At its meeting of March 2, 2017, Planning Commission recommended APPROVAL of Case No.
MS -16-07, a request for approval of a Minor subdivision/consolidation plat for property zoned
Residential -One C (R -1C) located at 3330 Chase Street, for the following reasons:
1. The parcels are consistent with the R -IC zone district regulations.
2. All requirements of the subdivision regulations have been met.
3. Utility districts can serve the property with improvements installed at the developer's
expense.
With the following condition:
1. Fees in lieu of land dedication in the amount of $2497.29 be paid at the time of Mylar
submittal for recording.
Enclosed is a draft copy of the minutes stating the Commission's decision.
A blackline Mylar of the plat with original signatures (in black, indelible ink) needs to be
submitted for recording with Jefferson County within 60 days of final action. Recording fees in
the amount of $21 must be submitted with the Mylar.

7. PUBLIC HEARING
A. Case No. MS -16-07: An application filed by 38 Street, LLC for approval of a
minor subdivision/consolidation plat for property zoned Residential -One C (R -1C)
TV located at 3330 Chase Street.
Ms. Reckert gave a short presentation regarding the subdivision/consolidation plat
and the application. She entered into the record the contents of the case file, packet
materials, the zoning ordinance, and the contents of the digital presentation. She
stated the public notice and posting requirements have been met, therefore the
Planning Commission has jurisdiction to hear this case.
Commissioner DORSEY asked if curb and gutter will be discussed at a later date,
once this case is approved.
Ms. Reckert confirmed that curb and gutter will be assessed later.
It was moved by Commissioner DORSEY and seconded by Commissioner
KIMSEY to approve Case No. MS -16-07, a request for approval of a two -lot
subdivision plat for property addressed as 3330 Chase, for the following
reasons:
1. The parcels are consistent with the R -1C zone district regulations.
2. All requirements of the subdivision regulations have been met.

All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.
I. REQUEST
The applicant is requesting approval of a two -lot minor subdivision plat on property zoned
Residential -One C (R-1 C). The purpose of the subdivision is to consolidate parcels to create two new
single-family development sites.
A neighborhood meeting is not required for a subdivision plat. Because this plat involves four parcels,
Planning Commission is the final authority on the land use approval.
II. EXISTING CONDITIONS/PROPERTY HISTORY
Subject property
The property is located on the east side of Chase Street, north of 33rd Avenue. The subject property
was platted in 1889 via the Columbia Heights Subdivision which subdivided the area bounded by
Sheridan on the east, Depew on the west, 32nd on the south and 35th on the north into lots measuring
25' x 125'. As a result, the home sites in this area are comprised of several of the parcels from the
Columbia Heights Subdivision. (Exhibit 1, Columbia Heights Plat)
In this case, 3330 Chase consists of Lots 15, 16, 17, and 18 of the Block 7. An existing house built in
1909 and a large accessory structure were recently demolished but are viewable in the attached aerial
photo. The subject property is 12,500 square feet (0.29 acres) in size. (Exhibit 2, Aerial Photo)
Adjacent zoning and land use
The zoning in the area is largely Residential -One C (R -1C) and Residential -Three (R-3). (Exhibit 3,
Zoning Map) The subject property is zoned R -IC. The surrounding area is largely comprised of
single-family homes and apartment buildings. (Exhibit 4, Site Photos)
III. SUBDIVISION PLAT
Attached is a copy of the proposed plat, which contains two sheets. (Exhibit 5, Plat)
Sheet 1 is the declaration page and contains the legal description, required signature blocks for
property owners, and recording block and notes.
Sheet 2 illustrates the new lot configuration with the two parcels. The plat essentially combines the
northern two lots (Lots 15 and 16) into Lot 1 and the southern two lots (Lots 17 and 18) into Lot 2.
Both parcels meet or exceed the R -1C lot size and width requirements of 5000 square feet and 50',
respectively. See below. No right-of-way dedications were required with this plat.

Staff concludes that the proposed new lots are consistent with the lot width and size requirements in
the R -1C zone district and that all requirements of the subdivision regulations contained in Article IV
of Chapter 26 have been met.
IV. AGENCY REFERRALS
All affected service agencies were contacted regarding the plat document and their ability to serve the
property. The developer will be responsible for any needed upgrades to accommodate the proposed
development. Specific referral responses follow.
West Metro Fire Protection District: No comments on the plat. Can serve the property with
improvements installed at the developer's expense.
Wheat Ridge Sanitation District: Has adequate capacity to accommodate development. No
comments on the plat.
Wheat Ridge Parks Department: Is requiring fees in lieu of land dedication in the amount of
$2497.29.
Wheat Ridge Police: No concerns.
Wheat Ridge Public Works: Has reviewed and approved the plat.
Xcel Energy: Can serve. No comments on the plat.
V. STAFF CONCLUSIONS AND RECOMMENDATION
Staff concludes that both of the new parcels are consistent with the lot size and width standards of the
R -IC zone district and that all requirements of the subdivision regulations have been met. Because all
internal and external agencies can provide service to the property with improvements installed at the
developer's expense, a recommendation of approval is given for Case No. MS -16-07 with one
condition listed below.

