Planning Commission Minutes October 18, 2018 -1— 7. PUBLIC HEARING A. Case No. MS -18-03: an application filed by Jeff Bustos for approval of a consolidation plat from four (4) lots to one (1) lot for property zoned Residential - V Three (R-3) located at 2645 Chase Street. Mr. Cutler gave a short presentation regarding the consolidation and the application. He entered into the record the contents of the case file, packet materials, the zoning ordinance, and the contents of the digital presentation. He stated the public notice and posting requirements have been met, therefore the Planning Commission has jurisdiction to hear this case. Commissioner LEO wanted to confirm that the only reason for this consolidation is for recording and title clarification purposes only and nothing else is going to change. Mr. Cutler confirmed that is correct. Commissioner VOS inquired about there being`no public hearing sign posted on the property when she drove by at 2:30p.m. on October 18, 2018. She asked if there had been any posting at all. Mr. Cutler said a sign was given to the applicant for posting on the property, notices were mailed to residents within a 300 -foot radius and the public hearing information was published in the Wheat Ridge Transcript. Commissioner VOS asked why not a 600 -foot radius and she also was curious about who the alley belongs to. Mr. Cutler said 600 -foot radius mailings are required for neighborhood meetings and he responded that the alley is City -owned. Commissioner VOS asked for clarification from a section in the staff report which states that the existing structure is a duplex but is legally nonconforming. Mr. Cutler explained that the property was developed in 1963 prior to City incorporation in 1969. As it sits now, the duplex is non -conforming relative to size and width and if it were scraped, a duplex could not be built in its place because the lot would be substandard for a duplex in the R-3 zone district. He said that by removing the lot lines it cleans up the site and reduces the non -conformities. Commissioner Larson asked if this a common occurrence. Ms. Reckert said that the lots on the east side of Wheat Ridge were subdivided in the late 1800's. They were done in 25 x 125 foot strips which was common. By Planning Commission Minutes -2— October 2— October 18, 2018 removing the lot lines on this property, it becomes better from a title perspective as building will not be crossing thee lot lines. Mr. Cutler added that a duplex split is exempt from the City's subdivision regulations and that the title company contacted staff about a consolidation to clean-up the lines prior to the duplex split being done. Commissioner OHM understands that with regards to townhome plats, there are visible lot lines and wanted to know if it is the same with a duplex split. He also asked how the garage is split because it is not in the center of the property. Mr. Cutler mentioned that the City does not review duplex splits so staff does not know what the ownership looks like. Presumably, there is a party wall agreement to show common ownership of land and anything else on the property. Commissioner Peterson asked if there currently is one owner on this property and whether the property owner is paying the property taxes. He then inquired who will pay the taxes once the duplex is split. Ms. Reckert said that it is irrelevant to the City because Jefferson County handles the property taxes. Jeff Bustos, applicant and realtor for the owners 7723 Everett St, Arvada Mr. Bustos added that a survey was done by Bell Survey and there is a party wall agreement which includes the garage. The property is and will remain a duplex and is an investment property. Commissioner VOS asked about the posting sign and why it was not being displayed. Mr. Bustos confirmed he did get the sign from Mr. Cutler and put it in the front window of the duplex. There has been some work done in the duplex to check the furnaces due to the cold weather. He thinks that due to the pressure change in the duplex with the furnace turning on and off that the sign blew out of the window. Commissioner VOS added she didn't think inside the window was a good place to post the sign and then asked if the duplex is for sale. Mr. Bustos said the property is currently under contract with other interested buyers but the Title Company wanted to see a consolidation before the duplex split could commence. Commissioner VOS asked if there will be any change to the building. Planning Commission Minutes -3— October 3— October 18, 2018 Mr. Bustos confirmed there will not be any changes to the structures; only two owners instead of one. It was moved by Commissioner DORSEY and seconded by Commissioner OHM to APPROVE Case No. MS -18-03, a request for approval of a consolidation plat on property zoned Residential -Three (R-3) located at 2645 Chase Street, for the following reasons: 1. The plat complies with the subdivision regulations design criteria established in Article IV of the Wheat Ridge Municipal Code. 2. The plat reduces nonconformities on the property. Save the Date: November 5, 2018 NRS Update Joint Session with City Council Ms. Reckert said the original Neighborhood Revitalization Strategy was completed in 2005 and that was an impactful policy document for the City and that it is time to refresh the document. Commissioner VOS asked what the format will be. Ms. Reckert said it would probably be a round table discussion. Commissioner LARSON asked if there will be an agenda packet. Ms. Reckert said there should be a packet of some sort prepared and distributed by the City Manager's office. 