Dear Chief Brennan,
First, I want to apologIze for taking so long to get this letter to you. Two of your officers performed
admIrably on one of our scenes and I wanted to get their names before sending you this letter.
On November 3rd, 2005 @ 7.20 a.m. we receIved a call at 3660 Miller Court. The call was toned as
a possible structure fire with smoke in the garage. I was in the area and responded directly to the scene.
Upon arrival I saw that two of your officers were standing m front of the residence talking to a woman
in a bathrobe. After exiting my vehIcle I made contact with your officers and they informed me that the
woman in the bathrobe was the occupant of the residence in question. They said that the woman had
reported that she had entered the garage earlier that morning and saw that the garage was full of smoke
and called 911. The officers also informed me that the resIdence was evacuated and that the occupants
were in the minivan parked down the street.
At this time, fire apparatus and personnel began arriving on scene and the task of controlling the
situation was underway
Your officers at this time were busy controlling the traffic on Miller Court (and at this time of the
day everyone was preparing to go to work), kept the neighbors away from the fire ground and out of
harms way as well as keepmg an eye on the occupants of the residence and seeing to their safety and
comfort.
These officers, Kyle Eversole and Michelle Abbott performed their duties above and beyond what
was expected of them and doing so in a cordial and profeSSiOnal manner. I believe that thIS scene went
as well as it did because of the assistance your officers gave to us and because of this I would like to
commend them for a Job well done.

Dear Mayor Cerveny:
Please accept this as my letter of resignation from my position as the Associate
Municipal Judge for the City of Wheat Ridge effective December 31, 2005. This
decision to resign is tinged with regret for I have been privileged to have served
the citizens of Wheat Ridge for the last 18 years.
However, the caseload volume in the Thornton Muncipal Court, where I have
served as Presiding Judge since 1992, has led to Thornton's decision to
transition to a full-time Municipal Court commencing in 2006. As a result of that
decision, the Council has offered me the opportunity to become their first full-
time Municipal Court Presiding Judge.
During my tenure in Wheat Ridge, I have experienced the growth of the Court,
the transition to day court from night court and the leadership and innovation of
court personnel in areas such as the Domestic Violence fast track program. I
have been witness to the challenges of the staff in not only skillfully operating the
court through these changes but doing so with the highest of integrity, knowledge
and compassion The competence, professionalism and dedication of fanner
Judge Randall Davis, Judge Christopher Randall, Court Administrator Kersten
Armstrong, Probation Officer Ruth Howard and all of our staff throughout these
years have been instrumental in all of the achievements by our Court. I'm proud
to have been associated with such wonderful people and will greatly miss the
friendships nurtured during this time.
Thank you for the trust shown in me by allowing me the opportunity to have
served Wheat Ridge for all of these years.

Jeff Dean, 3424 West 40th Avenue, Denver, spoke on behalf of the developer, as an
employee of IBC Holdings He stated his opposition to the emergency ordinance due to
the market inefficiencies that it will cause
Motion by Mr Schulz to direct staff to prepare a standard ordinance to include a
narrower scope of the types of applications that would be subject to the temporary
suspension and that the ordinance be brought to first reading at the first available date,
seconded by Mrs Rotola, carried 6-2, with Mrs Sang and Mr Gokey voting no

City Clerk Pam Anderson collected the voted nomination ballots and announced the
results Mrs Sang received the majority of the nominations for Mayor pro tem, and Mr

Motion by Mrs. Sang to appoint Mike Stites as Council President, seconded by Mrs
Rotola, carried 8-0