The following are comments about the second submittal.
PLAT DOCUMENT
Sheet One
1. Since this plat will not be going to public hearing in front of City Council, modify the City
Certification language to remove "by the Wheat Ridge City Council" and replace with "by the City of
Wheat Ridge".
Sheet Two
1. As previously requested, show West 33rd Avenue as the most appurtenant street to the subdivision.
This plat will be reviewed by Planning Commission at a public hearing. Even though a break line is
depicted with reference to the location of 32"d Avenue, it will be difficult for Planning Commission to
grasp this concept. An option may be to insert a smaller depiction of the subdivision on the same
page with 33rd Avenue shown with a note of explanation.
Attached are referrals received from other city departments and outside agencies regarding the plat
document.
Wheat Ridge Public Works: See attached letter from Dave Brossman dated January 24, 2017.
OTHER
1. Please forward an approved boundary description in Word format for publication purposes for
Planning Commission.
2. This case is scheduled for Planning Commission public hearing on March 2, 2017. A posting sign will
be available for pick-up the week of February 13 and must be posted no later than February 2, 2017.
Packets for distribution will be made on February 23. Please have the final plat version to us in
electronic format by February 20.
3. If the March 2 hearing date does not work for you, the next available date is March 16.
4. Fees in lieu of parkland dedication in the amount of $2497.29 for the new residential lot will be
required at the time of plat recording.

18, 2017 and I have approved the plat for Mylar® upon completion of the following
comments:
Sheet 1:
1. In the OWNER'S CERTIFICATE: In the first sentence, all acreage must be
shown to four (4) decimal places as previously requested and required per Sec.
26-410 of the Municipal Code of Laws.
1. Please have the words "BY THIS PLAT" included in the callouts for the two lot
existing lot lines intended for removal. This is specific language the City
Attorney requires.
Upon completion of the above minor corrections, please have the applicant send us a PDF

I have completed my first review for the Mann Consolidation for the consolidation of
previously platted parcels of the property located at 3330 Chase Street received on
December 16, 2016 and I have the following comments:
PLANNING & ZONING
Subdivision Plat:
General Comments:
1. Public Works recommends using "MANN CONSOLIDATION" as the
subdivision title instead of "3330 CHASE STREET SUBDIVISION".
2. They should add a subtitle "A CONSOLIDATION OF PREVIOUSLY
PLATTED PARCELS" to enhance the description of the plat.
3. The section and township information readability would improve if the font was
less bold, the text was larger or some combination of the two.
Sheet l:
1. In the OWNER'S CERTIFICATE:
a. All acreage must be shown to four (4) decimal places.
b. The legal description refers to "f" preceding the square footage and the
acreage callouts. These are redundant and when used with the "more or
less" phrase at the end of the sentence; please select one or the other but
not both.
c. Update the subdivision title in the dedicatory paragraph of the Owner's
Certificate.
d. Need to fill in the owner's name under the signatory line.
2. In the NOTARY ACKNOWLEDGMENT, please correct the spelling of the
word "acknowledgement".
3. In the LAND USE TABLE, show Total Acreage to 4 decimal places.

previously platted parcels of the property located at 3330 Chase Street received on
December 16, 2016 and I have the following comments:

Subdivision Plat:
General Comments:
1. Public Works recommends using "MANN CONSOLIDATION" as the
subdivision title instead of "3330 CHASE STREET SUBDIVISION".
2. They should add a subtitle "A CONSOLIDATION OF PREVIOUSLY
PLATTED PARCELS" to enhance the description of the plat.
3. The section and township information readability would improve if the font was
less bold, the text was larger or some combination of the two.
Sheet 1:
1. In the OWNER'S CERTIFICATE:
a. All acreage must be shown to four (4) decimal places.
b. The legal description refers to "f" preceding the square footage and the
acreage callouts. These are redundant and when used with the "more or

