I. REQUEST Case No. SUP -17-03 is an application by Shannon Fedrizzi (owner of Phenix Salon Suites) to allow body art establishments in the business' existing commercial space on property zoned Commercial - One (C-1) and located at 10160 W. 5& Avenue, just west of Kipling Street (Exhibit 1, Aerial). Pursuant to Section 26-114 of the Code of Laws, the Community Development Director has the ability to decide upon applications for Special Use Permits without a public hearing, provided the following conditions are met: 1. A completed application package has been submitted and fee paid; 2. The Community Development Department has notified adjacent property owner by letter notice and the site has been posted for at least ten (10) days; 3. No written objections have been received in such ten-day period; 4. The Community Development Director concludes that the criterial for approval, as set forth below, are substantially complied with and support the request. The Community Development Director can impose conditions or stipulations upon the approval, which may include physical design, operational, and maintenance considerations to ensure compliance with the criteria for review. The Community Development Director shall also decide the following: 1. Whether the SUP runs with the land in perpetuity; 2. Whether the SUP is personal to the applicant and may or may not be inherited; and/or, 3. Whether the SUP is granted only for a defined period, after which time the special use shall expire unless renewed subject to all of the requirements of this section. II. EXISTING CONDITIONS Current Zoning The C-1 zone district allows for a wide range of commercial uses, such as office, general business, retail sales, and service establishments intended to serve the community and region. Phenix Salon Suites offers individual tenant spaces for hair dresses, beauticians, cosmetologists, and practitioners providing personal services such as facials and skin care, all of which are allowable uses in the C-1 zone district. Other uses in the same commercial building include restaurants, dental offices, and medical clinics, all of which are allowable uses. Body art is defined in Section 26-123 as: The practice of physical body adornment by establishments or artists utilizing, but not limited to, the techniques of body piercing, tattooing, branding, sculpting, and scarification. This definition does not include practices conducted under the supervision of a physician licensed to practice medicine under Colorado law nor piercing of the outer perimeter of the ear by means of sterilized stud -and -clasp ear piercing systems. Case No. SUP -17-03 / Phenix Salon Suites A body art establishment is defined as any location "where the practices of body art are performed." This use is a special use in the C-1 zone district per Section 26-204.C.4 of the Municipal Code. Current Land Use The property is located on the south side of 50th Avenue, just west of Kipling Street and north of Interstate 70. The existing structure was constructed in 2005 and serves many retail, commercial, and restaurant uses. The applicant, Phenix Salon Suites is one of the existing tenants in this building, and provides individual suite spaces for independent hair stylists, nail technicians, and other small business owners. Based on City business license records, Phenix Salon Suites has been in operation since 2015. Phenix provides many necessary services in one centralized location allowing for small business owners to reduce overhead costs, while still maintaining their independence as business owners. Individual tenants of the suites are each expected to obtain their own business licenses. Surrounding Zoning and Land Use The property is surrounded by retail, commercial, and semi -industrial uses. The zoning in the area is reflective of the existing land use. To the west is a large property zoned Planned Industrial Development (PID) via the Sanders Industrial Park Outline and Final Development Plan for the purpose of a plumbing supply warehouse and distribution facility. To the south are various properties zoned Commercial -One and utilized as a marijuana dispensary, and an auto parts and service provider. Further south, still zoned C-1, is a motel and gas station. To the east, also zoned C- 1, are a number of businesses oriented towards Kipling Street, including a gas station and two drive through restaurants. To the north is the City of Arvada and the Arvada Ridge Marketplace with many commercial and retail uses including a Target and many drive-through fast food restaurants (Exhibit 2, Zoning). III. CASE ANALYSIS The applicant is seeking to accommodate potential tenants that provide body art services. The multi - tenant commercial structure was built to accommodate such uses, so it is unlikely that extensive tenant finish work would be necessary to accommodate a body artist (Exhibit 3, Site Photos). A body art establishment can be expected to generate similar levels of traffic and parking demand as the existing by -right personal services such as massage therapists, hair stylists or cosmetologists. Access into the site is possible from the I-70 Frontage Road/49th Avenue and Miller Street/50th Avenue. Signalized access to Kipling Street is offered at both 50th Avenue and 49' Avenue. There is also signalized access into the site from 50th Avenue. Jefferson County Public Health (JCPH) is the local authority that regulates the operation of body art establishments to ensure safe and sanitary practice, physical environment, and equipment. The proposed body art establishment will be subject to a plan review, annual licensing, and routine inspections by the department. Jefferson County Public Health also regulates the medical and bio - hazardous waste produced by body art establishments. IV. CRITERIA FOR REVIEW The Community Development Director shall use the following criteria from Section 26-114 to evaluate each application for a Special Use Permit. The applicant has provided their analysis of the application's compliance with the SUP criteria (Exhibit 4, Letter of Request). Staff provides the following review and analysis of the SUP criteria. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. It will utilize an existing structure, with existing parking, utilities, and functional space. Any tattoo parlor operating from the space will be required to comply with all County and State regulations regarding body art establishments. Staff finds this criterion has been met. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. The special use will not create or contribute to blight in the neighborhood. A body art establishment would be located within the existing Phenix Salon Suites space and would operate under the existing conditions. Phenix Salon Suites has been operating in this location for approximately 2.5 years, and there have been no issues related to blight conditions during that time. Staff finds this criterion has been met. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. The C-1 zoning allows for a wide range of community and regionally focused commercial, retail, and office uses. The Phenix Salon Suites offer spaces for hair stylists, cosmologists, massage therapy, and other similar personal services, all of which are allowed uses. It is reasonable to conclude a body art establishment operated from this space would have similar operational characteristics, and thus would not create any adverse impacts greater than allowed under the existing zoning. Staff finds this criterion has been met 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. A body art establishment is not expected to result in undue traffic congestion or traffic hazards. Nor would it cause any unsafe parking, loading, service, or internal traffic conflict to the detriment of persons on or off site. There are multiple access points into the parking lot, distributing traffic through multiple points of entry. There is also a signalized access point into the site from 501h Avenue and two signalized access points to Kipling Street, regulating the flow of traffic into and out of the site and other nearby commercial businesses. A tattoo parlor is expected to cause similar amounts of trip generation and parking demand as other personal service businesses that operate out of Phenix Salon Suites. Staff finds this criterion has been met. Case No. SUP -17-03 / Phenix Salon Suites 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent property owners. No changes to the existing structure are proposed for the operation of a body art establishment. There will be no impacts to the existing setbacks, height, bulk, buffering, screening, or landscaping. Building permit records indicate the structure met development standards for the C-1 zone district at the time of its development in 2005. There have been no major modifications to the structure or property (other than interior tenant finishes) since that time. Staff finds this criterion has been met. 6. The special use will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. There is a history of compliance by the applicant and/or property owner with Code requirements and prior conditions, if any, regarding the subject property. There is a history of compliance on the property from a code enforcement, zoning, building, and sales tax licensing perspective. Staff finds this criterion has been met. 8. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. No new construction on the site is proposed. Staff finds this criterion is not applicable. V. AGENCY REFERRAL All affected service agencies were contacted regarding the ability to serve the property. Their specific referral responses follow. Arvada Fire Protection District: No concerns. Fire inspectors will need to conduct a compliance inspection if the SUP is approved. Jefferson County Public Health: No concerns. Body art establishments are subject to plan review, yearly licensing, and routine inspections by Jefferson County Public Health. NEIGHBORHOOD MEETING & PUBLIC NOTICE A required neighborhood meeting was held on May 31, 2017. The property owner and applicant were in attendance, but no members of the public attended (Exhibit S, Neighborhood Meeting). No objections were received during the ten-day public noticing period. Pursuant to the requirements of Section 26-114, special use applications can be approved administratively after a ten-day noticing period if no legitimate objections are received. VII. STAFF CONCLUSIONS AND RECOMMENDATION Having found the application for Case No. SUP -17-03 / Phenix Salon Suites — a Special Use Permit to allow a body art establishment to be located within an existing commercial building located in the Commercial -One zone district — to be complete and in compliance with the majority of the applicable review criteria, staff recommends APPROVAL of the special use request for the following reasons: 1. The special use will not have a detrimental effect upon the general health, welfare, safety and convenience of persons residing or working in the neighborhood. 