EXECUTIVE SUMMARY:
In the past, the Wheat RIdge Police Department has contracted with a private vendor to provide
prisoner transportation from jail to jail or to provide jail transports to the Municipal Court for
prisoners being detamed on Wheat Ridge warrants. When this vendor went out of business, the PolIce
Department had to provide for jail to jail transports and transports to court. Providing this service took
patrol officers off the street impacting deployment and ability to provide emergent servIces.
In 2004, the PolIce Department and Municipal Court put together a Court Marshal program for the
City The CIty hired two part-time marshals to provide jail to jail transports and to bring individuals
from the county jail to Municipal Court. This Court Marshal program was designed to transport
prisoners from metro area county Jails (i.e. Denver, Boulder, Adams, Arapahoe and Douglas) where
the majority of our arrestees are being detamed, but did not address the occasion when a prisoner is
bemg held outside of the metro-area.
When mdivIduals are arrested outside of the metro area the Police Department uses the Jefferson
County Sheriffs Office to assist with transport. In the past, this service was provided by the Sheriffs
Office free of charge or in exchange for our Court Marshals transporting some of theu prisoners.
Unfortunately. this servIce IS no longer the provided by the Sheriffs Office free of charge. The
Sheriffs Office has asked that all law enforcement agencies within Jefferson County now pay for any
extended area transports. The cost for this service is $75 00 for the first prisoner and $35 00 for any
addItIOnal pnsoners transported. This request was submitted by the Shenffs Department in early
2005. Although we have not had to use this service to date, we anticIpate that we may have to at some
time in the future The Police Department has budgeted $75000 in the 2006 budget for this purpose.
The Shenffs Office has also asked that the Police Department enter mto an IGA WIth them for the
purpose of transporting pnsoners outSIde of the metro area.
The types of crimes for which the Police Department mIght need to extend extradition boundaries
would be domestic violence, restraining order violations, assaults and more senous misdemeanor
cases. Based on available data, it has been determined that less than ten (10) transports would be
needed m 2006.
COMMISSIONIBOARD RECOMMENDATION:
N/A
STATEMENT OF THE ISSUES:
The Wheat RIdge Police Department IS responsible for the transport of prisoners being detamed in
other jurisdictIOns on our muniCIpal charges. The Court Marshals currently transport prisoners within
the five county metropolitan region. Statewide extradition and transportation of pnsoners held on
Wheat RIdge municipal charges in other locations in the State are the Police Department's
responsibility The Jefferson County Sheriffs Office no longer provides this transportation service
free of charge to law enforcement agencies m Jefferson County.
AL TERNA TIVES CONSIDERED:
Three alternatIves were considered.
1 There are no private vendors who provide this service at a lower cost than the Sheriffs Office
2. The Wheat Ridge Police Department could provide thIS service; however, it would not be as cost
effectIve and would take valuable personnel resources away from more emergent service delivery
3 The City could discontmue extradition of offenders who commit serious misdemeanor offenses
such as domestIc violence, restraining order violations and assaults. It is not in the best interest of
the community's safety to take such an approach.
FINANCIAL IMPACT:
Funding for this program is budgeted in the 2006 Adopted Budget, account 01-211-700-750
(Professsional Services). The recommended amount is minimal as we do not anticipate many
transports outside of the metro-area.
RECOMMENDED MOTION:

INTERGOVERNMENT AL AGREEMENT
FOR PRISONER TRANSPORT SERVICES
(Wheat Ridge)
THIS AGREEMENT, dated for reference purposes only this 24th day of March,
2005, is entered lllto by and between the COUNTY OF JEFFERSON, STATE OF
COLORADO, a body politic and corporate (the "County"), for the use and benefit of the
JEFFERSON COUNTY SHERIFF'S OFFICE (the "Shenffs Office") and the CITY
OF WHEAT RIDGE, COLORADO (the "City")(collectively, the "Parties")
WHEREAS, pursuant to the provisions of C.R.S. S29-1-203 and S18(2)(a) of
Article XIV of the Colorado Constitution, the County and the City are legally authorized
to cooperate and contract with each other for the purpose of intergovernmentally
providing any function, servIce or facility authorized to it, and to provide for the joint
exercIse of the function, service or facilities; and
WHEREAS, the City is authorized as part of its governmental functions to
request the issuance of wrIts mandating the appearance of prisoners in the Jefferson
County County and District Courts, and warrants for the arrest of persons who have
violated the laws of the State of Colorado withm the jurisdictIOn of the City (the "Wheat
Ridge arrestees" or "arrestees"); and
--
WHEREAS, the County is authorized as part of its governmental functions to
pick up and transport such persons to the Jefferson County Detention Facility (the
"Facility"); and
WHEREAS, the County and the City are desirous of cooperating with the County
for transport or Wheat Ridge arrestees to the Facility for a mutually agreed upon price.
NOW, THEREFORE, for and in consideration of the mutual promIses,
covenants and other good and valuable consideratIOn, the sufficiency of which is hereby
acknowledged, the County and the City agree as follows:
ARTICLE I
Period of Agreement
This Agreement shall commence on January 1, 2006 and shall continue to and
including December 31, 2006. The Agreement shall continue from year to year thereafter
until terminated by either party. As this Agreement may contmue beyond the current
year, the parties understand and intend that any financial obligatIOn contained herein is
contmgent upon each party's legIslative bodies' authorization of funds. In the event anv
partv fails to appropriate funds require hereunder. this Al!:reement shall terminate
as of the last day of the calendar year for which funds have been appropriated. No
expense incurred pursuant to this Agreement shall be construed to be a multi-year fiscal
oblil!:ation nor a general oblIgation indebtedness within the meaning of any provision of
Article X, Section 20 of the Colorado Constitution.