Dear Ms. Reckert,
On behalf of the Wheat Ridge Sanitation District (WRSD), Martin/Martin Inc., acting as the District Engineer, offers the
following in response to the referenced referral dated December 15Th, 2016 concerning a resubdivision plat for a two
lot subdivision at 3330 Chase Street. The Wheat Ridge Sanitation District has no objections with the proposed request
conditional on the items identified herein are fully addressed. The following are general requirements for sanitary
sewer service.
The subject lot is entirely within the service and boundary area of the Wheat Ridge Sanitation District. Treatment of
sewage generated within the Wheat Ridge Sanitation District is provided by Metro Wastewater Reclamation District.
Existing District Sanitary Sewer Mainline(s)
Wheat Ridge Sanitation District has the following sanitary sewer mains adjacent to the proposed property:
• 8 -inch mainline running south to north, east of the referenced property within an easement.
It appears the property may be serviced by gravity flow; however, the homeowner/developer is responsible for
determining depths of the existing sanitary sewer main to verify if gravity flow is feasible or if a private individual
sewage ejector (lift station) is required. The issuance of a sewer tap permit by the District does not in any way
guarantee that the property can be served by gravity flow.
Each unit/building is required to have a separate sanitary sewer service with an independent connection to the District
main.
Costs
All costs involved are to be deposited in advance— engineering, reviews, design, construction, observation and
inspections — are the responsibility of the Owner/Developer at the then current rate fee structure. Please be aware
that proper tap and development fees are required to be paid prior to connection to the District main. A minimum
72 -hour notice prior to construction is required following District receipt of all fees. These fee amounts can be paid
directly to the District Office prior to connection, payable to Wheat Ridge Sanitation District, which also collects Metro
Wastewater's "connection fees".

of the property is 12,510 square feet (.29 acres). The property is currently comprised of four
parcels measuring 125'x 25' and was platted as part of the Columbia Heights Subdivision
approved in 1889. The proposed plat will consolidate lots into two legal single family building
sites each measuring 6255 square feet. Existing structures on the property have been
demolished.

Existing Site Conditions:
The property is located along the east side of Chase Street, north of 33 Avenue. Avenue. The subject property
was platted in 1889 via the Columbia Heights Subdivision and consists of Lots 15, 16, 17, and 18 of
the Block 7. The zoning in the area is largely Residential -One C (R -1C) and Residential -Three (R-3).
There are also sporadic pockets of Restricted Commercial (RC), Neighborhood Commercial (NC),
Residential -One A (R -1A) and Residential -One B (R -1B) zone districts in the immediate area. The
subject property is zoned R -1C. The surrounding area is largely comprised of single-family homes and
some apartment buildings.
Currently on the subject property is one single-family house and a large accessory structure. Jefferson
County Assessor records indicate the 1'/z story home was constructed in 1909 with an adjusted year
built of 1913. The subject property is 12,500 square feet (0.29 acres).
Applicant/Owner Preliminary Proposal:
The owner is proposing to subdivide the existing 4 parcels into 2 parcels for the development of two
single family dwelling units. The existing home on the north portion of the lot may or may not remain.
The applicant also plans to add detached garages to the rear of the lots.

Planning comments:
The following items were discussed based on the applicant's proposal:
Zoning & Use
The zoning on the property is R -1C which provides for high quality, safe, quiet and stabled medium -
density single-family residential neighborhoods. This is the City's smallest lot single family zone
districts. It allows for a minimum lot size of 5,000 square feet, and a minimum lot width of 50 feet. It
appears the subdivision proposed will fulfill both the minimum lot size and minimum lot width
requirements. No change in zoning is necessary. Future development of the parcel(s) will need to
comply with the development standards set forth in Section 26-208 (Residential -One C District) of the
Municipal Code.
Subdivision
Subdivision of the existing lots will be necessary in order to construct an additional single-family
home. Because the property currently consists of 4 parcels, the subdivision request will need to be
approved by the Planning Commission. All approved plats shall be recorded with the Jefferson County
Clerk and Recorder. A recordable mylar of the plat and associated recording fees shall be submitted to
the Community Development Department within 90 days of final action
Landscaping
Section 26-502 of the Municipal Code establishes landscaping requirements. Single-family and duplex
residential uses require landscaping to cover at least 25% of the total lot area. The minimum required
front yard (25 feet from the front property line) shall be fully landscaped, except for those areas
providing pedestrian or vehicular access. One street tree is required for every 70 feet of street frontage
(or portion thereof) to be placed within the front setback. No more than 50% of the total landscape
coverage of the lot shall be comprised of turf. The use of law water demand turf varieties such as
buffalo grass, blue gramma grass and tall fescue is encouraged.
Parkland
A parkland dedication fee of $2,497.29 is required for each new dwelling unit constructed in the City
of Wheat Ridge. With one existing home on the site, the developer will be responsible for parkland
dedication fees for one additional unit. This fee is collected when you pay the recording fees for the
subdivision plat.
Utility Providers
The City of Wheat Ridge is not a full-service city. The utility and service providers for this property
include:

