This letter is in regard to the first resubmittal for approval of a consolidation plat for property
located at 10001 W. 32nd Avenue (Case No. MS -14-03).
The initial application was filed with the City Community Development Department on June 5, 2014.20,
2014. An initial comment letter was generated by city staff on July 1, 2014. A second comment letter
was sent on October 15, 2014. Since that time, there has been no activity on your part regarding your
land use request.
It is departmental policy that if no action occurs on an open case file within one hundred twenty days, the
case can be closed. Subsequent action on the property will constitute a new application with new fees
required.
Please contact me at your earlier convenience to discuss status of your land use request.

RE: Consolidation Plat Case No. MS -14-03
I will present the mylar for this case to the City with all of the owners' and
notary signatures needed for the recording of the document. However,
as the separate parcels are being used as collateral by different lending
institutions, and as the conveyance of the parcels to Termara, LLC at the
date of the signed plat would result in a default under the various security
agreements and deeds of trust evidencing the pledge of the parcels as
collateral, we request that the mylar be held in the Community
Development Department. Termara, LLC will ultimately be the seller of
the consolidated property to Julia Greeley Home, Inc. Once the re-
zoning is in place, Termara, LLC will hold the land as a single parcel and
this will allow the sale of the property to go on as contracted.
Please be advised that the Panio's intend to go forward with the rezoning
which will apply to the consolidated property. We will use the outer
perimeter description for the rezoning process. Upon the conclusion of
the rezoning, the mylar can be recorded, the sale concluded and the
PUD recorded which applies to the Julia Greeley Home, Inc.
If there is any problem with going forward in this fashion, please let me
know.

Dear Mr. Stevenson,
I have completed the first review of the above referenced plat received on October 9, 2014, for the
proposed subdivision involving the property located at 10001 W.32"d Avenue, and 1 have the following
comments:
LAND SURVEYING
Final Plat:
General Comments:
1. Please provide the required margins: 2" on left side, 1" on top, and''/Z" for the remaining sides.
2. The City will need a small triangle of ROW, 20.0'x 20.0' in length to adequately maintain the
public improvements at the intersection. Since we understand that dedication of ROW by plat
would require a City Council hearing, this can be dedicated by a Warranty Deed instead. By using
the WD method all that is required is a signed & sealed legal description with Exhibit, and the
completed WD deed (I have provided the standard deed template with this Comment Letter). The
City will process the WD deed (it must go before the City Council) and then be recorded at the
County Clerk & Recorder's Office. The City can provide a copy of the recorded deed upon
req uest.
Sheet 1:
1. In the first line of Note 1, please add a space to WHEATRIDGE (it's actually two words:
"WHEAT RIDGE").
2. All other comments have been addressed.
Sheet 2:
1. Please modify the parcel line removal notation to read, "EXISTING PARCEL LINES ARE
HEREBY REMOVED BY THIS PLAT". (Change "Thereby" to Hereby").
2. The ROW that was vacated by the ordinance at Rec# 93155172 includes both 10001 W. 32nd

WHEREAS, West 32nd Avenue between Kipling Street and Simms
Street was recently •reconstructed; and
WHEREAS, a portion of said dedication right-of-way along the
north side of West 32nd Avenue is unneeded for public roadway
purposes; and
WHEREAS, said part of said West 32nd Avenue lies within the
City of Wheat Ridge, County of Jefferson, State of Colorado, and
is not needed by the City for roadway or right-of-way purposes;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF WHEAT RIDGE,

B) A Certificate of Taxes Due listing each taxing jurisdiction shall be obtained from the County Treasurer or the County Treasurer's
authorized agent.

Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing in the clerk and recorder's

Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion of Exception no. 4 of Schedule B, Section
2 of the Commitment from the Owner's Policy to be issued) upon compliance with the following conditions:
A) The land described in Schedule A of this commitment must be a single family residence which includes a condominium or
townhouse unit.
B) No labor or materials have been furnished by mechanics or material -men for purposes of construction on the land described in
Schedule A of this Commitment within the past 6 months.
C) The Company must receive an appropriate affidavit indemnifying the Company against un -filed mechanic's and material -men's
liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or major repairs undertaken on the property to be purchased within six months prior
to the Date of the Commitment, the requirements to obtain coverage for unrecorded liens will include: disclosure of certain
construction information; financial information as to the seller, the builder and or the contractor; payment of the appropriate
premium fully executed Indemnity Agreements satisfactory to the company, and, any additional requirements as may be
necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed to pay.