ARTICLE II
Transport of Arrestees
A. The Jefferson County Sheriffs Office Transportation Unit (the
"Transportation Unit") will pick up and transport Wheat Ridge arrestees to the FacIlity at
the request of the City. The City will desIgnate an employee of the Wheat Ridge Police
Department to coordinate the pick up and transport of Wheat Ridge arrestees with
desIgnated Transportation Unit Personnel.
B. The County, in its sole discretion, may coordmate the transport of certain
Wheat RIdge arrestees outsIde the Denver metropolitan area WIth Transports Across
Colorado, a network of law enforcement agencies working in cooperatIOn to facilitate the
transport of prisoners. The City agrees to pay the County the full price for the transport
of each Wheat Ridge arrestee, as set forth m Article III of this Agreement, whether or not
Transports across Colorado is mvolved m the transport of that arrestee.
C. The County, in its sole discretion, may refuse to pIck up or transport any
Wheat Ridge arrestee.
ARTICLE III
Payment
A. The City shall pay the County seventy-five dollars ($75,00) for the
transport of the first Wheat Ridge arrestee per trip If addItional Wheat Ridge arrestees
are transported in the same trip, a charge of thirty-five dollars ($35.00) for each
addItional arrestee shall be assessed.
B On a monthly basis, the County shall provide a written mvoice to the City,
detailing the number of transports and arrestees included in each transport. The County
and City shall work together to review and confirm the number of transports prior to the
submiSSIOn of the invoice to the City. Payment shall be due thirty (30) days following
the date of mvoice.
C. The County reserves the right to increase the rates described in ArtIcle III,
paragraph A above, upon mutual agreement of the parties to this Agreement, which
agreement shall be set forth in writing and shall serve as an amendment to this
Agreement.
ARTICLE IV
Termination
This Agreement may be termmated by either party upon written notice to the
other party of its intention to terminate thirty (30) days prior to the effective date of
terminatIOn. The County's obligations to the City under this Agreement shall terminate
upon termination of this Agreement. The City shall be obligated to pay for all transports
provided by the County through the date of termination of this Agreement.

ARTICLE V
No Liability
To the extent permitted by law and without waiving rights provided under the
Colorado Governmental Immunity Act or other law, the City shall hold and save the
County, its elected officials, agents and employees harmless, and shall mdemmfy the
County from any costs, damages, claims injunes or losses incurred by the City resulting
from the provision of transportation services under this Agreement.
ARTIVLE VI
Employment Status
Neither this Agreement nor any services performed hereunder shall constitute any
change m the employment status of any employees of the parties to this Agreement. It is
addltionally understood and agreed that the City shall have no nght to control or direct
the activities of any employee of the County during the performance of any servlces
under thiS Agreement. Each of the partles shall, at its own expense, keep in full force and
effect during the term of this Agreement, statutory workers' compensation insurance or
adequate self-insurance funds to provide coverage for its own personnel.
ARTICLE VII
Amendments to this Agreement
This Agreement constitutes the entire agreement between the County and the City
and may only be amended m writmg executed by both parties.
ARTICLE VIII
Officials Not To Benefit
No elected official or employee of the County or the City shall be personally paid
or personally recelve directly or indirectly any share or part of thlS Agreement or any
benefit that might arise therefrom.
ARTICLE IX
Venue and Governing Law
Venue for any and all legal actions regarding the transactlOns covered herem shall
lie m the Distnct Court in and for the County of Jefferson, State of Colorado, and this
Agreement shall be governed by the laws of the State of Colorado

Notices
Any notIce required or permitted by this Agreement shall be in writing and shall
be deemed to have been sufficIently given for all purposes If sent by certIfied mail or
registered mail, postage and fees prepaid, addressed to the party to whom such notice is
to be given at the address set forth below, or at such other address as has been previously
furnished in writrng to the other party.

