Motion carried 7-0. APPROVAL OF MINUTES — September 20, 2018 It was moved by Commissioner OHM and seconded by Commissioner PETERSON to approve the minutes of September 20, 2018, as written. Motion carried 7-0. PUBLIC FORUM (This is the time for any person to speak on any subject not appearing on the agenda.) No one wished to speak at this time. Planning Commission Minutes October 18, 2018 -1— 7. PUBLIC HEARING A. Case No. MS -18-03: an application filed by Jeff Bustos for approval of a consolidation plat from four (4) lots to one (1) lot for property zoned Residential - Three (R-3) located at 2645 Chase Street. Mr. Cutler gave a short presentation regarding the consolidation and the application. He entered into the record the contents of the case file, packet materials, the zoning ordinance, and the contents of the digital presentation. He stated the public notice and posting requirements have been met, therefore the Planning Commission has jurisdiction to hear this case. Commissioner LEO wanted to confirm that the only reason for this consolidation is for recording and title clarification purposes only and nothing else is going to change. Mr. Cutler confirmed that is correct. Commissioner VOS inquired about there being no public hearing sign posted on the property when she drove by at 2:30p.m. on October 18, 2018. She asked if there had been any posting at all. Mr. Cutler said a sign was given to the applicant for posting on the property, notices were mailed to residents within a 300 -foot radius and the public hearing information was published in the Wheat Ridge Transcript. Commissioner VOS asked why not a 600 -foot radius and she also was curious about who the alley belongs to. Mr. Cutler said 600 -foot radius mailings are required for neighborhood meetings and he responded that the alley is City -owned. Commissioner VOS asked for clarification from a section in the staff report which states that the existing structure is a duplex but is legally nonconforming. Mr. Cutler explained that the property was developed in 1963 prior to City incorporation in 1969. As it sits now, the duplex is non -conforming relative to size and width and if it were scraped, a duplex could not be built in its place because the lot would be substandard for a duplex in the R-3 zone district. He said that by removing the lot lines it cleans up the site and reduces the non -conformities. Commissioner Larson asked if this a common occurrence. Ms. Reckert said that the lots on the east side of Wheat Ridge were subdivided in the late 1800's. They were done in 25 x 125 foot strips which was common. By Planning Commission Minutes -2— October 2— October 18, 2018 removing the lot lines on this property, it becomes better from a title perspective as building will not be crossing thee lot lines. Mr. Cutler added that a duplex split is exempt from the City's subdivision regulations and that the title company contacted staff about a consolidation to clean-up the lines prior to the duplex split being done. Commissioner OHM understands that with regards to townhome plats, there are visible lot lines and wanted to know if it is the same with a duplex split. He also asked how the garage is split because it is not in the center of the property. Mr. Cutler mentioned that the City does not review duplex splits so staff does not know what the ownership looks like. Presumably, there is a party wall agreement to show common ownership of land and anything else on the property. Commissioner Peterson asked if there currently is one owner on this property and whether the property owner is paying the property taxes. He then inquired who will pay the taxes once the duplex is split. Ms. Reckert said that it is irrelevant to the City because Jefferson County handles the property taxes. Jeff Bustos, applicant and realtor for the owners 7723 Everett St, Arvada Mr. Bustos added that a survey was done by Bell Survey and there is a party wall agreement which includes the garage. The property is and will remain a duplex and is an investment property. Commissioner VOS asked about the posting sign and why it was not being displayed. Mr. Bustos confirmed he did get the sign from Mr. Cutler and put it in the front window of the duplex. There has been some work done in the duplex to check the furnaces due to the cold weather. He thinks that due to the pressure change in the duplex with the furnace turning on and off that the sign blew out of the window. Commissioner VOS added she didn't think inside the window was a good place to post the sign and then asked if the duplex is for sale. Mr. Bustos said the property is currently under contract with other interested buyers but the Title Company wanted to see a consolidation before the duplex split could commence. Commissioner VOS asked if there will be any change to the building. Planning Commission Minutes -3— October 3— October 18, 2018 Mr. Bustos confirmed there will not be any changes to the structures; only two owners instead of one. It was moved by Commissioner DORSEY and seconded by Commissioner OHM to APPROVE Case No. MS -18-03, a request for approval of a consolidation plat on property zoned Residential -Three (R-3) located at 2645 Chase Street, for the following reasons: 1. The plat complies with the subdivision regulations design criteria established in Article IV of the Wheat Ridge Municipal Code. 2. The plat reduces nonconformities on the property. Motion passed 7-0. 8. OLD BUSINESS A. Save the Date: November 5, 2018 NRS Update Joint Session with City Council Ms. Reckert said the original Neighborhood Revitalization Strategy was completed in 2005 and that was an impactful policy document for the City and that it is time to refresh the document. Commissioner VOS asked what the format will be. Ms. Reckert said it would probably be a round table discussion. Commissioner LARSON asked if there will be an agenda packet. Ms. Reckert said there should be a packet of some sort prepared and distributed by the City Manager's office. 9. NEW BUSINESS A. Save the Date: November 3, 2018 DOLA 2018 Planning Commissioner Workshop Ms. Reckert said the Workshop typically has interesting content regarding powers and duties of Planning Commissioners and encouraged the commissioners to attend. B. Ms. Reckert mentioned that Zack Wallace Mendez will be leaving us for a position in Denver as a Transportation Demand Manager. He will be missed but staff is excited for him, so there will be a planner position coming open. 10.
