SUBJECT: MS -18-05 / West Highlands Auto Plat (Barrera Subdivision)
Summary of Request: The applicant requested an administrative subdivision (consolidation
plat) on property zoned Commercial -One (C-1) and located at 5440 W. 29th Avenue.
Findings:
• All comments from referral agencies have been addressed.
• Public Works has completed review of the plat and has found it approvable.
• The consolidation will allow the proposed addition to the existing auto repair business,
approved under Case No. WSP-18-01, to proceed with building permits.
• The plat complies with the subdivision design criteria established in Section 26-410 of
the Wheat Ridge Municipal Code.
Recommendations:
Staff recommends approval of the administrative subdivision at 5440 W. 291h Avenue (Case No.:
MS -18-05), with the following conditions:
1. A right-of-way permit must be obtained from Public Works to construct the required
curb, gutter, and sidewalk on Chase Street. The construction must be completed before a
Certificate of Completion can be issued for the building addition.

Re: Barrera Subdivision
Mr. Landry:
This letter is in regards to the application for the Barrera Subdivision (consolidation plat) on property
located at 5440 W. 29`" Avenue. The fourth submittal has been reviewed and Public Works has found
the submittal to be approvable (see attached memo).
Please submit the Plat on 24" x 36" mylar with the Owner's Certificate and Surveyor's Certificate
signed, along with a recording fee of $13. The mylars must be signed with a thin permanent marker
or felt tip pens. Make sure the margins are 2" on the left, 1" on top, and '/2" on the remaining sides.
The City will complete the additional signature certifications and route the documents to Jefferson
County for recording.
As a reminder, we still have not received a building permit or ROW permit for this project.

I have completed my second review for the request for approval of a Consolidation Plat for the
property located at 5440 W. 29th Avenue, received on October 22, 2018, and I have the
following comments:
PLANNING & ZONIN
Site Plan
No Site Plan was included with this 2' submittal; the Site Plan was found to be
approvable from a Public Works standpoint during the first review.
Final Plat
1. In Note #10, please have them revise "NAV 83" to NAD 83" as indicated on the
redlined plat.
2. They need to identify the 8' alley and associated Utility Easement (as was
previously shown). If this is now incorrect, then please identify the area.
The following comments pertain to the Legend:
a. I'm sorry to keep picking on this, but the 2 ("EXISTING LOT LINE" and
"EASEMENT LINE") linetypes still look too much alike. Please darken these 2
along with the "PROPERTY LINE" linetype to resemble the much easier to
distinguish examples given to the right.
b. State if THE "EASEMENT LINE" represents a "PROPOSED EASEMENT
LINE".
c. Change the scale so the Section Line linetype shows the breaks.
d. Don't really need the Right -of -Way Line linetype unless there is somewhere
where this is different from the property line.
4. They will need to include all dates of revision.

The Site Plan is approvable from a Public Works standpoint.
Final Plat
General Comments:
a. Where abbreviations are used, be consistent with the use of periods with street
callouts (PW recommends use of periods).
b. N -S street names are not `N. Name Street or Blvd.' but just "Name Street or
Blvd."
c. Throughout document, show all acreage values to 4 decimal places.
2. Owner's Certificate:
a. In the first sentence, show acreage to 4 decimal places.
b. In paragraph 3, PW recommends not separating the bearing callout as redlined.

them out a bit and maybe slightly larger. The "1" next to the set nail is very
close and would stand out better with a little additional space.

b. PW has recommended additional linetypes be used as redlined. This is an effort
to be consistent and clear.
c. Remove duplicate lot numbers (38, 39 & 40) from the subject property. Show
the new LOT 1 callout as shown (no need for a Block number for a one lot
subdivision).
d. The redlined existing subdivision names are just suggestions for a more typical
callout, as are the block number callouts.