TITLE:
A RESOLUTION APPROVING AN INTERGOVERNMENTAL

WHEREAS, the Police Department does not have the personnel
resources, nor the time, to provide transportation for prisoners outside the
metro area; and
WHEREAS, although the City has a Court Marshal program, the
transportation of prisoners outside the metro area, IS outside their scope of
coverage for transporting pnsoners; and
WHEREAS, the City has found alternative transportation in the past,
those services no longer exist for the Police Department and Municipal
Court; and
WHEREAS, Jefferson County Sheriffs Office provides this service to
all Jefferson County agencies, it is a cost savings service to the City of
Wheat Ridge
NOW THEREFORE BE IT RESOLVED by the City Council of the
City of Wheat Ridge, Colorado, as follows:
The City of Wheat Ridge agrees to enter into an Interagency Governmental Agreement
with the Jefferson County Shenffs Office for the express purpose oftransportmg Wheat
Ridge arrestees/pnsoners from jail facilIties outside the metro area, to the Jefferson
County Jail.
. Cost for this service, under the IGA, for the fiscal year 2006 will be $75 00 for the
first prisoner and $35.00 for each additlOnal prisoner transported.
. ThiS contract will be re-negotiated each year to determine the transportation fee.

EXECUTIVE SUMMARY:
Section 39-5-128 of the Colorado Revised Statutes (C.R.S.) reqUires the Jefferson County Assessor to
certify to the CIty the total valuatIOn for assessment of all taxable property located withIn the territorIal
limits of the CIty of Wheat Ridge. The total net assessed valuation for the City for the year of2005 is
$396,211,440 which IS an increase of $17,656,230 compared to the year of 2004. The City IS also
required by this same section of the c.R.S to offiCIally certify the property tax mill levy to the
Jefferson County Board of County Commissioners by December 15, 2005 The City's property tax
mill levy was temporarily reduced from I 860 mills to 1.806 mills for the 2004 budget, increased to
1.830 mills for the 2005 budget, and will agaIn temporarily decrease by 0.074 mills to 1.786 mills for
the 2006 budget, potentially raising $707,633 in property tax revenue, an Increase of $15,009
compared to 2005
Section 20 of Article X of the ConstItutIOn of Colorado, the Taxpayers Bill Of Rights (TABOR),
restrIcts increases in property tax revenue to inflation plus local growth (defined as the percentage
change in actual value of real property from construction of taxable real property Improvements). This
allowable growth for the City in 2005 is 2.16%. TABOR also restricts the CIty from raising the
property tax mill levy without voter approval unless the mill levy was temporarily reduced in a
prevIous year

2006 BUDGET YEAR
WHEREAS, the City Council of the City of Wheat Ridge adopted the 2006 annual
budget on October 10,2005 m accordance with the Local Government Budget Law, and;
WHEREAS, the amount of money necessary to balance the budget for general operatmg
purposes from real property tax revenue is $707,633, and;
WHEREAS, the Local Government Budget Law requires certification of the annual
property tax mill levy by December 15, 2005, and,
WHEREAS, the total net assessed valuation of all taxable property subject to taxation
for the year of 2005 is $396,211,440 and,
WHEREAS, the City for the fiscal year 2005 has determined to levy 1 860 mills on all
taxable property within the City; and
WHEREAS, such levy will cause the revenues to the City to exceed the hmitations set
forth in Section 20 of Article X of the Constltution of Colorado (The Taxpayers Bill of Rights)
TABOR by approximately $29,320; and
WHEREAS, the City has determined to comply with the TABOR property tax revenue
limit by applymg a temporary mill levy reduction of 0.074 mills for a total levy of 1 786 mills on
all taxable property withm the City; and
NOW, THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF WHEAT RIDGE:
A. That for the purpose of meeting all general operating expenses of the City of
Wheat Ridge during the 2006 budget year, there is hereby levied a tax of I 786
mllls, after a temporary mill levy reduction of 0 074 mills, placed upon each
dollar of the total valuation of all taxable property Within the City of Wheat Ridge
for the year 2005.
B. That the Mayor of the City of Wheat Ridge is hereby authorized and directed to
immediately certify to the County Commissioners of Jefferson County, Colorado
the mill levy for the City of Wheat Ridge as herein above determmed and set
DONE AND RESOLVED THIS

