REGARDING ROOF VENTILATION: Roof ventilation shall comply with IBC Sec. 1203.2 or IRC Sec. R806. The installation of ridge venting requires the installation or existence of soffit venting. For calculation purposes, one hat or turtle vent equal to one-half of one square foot of opening. Effective December 1, 2014, asphalt shingle installations require an approved midroof inspection, conducted when 25-75 percent of the roof covering is installed, prior to final approval. Installation of roof sheathing (new or overlay) is required on the entire roof when spaced or board sheathing with ANY gap exceeding one half inch exists. Sheathing and mid -roofs may be called in at the same time, one hundred percent of the sheathing must be complete and 25-75 percent of the mid -roof may be complete. Asphalt shingles are required to be fastened to the roof deck with a minimum of 6 nails per shingle. Ice and water shield is required. Eave and rake metal is required. A ladder extending 3 feet above the roof eave and secured in place is required to be provided for all roof inspections. Roof ventilation is required to comply with applicable codes and/or manufacturer installation instructions, whichever is more stringent. Colorado Roofing Solutions, LLC, and Client hereby expressly agree that any and all claims arising from Colorado Roofing Solutions, LLC, work shall be subject to the rights remedies, and procedures provided in the Construction Defect Reform Act, C.R.S. ss 13-20-802 et seq. 3. STANDARD OF CARE. Colorado Roofing Solutions, LLC's, services as defined in this Agreement shall be performed in accordance with generally accepted principles and procedures, consistent with a level of care and skill ordinarily practiced by roofing specialists currently providing similar services under similar circumstances at the time Colorado Roofing Solutions, LLC's, services were provided. Client shall provide Colorado Roofing Solutions, LLC, written notice of any claim or default under this Agreement in accordance with the Construction Defect Reform Act. Colorado Roofing Solutions, LLC, shall be afforded the opportunity to inspect the premises and respond to the claim either by making a monetary settlement offer or offering to remedy the construction defect in accordance with the Construction Defect Reform Act. 4. OBLIGATION OF CLIENT. Client warrants that all information provided to Colorado Roofing Solutions, LLC, is complete and accurate to the best of Client's knowledge, and Client understands that Colorado Roofing Solutions, LLC, is relying upon Client's information to do its work. S. WARRANTY. Colorado Roofing Solutions, LLC, is not a manufacturer. If any equipment is used or purchased by Colorado Roofing Solutions, LLC, for use on site the manufacturer's warranties if any of the equipment are solely those of the manufacturer. Colorado Roofing Solutions, LLC, makes no other representation, guarantee, or warranty, express or implied, in fact or by law, whether of merchantability, fitness for a particular purpose, or otherwise concerning any of the goods or services used or purchased by Colorado Roofing Solutions, LLC, that may be furnished by Colorado Roofing Solutions, LLC, to Client. 6. Any change orders requested by the property owner post signing this agreement must be agreed upon between the property owner and Colorado Roofing Solutions in writing and will be an addendum to this agreement. DUE TO THE AGE AND CONDITION OF YOUR HOUSE, AND THE NEED TO REPLACE THE ROOF OF YOUR HOME, DURING THE PROCESS OF REPLACING YOUR ROOF, OTHER DAMAGE TO YOUR HOME MAY BE CAUSED. THESE ISSUES ARE NOT READILY ASCERTAINABLE PRIOR TO THE BEGINNING OF CONSTRUCTION ON YOUR ROOF. COLORADO ROOFING SOLUTIONS, LLC, CARRIES BOTH GENERAL LIABILITY AND WORKER'S COMPENSATION INSURANCE. It is the homeowners' responsibility to make sure all ventilation pipes in the attic are protruding through the roof and are properly connected after the roofing work is completed. Colorado Roofing Solutions is not responsible for the unconnected ventilation pipes after roofing work is complete. 8. Colorado Roofing Solutions is not responsible for interior sheet rock damage due to loading and hammering of roofing materials. 9. Properly installing a new roof may (and frequently does) require removal and replacement of existing flashing. During installation, siding adjacent to the flashing that is old, worn or deteriorated, may break, crack or tear. Colorado Roofing Solutions is not responsible for any consequential damage to worn or deteriorated siding resulting from replacing flashing. 10. You agree to provide Colorado Roofing Solutions and material distributors unobstructed access to your driveway while work is in progress. The equipment and materials used in replacing a roof are heavy. Colorado Roofing Solutions is not responsible for driveway and curb damage that results from settling, compression, or inadequate support of your driveway and curbs. 11. Building Codes and good building practices require that air conditioning, water and electric line and pipes'be located a safe distance below roof decking. Colorado Roofing Solutions is not responsible for nail penetrations to air conditioning, water or electric lines or pipes that are located less than 3" below the bottom surface of the roof deck or any resulting damages. 12. Additional materials are generally ordered for each joL. Any and all materials delivered to your job site remain the property of Colorado Roofing Solutions. 13. SUPPLEMENTS. Any and all additional work required that is absent on the original insurance scope of work, whether required by city/county code or overlooked during the insurance adjustment, will require a submission for supplemental funds to the insurance provider of the said property. Any additional funds, pertaining to the work performed by Colorado Roofing Solutions, released by the insurance provider are intended for, and will be allotted to, Colorado Roofing Solutions for the additional required work performed. (Supplements include items such as: building permit, code upgrades, additional work performed, taxes, base service charges, overhead and profit etc) 14. DEDUCTIBLE. Your deductible is the portion of your claim that is not covered by your insurance company. You, the insured, are responsible for paying your deductible amount to Colorado Roofing Solutions. Ex: Your claim equals sio,000. If your deductible is $Soo, the insurance provider will release S9500 in total. Leaving you, the insured, to pay the difference to Colorado Roofing Solutions. 15. RESCISSION. You the buyer may cancel this transaction and receive a full refund of any amounts paid at buyer's sole discretion at anytime prior to midnight of the third business day after the date of execution of this contract. In witness whereof purchaser(s) each acknowledge receipt of a completed copy of this contract, and all disclosures on the day and year written below. If you plan to use the proceeds of a property and casualty insurance policy to pay for the roofing work, you may rescind this contract within 72 hours after you receive written notice from the property and casualty insurer that your claim has been denied in whole or part. However, Colorado Roofing Solutions, LLC is entitled to retain payments or deposits to compensate Colorado Roofing Solutions for roofing work actually performed in a workmanlike manner consistent with standard roofing industry practices. 16. Colorado Roofing Solutions, LLC cannot pay, waive, rebate, or promise to pay, waive, or rebate all or part of any insurance deductible applicable to the insurance claim for payment of roofing work on your property. 17. OTHE R. In addition, finance charges of 1 v per month will be added after forty five (45) days of completion. Colorado Roofing Solutions will not be held liable for any structural movement, settling, cracks in drywall, or driveway due to the roofing or loading processes.