This notice applies to owner's policy commitments containing a mineral severance instrument exception, or exceptions, in Schedule B,

This Commitment shall be effective only when the identity of the Proposed Insured and the amount of the policy or policies committed for have been inserted in
Schedule A by the Company. All liability and obligation under this commitment shall cease and terminate six months after the Effective Date or when the policy or
policies committed for shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault of the Company.
CONDITIONS AND STIPULATIONS
1. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or
interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to
Company in writing, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the
Company is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the
Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may
amend Schedule B of this Commitment accor-lingly, but such amendment shall not relieve the Company from liability previously incurred pursuant to
paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of
Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply
with the requirements hereof or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon
covered by this Commitment. In no event shall such liability exceed the amount stated in Schedule A for the policy or policies committed for and such
liability is subject to the insuring provisions and the Conditions and Stipulations and the Exclusions from Coverage of the form of policy or policies
committed for in favor of the proposed Insured which are hereby incorporated by reference and are made a part of this Commitment except as
expressly modified herein.
4. This commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a report of the condition of title. Any action
or actions or rights of action that the proposed Insured may have or may bring against the Company arising out of the status of the title to the estate or
interest or the status of the mortgage thereon covered by this Commitment must be based on and are subject to the provisions of this Commitment.
5. The policy to be issued contains an arbitration clause. All arbitrable matters when the Amount of Insurance is $2,000,000 or less shall be arbitrated at
the option of either the Company or the Insured as the exclusive remedy of the parties. You may review a copy of the arbitration rules at

STANDARD EXCEPTIONS
In addition to the matters contained in the Conditions and Stipulations and Exclusions from Coverage above referred to, this Commitment is also subject to the
following:
1. Rights or claims of parties in possession not shown by the Public Records.
2. Easements, or claims of easements, not shown by the Public Records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, and any facts which a correct survey or inspection of the Land would
disclose and which are not shown by the Public Records.
4. Any lien, or right to a lien, for services, labor or material theretofore or hereafter furnished, imposed by law and not shown by the Public Records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the Public Records or attaching subsequent to the
effective date hereof but prior to the date the proposed insured acquires of record for value the estate or interest or mortgage thereon covered by this
Commitment.

Dear Ms. Reckert:
The Julia Greeley Home, Inc. (hereinafter "Greeley") is under contract to purchase the
properties listed above. Mr. and Mrs. Panio, either as joint tenants or as the AMOF Partnership,
currently own the property and have been operating an adolescent treatment facility. The
Panios are applying for a Consolidation Plat for unifying these properties into a single parcel.
A: Background:
All properties are currently being operated as an adolescent residential treatment program.
The parcels were purchased by two different ownership entities.
1. Address: 10001 W. 32nd Avenue:
a) Structures: Currently contains three buildings (Parcel ID No. 39-281-00-030):
11 The main structure (previous main residence) is the office, treatment, facility dining room
and kitchen with second floor sleeping quarters for female residents.
2] A two story dormitory for male residents is adjacent to the east.
31 A small "caretaker's residence is near the dormitory structure, closest to Kipling.
b) Parcels at 10001 W. 32nd Ave. (Jefferson County Tax Schedule Nos: 163213 and 995448):
Currently contains two parcels, I believe that Schedule No. 995448 should not be shown
as a separate parcel, but has a lienholder with an incorrect or incomplete legal
description. Panics' have retained an attorney to remove this "orphan" parcel from their
property description by tracking down the lienholder to remove this mortgage
and can then provide a re-freshed title commitment for the Consolidation Plat.
1 ] The three structures listed above are on one parcel.
2] the parcel also contains approximately 20% of the footprint of the barn converted
to a recreation hall/crafts or meeting facility that is encumbered by the mortgage.
2. Address: 3250 Hillside Drive: (Parcel ID Nos: 39-281-00-023 and 39-281-00-029)
a) Structures at 3250 Hillside Drive: Currently contains two buildings:
I] The original single family residence on this site has been converted to a sleeping
quarters for female residents.
2] The second structure was originally a barn, (appurtenant to the single family
house) but was converted to use as a recreation or crafts space. The lot line
goes through this structure - leaving 80% of the building within this property -
which absolutely must be corrected.
3] These structures are separated by a parcel that is not in the Panios' ownership
(Parcel ID No. 39-281-00-026) which consists of a retaining pond for ditch water,
which may now be an abandoned use.
B: Implications:
There is a lot line that splits a barn -like structure into 80% on one side of the line and
20% on the other side of the line. There is no internal structure or fire wall to separate the
space. This must be corrected by the Consolidation Plat. This deed condition may have
existed prior to the Panio's purchase, and, if that is the case, indicates that the Panio's may
have even purchased the property with this erroneous deed. A prior owner discovered that
the property taxes had not been paid on the parcel and offered the property to the
Panios for the back taxes due. Refinancing by the previous owner may have compounded
the deed error by placing an encumbrance on one part of the structure and not on the
whole structure.
2. Greeley seeks to purchase all of the parcels as one legal description which would allow
them to purchase and obtain title insurance on one "legal" parcel; thus the need for a
Consolidation Plat of all parcels under single ownership.
3. Julia Greeley Home, Inc. intends to use the facilities in their current condition. There are no
plans for any Building Permits on these existing structures.
I will be the contact person, along with Bradley Zieg, agent for the Greeley Home, Inc. who will
attend meetings or staff conferences on this matter. Please let me know if there is any
additional information the Wheat Ridge staff needs to discuss this application.