EXECUTIVE SUMMARY:
The Wheat Ridge Clty Councll may adopt by motion the 2006 City Council Regular Meeting
Calendar This mcludes scheduled meetings for regular City Council Meetings, Study Sessions,
quarterly Dlstrict meetings, the Annual Town meeting, and Clty of Wheat Ridge hohdays. The
proposed calendar lS Attachment 1.

STATEMENT OF THE ISSUES:
The regular meetmgs of the Wheat Ridge City Council are based on the Clty Council Rules and the
City Charter. It should be noted that the two Study Sessions in January and February that fall on
holidays when the City is closed have been scheduled for Tuesday, January 1 th and Tuesday,
February 21 5t Also, as Independence Day falls on a Tuesday this year, the July 3rd Study Session has
been eliminated to allow for holiday travel. Adopting the regular meetmg calendar for the year is more
efficient and enables the Mayor, Council and staffto schedule other events and travel in advance. The
Council will be able to amend the schedule by motlon throughout the year, lfnecessary

EXECUTIVE SUMMARY:
The duties of the Parks and Recreation Commission are to regularly consult with the DIrector of Parks
and Recreation, review all existing and proposed legislation relating to parks and recreation matters,
make recommendahons on parks and recreation matters to the City Council, act as liaison between the
department of parks and recreation and the community at large; promote and develop positive
relationshIps with communl~ groups, other public agenCIes and the general public; encourage the
widest possible citizen understanding of parks and recreatlOn activities; and seek cIhzen adVIce and
support for the proper management and operation of parks and recreation faCIlities. The Commission
has the authon~ to develop parks regulations for the proper management, operatlOn, and control ofthe
parks, parkways, and other recreation facilities within the CIty. The CommisslOn meets the 3rd
Wednesday of every month at 7'00 p.m. at the Recreation Center There IS a vacancy on the
commission for District II, with the term expinng on March 2, 2007

STATEMENT OF THE ISSUES:
An application was receIved on October 27, 2005 for a pOSItion on the Parks and Recreation
CommisslOn from Ryan Eggleton of District I. Currently, a vacancy occurs in Distnct II, term endmg
March 02, 2006 Section 9.3 of the Wheat Ridge Charter states "All boards and commissions shall
have approximately equal representation from each council district" ArtIcle II, Section 2-53( c) ofthe
Code of Laws states, "All appointments to all boards and commissions shall be made to achieve equal

representation from each council district to each board or commission. If, after reasonable
advertisement, no applications are received from residents within the relevant council distnct for a
vacancy on any board or commission, the council may appoint any otherwise qualified resident." The
Distnct II vacancy has been reasonably advertised on the City of Wheat RIdge web-site and Channel 8
for a period no less than 2 weeks. Mr. Eggleton's applicatIon was the only one received for the
vacancy. To provide for an equal distribution of overlapping terms, this term will expire on March 2,
2007

METROPOLIT AN BOARD/AGENCY APPOINTMENTS
Denver Regional Council on Government (DRCOG):
The Denver RegIOnal Council of Governments or DRCOG (pronounced Dr. COG) IS a
voluntary association of 50 county and mumclpa1 governments in the Greater Denver
area. Through DRCOG, local governments work to address issues of regIOnal concern.
Those issues mclude growth and development, transportation, the enVIronment, provIsion
of services to the region's older population, and analysis of economic and development
trends. Besides promoting regIOnal cooperatIOn and coordmation among local
governments, DRCOG resolves problems, performs regional plarming, and provides
servIces to its members. Each member local government has an elected official as its
representative on the Board of Directors. V otmg membership IS restricted to local elected
officIals. county commissioners, mayors, city council members or trustees.
DRCOG meets the 3rd Wednesday of the month at 7:00 p.m. (sub-committees and
one day-long retreat) Current member Mayor Cerveny; Larry Schulz, alternate.
Jefferson Countv-wide TransDortation Committee
ThIs commIttee addresses county transportation issues, i.e Northwest Corridor Plan.