9. NEW BUSINESS A. Save the Date: November 3, 2018 DOLA 2018 Planning Commissioner Workshop Ms. Reckert said the Workshop typically has interesting content regarding powers and duties of Planning Commissioners and encouraged the commissioners to attend. B. Ms. Reckert mentioned that Zack Wallace Mendez will be leaving us for a position in Denver as a Transportation Demand Manager. He will be missed but staff is excited for him, so there will be a planner position coming open. 10. I. REQUEST The applicant is requesting approval of a minor subdivision at 2645 Chase Street, consolidating four (4) lots into one (1). The existing duplex on the property will remain. Because four lots are involved, the case is required to be heard by the Planning Commission. The purpose of a subdivision plat review is to confirm appropriate lot configuration, access, rights-of- way, easements and utility service to and in this case primarily to clean up the underlying, nonconforming lot lines. II. EXISTING CONDITIONS The subject site is located on the west side of Chase Street between 26a' and 27b Avenues. A public alley runs east -west along the southern border of the site (Exhibit 1, Aerial). It is zoned Residential - Three (R-3), as are most of the properties in the vicinity (Exhibit 2, Zoning). Some properties to the west are zoned Residential -One C (R -1C) and contain single-family homes. There is a mix of multifamily and single-family in the area. The subject site is currently occupied by a duplex, built in 1963 according to the Jefferson County Assessor. Much of east Wheat Ridge is comprised of 25 -foot wide lots and often times improvements cross those lot lines. This property consists of four 25 -foot wide lots (Lots 29B -32B of Prince's Subdivision of Block 14 Lakeside). Each is approximately 2,000 square feet, totaling just over 8,000 square feet. The lots have the same parcel identification number with the Jefferson County Assessor, which denotes there is a single tax payer on the lots, but this is independent from the actual platting of the land pursuant to the City's subdivision regulations. Case History The City became involved after being contacted by a title company representing the buyer of one side of the duplex. A duplex split was recorded at Jefferson County prior to contact with staff, but the title company contacted the City because the existing lot lines cross through the duplex and were not erased by the duplex split. Duplex splits are exempt from subdivision regulations and can be recorded directly at the County; duplex splits create two ownership interests in an existing duplex but do not dissolve existing lot lines. Staff recommended a consolidation plat to dissolve the existing lot lines which run through the building and create a complicated title. The consolidation plat was not a City requirement, but it was highly recommended in order to resolve issues with the title company and to help prevent future title issues. Hearing this, the title company required a consolidation plat in order to proceed with any deed changes. Having a clean title benefits the property in general, eliminates nonconforming lots, and in this case would then allow the duplex split to proceed. While the existing building is a duplex, it had not yet been split into separate ownership interests. III. PROPOSED SUBDIVISION PLAT Planning Commission Case No. MS -18-03 I Litsey Plat Document The proposed plat document consists of one page (Exhibit 3, Litsey Subdivsion). The page includes a legal description of the property; signature blocks for the owners, City, surveyor and County; data tables; standard declarations and notes; and the plat itself. Lot Configuration Three internal lot lines are being removed by the plat, creating a single 8,006 square foot lot: Lot 1, Litsey Subdivision. The outside boundaries of the property are not changing. Public Improvements A consolidation plat does not require public improvements or right-of-way dedication. No site work is occurring so the requirement for public improvements during site redevelopment is not applicable. Right-of-way in this location is adequate. Future Considerations If the property were to redevelop, the only allowable use would be a single-family home due to the lot size being under 9,000 square feet. However, because the existing use is a duplex and is legally nonconforming, the existing use can remain and the consolidation plat reduces the nonconformities on the site. The duplex was built before the City incorporated and has existed as such since 1963. IV. AGENCY REFERRALS All affected service agencies were contacted for comment on the subdivision plat regarding the ability to serve the property. Specific referral responses follow. City of Wheat Ridge Public Works: The plat was found to be approvable on September 17, 2018 by Dave Brossman. City of Wheat Ridge Building Division: No comments. West Metro Fire Protection District: No concerns. Wheat Ridge Sanitation District: The district provided general requirements for sanitary sewer service. Wheat Ridge Water District: No comments. Xcel Energy: No concerns. Century Link: No concerns. Comcast: No comments. V. STAFF CONCLUSIONS AND RECOMMENDATIONS Staff concludes that the proposed subdivision plat results in a logical lot layout. Staff further concludes that the subdivision plat complies with the standards in Article IV of the zoning and development code (subdivision regulations) and that all utility agencies can continue to serve the property. The consolidation plat will allow the duplex split to proceed and will simplify a complex non -conforming Planning Commission Case No. MS -18-03 /Litsey site, helping to prevent future land/title issues. For these reasons, staff recommends approval of the subdivision plat. VI. SUGGESTED MOTIONS Option A: "I move to recommend APPROVAL of Case No. MS -18-03, a request for approval of a consolidation plat on property zoned Residential -Three (R-3) located at 2645 Chase Street, for the following reasons: 1. The plat complies with the subdivision design criteria established in Article IV of the Wheat Ridge Municipal Code. 2. The plat reduces nonconformities on the property.