All land use applications will be sent out on referral to these agencies for comment; however, staff
encourages potential applicants to contact service districts ahead of time. This may help to understand
any design or infrastructure requirements and potential costs associated with the proposed project.
Building Division comments:
New construction will require building permits, and the issuance of a Certificate of Occupancy upon
completion of the project, and only after passing all of the required inspections.
The City has adopted and currently enforces the 2012 Edition of the International Codes and the 2014
Edition of the National Electric Code. The City uses the ANSI 117.1-2009 Standard in determining
requirements related to accessibility.
Public Works comments:
The following items were discussed based on the applicant's proposal:
Drainage
Site drainage requirements are based on the area of disturbance created by the new development. Any
drainage ponds on the site will be required to be located in their own tract. More information on
drainage requirements can be found in the attached notes and on the City's Civil Engineering
Resources webpage. A final drainage report is required, signed and sealed by a Professional Engineer
licensed in the State of Colorado.
Streetscape
When new properties are created through the subdivision process, staff reviews adjacent street
improvements to confirm that they meet current roadway standards. Chase Street is classified as a
local street meaning it provides access to residential land uses, and serves low traffic volumes. The
current minimum standard for a local street includes a 6 -inch vertical curb, a 2 -foot gutter, and a 5 -
foot attached sidewalk. The applicant may provide the curb, gutter, and sidewalk along the frontage of
the property or pay fees in lieu totaling approximately $5,235. Due to the lack of improvements along
Chase Street in the surrounding area, Staff recommends paying the fees in lieu.
Review Process
This request will require a subdivision.
Subdivision
The first step in the subdivision process is the pre -application meeting. After the pre -
application meeting is complete, a formal application may be submitted. Applications must be
submitted by appointment with a planner. Incomplete applications will not be accepted.
The Municipal Code defines this specific subdivision as a `minor' subdivision because the
existing property consists of 4 parcels. A minor subdivision requires one public hearing in
front of Planning Commission, who will approve, approve with conditions, or deny the
subdivision.
Upon submittal of a complete application, you will be assigned a case manager who will be
your point of contact with the City through the duration of the subdivision process. The case
manager will review the application, send it out on referral to outside service agencies (Xcel
Energy, water district, fire district, etc.) and other City agencies (Public Works, Economic
Development, etc.) for review. The referral period is 15 days, during which time the referral
agencies and departments may submit comments on the application. These comments, as well
as those from the case manager, will be forwarded to the applicant. Modifications to the
subdivision plat may be required as a result of these comments. The applicant must address
comments and resubmit relevant documents. This process may need to occur several times.
Once all comments have been addressed to the case manager's satisfaction, the application will
be scheduled for public hearing before the Planning Commission.

Public hearings require publication on the City website and Wheat Ridge Transcript newspaper
in addition to a sign being posted on the property for 15 days, and a letter notice being mailed
to all property owners within 300 feet of the subject property. Your case manager will work
with the appropriate departments to ensure that the publications are made and letters mailied
out. The case manager will also prepare the sign, and the applicant will be responsible for
posting the sign on the property.
The plat must be approved prior to the issuance of any building permits.

2. Rights of eminent domain. This Exclusion does not modify or limit the coverage provided under Covered Risk 7 or 8.
3. Defects, liens, encumbrances, adverse claims, or other matters:
(a) created, suffered, assumed, or agreed to by the Insured Claimant;
(b) not Known to the Company, not recorded in the Public Records at Date of Policy, but Known to the Insured Claimant and not disclosed in writing to the

(a) a fraudulent conveyance or fraudulent transfer; or

DEFINITION OF TERMS
The following terms when used in this policy
mean:
(a) "Amount of Insurance": The amount
stated in Schedule A, as may be increased or
decreased by endorsement to this policy, increased by
Section 8(b), or decreased by Sections 10 and 11 of
these Conditions.
(b) "Date of Policy": The date designated as
`Date of Policy" in Schedule A.
(c) "Entity": A corporation, partnership, trust,
limited liability company, or other similar legal
entity.
(d) "Insured": The Insured named in
Schedule A.
(i) The term "Insured" also includes
(A) successors to the Title of the
Insured by operation of law as distinguished from
purchase, including heirs, devisees, survivors,
personal representatives, or next of kin,

16. SEVERABILITY

invalid, but all other provisions shall remain in full

17. CHOICE OF LAW; FORUM
(a) Choice of Law: The Insured
