Plan: Neighborhood; Main Street Corridor Existing Site Conditions: The property is located on the west side of Pierce Street between W. 37h Place and W. 38b Avenue. The property is in the Mixed Use — Neighborhood (MU -N) zone district. The surrounding area consists of a mix of uses and zone districts. Most parcels along W. 38a' Avenue are also zoned MU -N and contain primarily commercial uses. The parcel directly to the north is zoned Commercial -One (C- 1) and contains an auto repair business. Parcels to the south along Pierce Street are zoned Residential - Three (R-3) and contain a mix of multifamily buildings, duplexes, and single-family homes. The site consists of two parcels. According to the Jefferson County Assessor, the northern parcel is 10,759 square feet and the southern parcel is 13,826 square feet, totaling 24,585 square feet (.564 acres). Two L-shaped apartment buildings are on the site, containing four units each. A small building on the northern parcel behind the main building contains an additional unit and an office. A small accessory structure is on the southern parcel behind the main building. According to the Jefferson County Assessor, all buildings were built in 1938. The L-shaped buildings are approximately 2,360 square feet each. Applicant/Owner Preliminary Proposal: The applicant has proposed the consolidation of the two existing parcels into one larger parcel. They are currently under contract to purchase the two parcels together. The applicant would like to convert the existing office space in the small building in the northwest corner into two studio apartments, bringing the unit total from 9 to 11. They have also proposed cosmetic upgrades, including new paint, landscaping, and interior upgrades. The upgrades would primarily be exterior work in order to increase curb appeal, and the property would be fenced on the sides and rear. A consolidation plat for the two parcels is necessary to meet the density standard in the MU -N zone district to allow the two additional dwelling units. Will a neighborhood meeting need to be held prior to application submittal? A neighborhood meeting will not be required. Planning comments: The following items were discussed based on the applicant's proposal: Zoning & Use The MU -N zone district is generally located along neighborhood main streets and neighborhood commercial centers. It was established to encourage medium density mixed use development. In addition to residential and civic uses, it allows for a more limited range of neighborhood -serving commercial and retail uses. The existing and proposed uses act as a transition from the 38th Avenue corridor to the neighborhoods to the south on Pierce Street. Consolidation Plat The applicants are a proposing a consolidation plat in order to take advantage of the density maximums for the MU -N zone district. The purpose of the City's subdivision regulations are to promote logical lot layouts and enable development, and the proposed consolidation meets these goals. Open Space In the mixed use zone districts, it is required that 15% of the site is open space for a single -use development. Open spaces include planted areas as well as hardscaped areas, such as plazas. The site currently exceeds the 15% requirement. Of the 15% coverage, 75% is required to be usable open space as defined by 26-1116 of the zoning and development code. Automobile Parking The proposed development will require at least 11 parking spaces (1 per unit). Use Group A Minimum Required Parking Maximum Allowed Parking Residential 1 space per unit 2.5 spaces per unit A For other uses, please refer to Section 26-1109 of the Wheat Ridge Municipal Code Since the development is not undergoing a major change of use or expanding its footprint, the existing gravel parking lot in front of the buildings along Pierce Street may continue to exist in its current nonconforming condition. However, staff has encouraged the construction of a new paved parking lot consisting of 6 parking spaces, which would also accommodate future Pierce Street improvements. 2 The applicant noted that the access easement off of W. 38`x' Avenue through the property to the north would remain in place, allowing residents to access the parking spaces at the northwest corner of the site. Driveway Improvements The first 25 feet of driveway area from the existing edge of pavement into the site shall be surfaced with concrete, asphalt, brick pavers, or similar materials. The driveway along the southerly portion of the subject property must comply with this requirement. Utility Providers The City of Wheat Ridge is not a full-service city. The utility and service providers for this property include: • West Metro Fire Protection District: 303-989-4307 • Wheat Ridge Water District, phone: 303-424-2844 • Wheat Ridge Sanitation District, phone: 303-424-7252 All land use applications will be sent out on referral to these agencies for comment; however, staff encourages potential applicants to contact service districts ahead of time. This may help to understand any design or infrastructure requirements and potential costs associated with the proposed project. Building Division comments: New construction will require building permits, and the issuance of a Certificate of Occupancy upon completion of the project, and only after passing all of the required inspections. The City has adopted and currently enforces the 2012 Edition of the International Codes and the 2014 Edition of the National Electric Code. The City uses the ANSI 117.1-2009 Standard in determining requirements related to accessibility. Staff encouraged the applicant to have preliminary conversations with West Metro regarding building upgrades for the proposed two new units. Public Works comments: The following items were discussed based on the applicant's proposal: Public Improvements The applicant will not be required to construct public improvements along Pierce Street. The current parking configuration requires vehicles to back out into the public right-of-way, which is disallowed by Municipal Code. Public Works has proposed a solution to this issue, which will create a far safer condition. Refer to the attached Public Works comments and site map for more information. Public Works has requested funding for 2018 to complete public improvements along Pierce Street along the frontage of the property, under the condition that the owner agrees to construct the improved parking facility. All work within the public right-of-way, including driveway connections, must receive the necessary Right -of -Way Construction Permit(s). 3 Review Process Consolidation plat A formal application may be submitted now that the pre -application meeting is complete. Applications must be submitted by appointment with a planner. Incomplete applications will not be accepted. A subdivision or lot line adjustment consisting 3 or fewer lots or parcels is considered an administrative subdivision. An administrative plat does not require a public hearing. Upon submittal of a complete application, the case manager will review the application, send it out on referral to outside service agencies (Xcel Energy, water district, fire district, etc.) and other City agencies (Public Works, Economic Development, etc.) for review. The referral period is 15 days, during which time the referral agencies and departments may submit comments on the application. These comments, as well as those from the case manager, will be forwarded to the applicant. Modifications to the subdivision plat may be required as a result of these comments. The applicant must address comments and resubmit relevant documents. This process may need to occur several times. Once all comments have been addressed to the case manager's satisfaction, they will prepare written findings with a recommendation. The Community Development Director will review the plat and approve, approve with conditions, or deny the plat. Once approved, a blackline mylar copy of the plat with original signatures in black, indelible ink must be submitted to the City of Wheat Ridge in order to be recorded with Jefferson County Clerk and Recorder. The plat must be approved and recorded prior to the issuance of any building permits.