2. The special use will not create or contribute to blight in the neighborhood by virtue of physical or operational characteristics. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property. 4. The special use will not result in undue traffic congestion or traffic hazards, or unsafe parking, loading, service or internal traffic conflicts to the detriment of persons whether on or off the site. 5. The property is appropriately designed, including setbacks, heights, parking, bulk, buffering, screening and landscaping, so as to be in harmony and compatible with the character of the surrounding areas and neighborhood, especially with adjacent properties. 6. The special use will not overburden the capacities of the existing streets, utilities, parks, schools and other public facilities and services. 7. The use of a suite for the purpose of providing permanent makeup or body tattoos will have no extra impact or detrimental effects in regards to health, safety or welfare of neighboring businesses. 2. The special use will not create or contribute blight in the neighborhood as there will be no exterior signage or additional building at the location. 3. The special use will not create adverse impacts greater than allowed under existing zoning for the property as it is already in use as a commercial space. 4. The property is already set up for commercial and retail space and will have no need for additional work to get the business up and going. 6. There are no additional architectural requirements needed for this special use as the special use will be housed in a already approved commercial space that has been in business for over 2 years. Review Process SPECIAL USE PERMIT Neighborhood Meeting The first step in the Special Use Permit (SUP) process is the pre -application meeting, which is being substituted with this information. The next step is to conduct a neighborhood meeting. The applicant is responsible for drafting a letter that will be delivered (via mail or hand delivery) to all property owners and current residents in a 600 -foot radius of the subject property. The letter must be approved by the Community Development department PRIOR to sending. The Community Development department can provide the applicant with a neighborhood meeting letter template and samples, if necessary. Additionally, the Community Development department will research the property owner and resident information from the Jefferson County records and provide the applicant with mailing labels. The applicant will coordinate with the Community Development department on the time and location of the neighborhood meeting. The meeting may be held in one of the Wheat Ridge Municipal Building conference rooms, or any other location the applicant desires. There is a $100 fee for the meeting. Staff will be present at the meeting to facilitate the discussion and answer any zoning, land use, and process related questions. However, the applicant will lead the meeting and inform the audience about the proposal. Application Once the neighborhood meeting is complete, a formal application may be submitted. The SUP application will be assigned a case number and case manager. The case manager will be the applicant's point of contact at the City for the duration of the case processing. The case manager will review your case, and send it out on referral to City and outside agencies for review. The referral period is 15 days, during which time all departments and agencies may submit comments on the application. These comments, as well as those from the case manager, may require modifications to the application. Once review of the application is complete, the property must be posted. This posting lasts 10 consecutive days and requires a sign to be posted on the property. Additionally, the Community Development department will send out written notification of the SUP request to all adjacent property owners. If no legitimate complaints are received during this posting period, the Special Use Permit application may be reviewed and decided upon administratively. If a legitimate complaint is received by the Community Development Department during this posting period, the Special Use Permit will be automatically forwarded to the City Council for a public hearing and decision. If the application is reviewed administratively and denied, the applicant can appeal the decision to the City Council. If the case is forwarded to City Council due to receipt of legitimate objections, or due to appeal by the applicant, the property must be posted again. This posting period lasts 15 consecutive days and will require a sign to be posted on the property. The Community Development Department will also mail out notification of the hearing to all property owners within 300 -feet of the subject site. At the public hearing before City Council, the case manager will present the case, and based on an established set of criteria present evident to recommend the approval, approval with conditions, or denial of the Special Use Permit. The applicant, and the public, will be allowed to present evidence and provide testimony in support of opposition of the Special Use Permit. The City Council will then make a decision of approval, approval with conditions, or denial based on the testimonies provided by staff, the applicant, and the public.