The mISSion of the Jeff Co Housing Authonty "After assessmg the needs, provide
affordable housing throughout Jefferson County to the greatest number of eligible people

Communitv DeveloDment Block Grant Committee (CDBG)
The CDBG CommIttee IS a federally funded grant that was created to Improve the
physical. economic and social conditions for low and moderate-mcome residents or low-
income areas of Jefferson County. The grants may be used for: acquisition, disposition,
and rehabIlitation. new constructIOn of property, public facilities improvements, urban
renewal completIOn, relocation, home ownership, and housing services.

Jefferson Countv Board of Corrections
The Community Corrections unit screens and recommends placement of adult and
juvenile offenders diverted from incarceration and monitors offender progress and
program compliance. The unit also contracts with private community corrections servIce
proViders for residential and non-residential services. Community Corrections supports
two volunteer boards appointed by the Jefferson County Board of CommiSSIOners.
Information on offenders referred to Community Corrections is prepared and presented to
the Board of CorrectIOns. The decisions of the Board are communicated to the courts, the
Department of Corrections and the DiVIsion of Youth Corrections.

Police Seizure Fund
Beginning with 1990, all proceeds from seizures and forfeitures of property pursuant to
C.R.S. 16-13-501 ("Colorado Forfeiture Act') are reqUIred to be placed in a separate fund
and used solely by the Police Department for purposes other that normal operating needs.

Jefferson Economic Council (JEC)
The JEC is a public/private not-for-profit partnership serving Jefferson County and is one
of the oldest and largest economic development organizations in Colorado The JEC
concentrates on creating, expanding, and retainmg high-paying primary jobs that fuel the
economic health and vitalIty of our commulllty A 36-member Board of Directors,
conslstmg of21 votmg members and 15 ex-officio members governs the JEC The Board,
representing a broad spectrum of industries and city/county government, help shape and
direct economic policy in Jefferson County and the metro area. Members of the Board of
Directors also serve on several volunteer committees that gUIde the operations of the JEC
and study and act on business issues in Jefferson County The appointment IS an elected
official.
Meets on the 3rd Friday of the month; 7:30-9:30 p.m. Current member Mayor

Dear Pam,
I would to like to represent the City of Wheat Ridge as an alternate on the Denver Regional Council of Gov-
ernment (DRCOG). My experience includes over 15 years working with regional planning issues and I have
worked with DRCOG in the following ways:
. As a member of the Jefferson County Planning Staff, I worked on the Metro Vision Land Use Plan
. As a board member of the Jefferson Conservation District, I participate in the DRCOG Clean Water Action
Plan through the Bear Creek Watershed Association. I recently completed a project with DRCOG and the
BCWA that looked at the impacts of existing and future land use on the water quality of Bear Creek Reservoir
. Through Jefferson County and the Conservation District, I have evaluated proposed amendments, submitted
to DRCOG, to the Urban Growth Boundary. I have a good understanding of the social, economic, environ-
mental, and legal considerations of regional growth and how such growth affects urban, suburban, and rural
communities.
. As a board member of several watershed organizations, I have worked with various DRCOG committees,
such as the Water Planning Committee. I have a good understanding of regional transportation issues, in-
cluding how transportation funding is handled and how land use issues, such as the Urban Growth Bound-
ary, impact transportation funding.
. In 2005, I attended the DRCOG Board of Directors strategic planning workshop and participated in planning
sessions with the board. I have also attended Metro Vision, Clean Water Action Plan, Aging, and Transporta-
tion workshops sponsored by DRCOG.
In addition, if Council member Schulz does not submit a request for appointment to the Housing Authority, I
would like this letter to serve as my request. I have extensive experience in the processing of land use and
building permit applications, project management, construction management, and working with non profits.
My work as a planner includes affordable housing projects and I feel that I can help the Housing Authority con-
tinue its record of success.
