer requested upgrades to the Work When Price Agreeable has been determined it shall become the final contract amount and the Customer authorizes
Contractor to, begin the Work necessary to complete the project, including but not limited to obtaining the labor, materials, and permits necessary to perform the Work in accordance with the Price Agreeable, plus
any Customer requested upgrades. Therefore, Contractor, acting as Customers Contractor, will be entitled to all insurance proceeds in accordance with this Agreement. All prices as subject to change. If Customer does
not intend to make payment using the proceeds from an insurance policy, then this Agreement shall be binding on the parties when signed for the price included in Schedule A.
IV. CONTRACTOR DUTIES. Contractor shall provide to Customer the labor and material contained in Schedule A attached hereto (the "Work"), which is hereby Incorporated by reference. Contractor shall perform
said Work in a good and workmanlike manner and shall use the methods and techniques that will accomplish the services and Work, consistent with good and reputable business and professional practices, and all
applicable local, state, and federal laws. Contractor shall remove all trash from the Property created by the Work and shall roll the yard of the Property, if any, with a magnetic roller.
V. SUBSTITUTION OF MATERIALS. Contractor shall furnish materials and equipment as specified. In the event that materials or equipment cannot be furnished as specified, substitute materials or equipment
capable of substantially equal or better performance may be used without prior notification of the Customer. Contractor may also substitute materials and equipment upon Contractor's request and Customers
approval, which approval shall not be unreasonably withheld.
VI. COMPENSATION. For all services the Contractor performs under this Agreement, the Customer shall pay the Contractor the amount set forth in Schedule A hereto. Such amount is due upon Substantial
Completion of the Work. If Customers insurance company falls to pay Contractor, Customer shall be personally liable to Contractor for any unpaid amounts.
VII. LATE FEES. Customer shall pay Contractor a late fee of ten percent (10%) on any past due amounts, to be charged monthly or the maximum amount allowable by the laws in the state this agreement is
effective.

IX. RELIEF CUSTOMER MAY SEEK. In the event that Contractor defaults on this Agreement, violates any provision of this Agreement, or does not perform the Work as represented or according to industry
standards, Contractors liability shall be limited to the amount specified in Schedule A.
X. RIGHT TO CURE. Customer shall notify Contractor In writing of any defects, shortcoming, or dissatisfaction with Contractors performance of the Work or fulfillment of its obligations pursuant to this
Agreement. Such notice shall provide Contractor with an opportunity to cure any Work not performed in a good and workman like manner prior to Customer contracting with any other person, entity, or contractor
to remedy or complete the Work Customer shall provide thirty (30) days' notice to Contractor prior to the Customer attempting to complete or remedy the Work, and prior to commencing any legal action related
to or arising out of the Work or this Agreement. Contractor shall respond to Customers notice of an opportunity to cure within thirty (30) days. If Contractor accepts the opportunity to cure, it shall complete such
Work as to remedy the incomplete or deficient Work within ninety (90) days of such acceptance. Customers failure to provide Contractor with such an opportunity to cure shall release Contractor from any claims or
liability related to or arising out of the Work performed pursuant to this Agreement, and prohibit Customer from seeking damages from Contractor related to or arising out of the Work or this Agreement and from
claiming any offset in amounts due to Contractor to the Work or this Agreement.
XI. IDEMNIFICATION. Customer shall indemnify Contractor and its employees, officers, directors, agents, subcontractors, and servants from and against any loss, damage, costs, actions, injury, and or other
proceeding Contractor shall suffer as a result of any breach of this Agreement by Customer to the extent permitted by law. Customers indemnity obligations shall include, but are not limited to all: losses, damages,
injury, or liability that Contractor may suffer as a result of Customers breach of this Agreement. Such damages shall also include attorney fees, litigation costs, and alternative dispute resolution costs and expenses..,
XII. LIMITED WARRANTY. Contractor warrants that its Work shall be completed in a good and workmanlike manner according' to standard industry practices. THERE SHALL BE NO OTHER WARRANTY OF ANY
KIND, EXPRESSED OR IMPLIED, INCLUDING, WITHOUT UMfTATION, THE WARRANTIES OF HABITABILITY, MERCHANTABILITY AND FITNESS OF PARTICULAR PURPOSE. All implied warranties are expressly and
irrevocably waived and released by Customer and disclaimed by Contractor. Contractor does not warrant against damage mused by Customers improper care and maintenance or rrwdification to the property,
drainage, grading or landscaping. Customer warrants and represents that Customer has homeowners insurance for the Property. Contractor is not liable for any damage below the roof due to Ice dams, hail, or
preexisting conditions or construction defects. This includes but Is not limited to faulty AC lines, supply lines, and water lines, installed along the rafters or attached to the underside of the roof decking. Customer
agrees that Contractor will not be responsible for any damage mused by mold or any other fungus or biological material, regardless of whether it may be associated with defects in Contractors construction or
services, including but not limited to property damage, personal injury, loss of Income, emotional distress, death, loss of value, adverse health effects or any special consequential, punitive or other damages.
XIII. GENERAL PROVISIONS.
Assignments. This Agreement constitutes a personal contract that may not be assigned by Customer without prior written consent of Contractor.
A. Governing Law. The Parties agree that this Agreement shall be governed by, interpreted and construed in accordance with the laws of the State of Colorado, and the Parties agree that any suit, action or proceeding
with respect to this Agreement shall be brought in the state courts in Denver, Colorado. The Parties hereby accept the exclusive jurisdiction of the courts for the purpose of any such suit, action, or proceeding. Venue
for such action, in addition to any other venue permitted by statute, shall be in Denver, Colorado.
The Parties irrevocably waive the right to a jury in any trial on the merits.
B. Severability. If any provision of this Agreement is held to be illegal, invalid, or unenforceable, such provision shall be fully servable and the remainder of this Agreement shall remain in full force and effect.
C. Binding Affect. This Agreement shall be bending upon and shall inure to the benefit of each Party hereto and each Party's respective successors, heirs, assigns, and legal representatives.
D. Entire Agreement. This Agreement, along with the attached schedule A embodies the entire agreement and understanding between the Parties with respect to its subject matter and supersedes all prior
agreements and understanding, whether written or oral, relating to its subject matter. No amendments, modification, or termination of this Agreement shall be valid unless made in writing and signed by each of the
Parties.
E. Interpretation. In interpreting words in this Agreement, unless the context will otherwise provide or require, the singular will include the plural, the plural will provide the singular, and the use of any gender will
include all genders.
F. No Construction Against Drafter. The Parties have reviewed the Agreement in its entirety and acknowledgment that each has had a full opportunity to negotiate the terms of this Agreement. Therefore, the
parties waive any and all applicable common law and statutory rules of construction that any provision of this Agreement should be construed against the drafter, and agree to affirm that this Agreement and all
provisions thereof shall in all cases be constructed as a whole, according to the fair meaning of the language used.
G. Contractor represents and warrants that it is regularly engaged in business that is being pursued by the Customer, that will not and does not depend exclusively on Customer to provide it with business, and that it
irrevocably waives any right to claim unemployment insurance or workers compensation benefits of any kind relating to the Work performed for Customer.
H. Paragraph/Section Headings. The paragraph and section headings are inserted for convenience of reference only, and shall not be deemed to form a part of this Agreement, or to govern or effect the meaning of
any of the terms of provisions hereof.
I. Own Will. The Parties have entered into this Agreement of their own will and no statement, representation or promise has been made to induce either Party to enter into this Agreement.
J. Modification of Contract. This Agreement may not be modified, changed or amended, nor may any rights, remedies or claims of Contractor be waived except by written document executed by authorized
representatives of the Parties hereto. Contractors failure to strictly comply with any provision of this Agreement shall not constitute or be interpreted as a waiver of or intent to waive any right or obligation in this
Agreement. No failure or delay by Contractor in exercising any right or remedy, in whole or in part, shall operate as a waiver of that or any other right or remedy. No acceptance of any partial payment by Contractor
shall be deemed a waiver or considered as an intent to waive any rights under this Agreement.
K. Attached Documents. Schedule A will be referred to as the Agreed Price, or will be considered the Agreed Scope of Work provided by the insurer or the Contractor. A Scope sheet may or may not be attached to this
document as well. Scope sheet will provide amounts of materials and miscellaneous items necessary to complete the Work.
XIV. MAKE ALL CHECKS PAYABLE TO ROCKY MOUNTAIN ENTERPRISES.
XV. CANCELATION POILICY. Customer has the right to rescind this Agreement and Obtain a full refund of any deposit within 72 hours after the Agreement is executed by Customer. If Customer plans to use the
proceeds of property and casualty insurance policy to pay for the Work, Customer may rescind this Agreement in writing within 72 hours after Customer receives written notice from the carrier that the Customers
claim has been denied in whole or in part by mailing or delivering such notice to Contractor at 300 E Miller Court, Suite 1571, Castle Rock, CO 80104 If Customer rescinds this agreement within the 72 hour period,
Contractor shall, within ten (10) days of receiving notice of such rescission, refund any moneys paid by Customer. However, Contractor is entitled to retain payments or deposits to compensate Contractor for roofing
work actually performed, including costs incurred by Contractor for custom non-refundable materials ordered for the Work prior to Contractor receiving notice of Customers rescission. If Customer does not rescind
this Agreement before the 72 -hour period expires, then the terms of this Agreement shall remain binding upon Customer. Contractor cannot pay, waive, rebate, or promise to pay, waive or rebate all or part of any
Insurance deductible applicable to the insurance claim for payment for roofing work on Customers property. Nothing in this section abrogates the Contractors right to pursue any and all legal remedies to recover the
reasonable value of actual work performed, including but not limited to roofing materials ordered and actually Installed on the property pursuant to this Agreement before Customer rescinds the contract.