Re: Barrera Subdivision
Mr. Landry:
This letter is in regards to the application for the Barrera Subdivision (consolidation plat) on property
located at 5440 W. 290' Avenue. The City has reviewed the first submittal of the subdivision plat and
has the following comments. Please also refer to the enclosed redlined copy of the draft documents.
Plat Comments
1. Add the case number MS -18-05 and WSP-18-01 to a Case History table (refer to redlines).
2. The owner's certificate and signature block should state a name/title in addition to the LLC name
(whoever is managing the LLC). That way there is a signature to match a name on the document.
For example: John Smith, President on behalf of Barrera Holding LLC.
3. Remove the Cross Access Easement note as none are shown on the plat.
4. Remove the Planning Commission Certification section.
5. In the Surveyor's Certificate, change the subdivision name to `Barrera Subdivision." Provide the
name of the surveyor under the signature line again for clarity.
6. Remove "Zoned R -1C" from the Lakeside Block 4 label on the west side of Chase Street. The
correct zoning is provided on each lot. Refer to redlines. Do the same for Lakeside Block 3 just
south of the site.
7. Remove the partial lot names on the southern edge of the plat. Refer to redlines.
8. Make the lot weight for the subdivision boundary bolder and add the various lines to the legend.
9. Remove the "N." from the Chase Street label on the plat.
10. What is the large circled "3" on lot 38? Remove.
11. Remove the larger 38, 39, and 40 labels because there are already labels that read "Lot 38..."
which will help clean up the plat.
For future consideration (ATTN: Jeff Chacon & Osvaldo Barrera)
12. The following items must be completed before a Certificate of Completion for the building
addition may be obtained and prior to final inspections on the building addition.
a. This plat must be formally approved by the City.
b. The construction of the curb, gutter, and sidewalk on Chase Street must be completed.
Public Works has not received a Right -of -Way Construction Permit application as of this
letter. Dave Brossman provided information on May 25, 2018 regarding ROW
www.d.wheatridge.co.us
Construction permits and contractor licensing. Contact Public Works at 303-235-2861 for
more information.
13. The Building Division has not received a building permit application for the addition. The plans
previously submitted in 2016 have expired. Osvaldo Barrera picked up those plans from the
Building Division on July 24, 2017 and staff explained a new permit must be applied for. Contact
the Building Division at 303-235-2876 for permitting information and submittal requirements.
The application was also sent on referral to other City departments and outside agencies. Attached are
the comments that were received.
Wheat Ridge Public Works: See attached comments and redlines from Dave Brossman dated
October 15, 2018. Please refer to both Public Works and Planning documents to ensure all City
comments are addressed.
West Metro Fire Protection District: See attached letter from Bruce Kral, dated September 28, 2018.
West Metro does not have any comments on the plat but reminded the applicant that the building
addition plans must be submitted to the district prior to submittal to the City of Wheat Ridge.
Wheat Ridge Sanitation District: No objections. See attached letter from Bill Willis, dated
September 25, 2018.
Wheat Ridge Water District: No comments.
Xcel Energy: See attached letter from Donna George, dated October 9, 2018. They have requested
that the words "and utility" are added to the 8 -foot public alley easement being dedicated by the plat,
since there are existing facilities in that area. Refer to redlines for correct language.
Century Link: No concerns.
Comcast: No concerns.

Dear Mr. Cutler,
On behalf of the Wheat Ridge Sanitation District (WRSD), Martin/Martin Inc., acting as the District's Consulting
Engineer, offers the following in response to the referenced referral dated September 25th, 2018 concerning a site plan
for a proposed 2 -story addition to an existing auto repair facility at 5440 West 29th Avenue. The Wheat Ridge Sanitation
District has no objection with the proposed addition conditional on the elements identified herein are fully addressed.
The following are general requirements for sanitary sewer service. Rules, Regulations and Standards of the District
must be complied with at all times.
The property referenced above is entirely within the boundary and service area of WRSD and is currently providing
service to a commercial unit. Treatment of sewage generated within the WRSD is provided by the Metro Wastewater
Reclamation District (Metro).
Existing Sanitary Sewer Mains
Wheat Ridge Sanitation District has the following sanitary sewer mains in the vicinity of the proposed property:
• 8 -inch mainline running west to east, north of the referenced property within West 29' Avenue.
• 6 -inch mainline running south to north, east of the referenced property within an easement.
It appears from existing records that the property may be serviced by gravity flow; however, the developer is
responsible for determining vertical depths and horizontal locations of District facilities to verify if gravity flow is
capable of servicing lots or if private individual sewage ejectors (lift station) are required.
Per the submitted plans, it appears that there are modifications or additions planned to the existing structure. If there
are any plumbing modifications or additions, the District will need to review and approve plans prior to construction. A
water provider letter verifying water meter sizing for all units/buildings will be required prior to a tap application
completion.
Costs
All costs involved are to be deposited in advance— engineering, reviews, legal, design, construction, observation and
inspections — and are the responsibility of the Owner/Developer at the then current rate fee structure. Please be
aware that proper tap and inspection fees are required to be paid prior to connection to the District main. A
minimum 72 -hour notice prior to construction is required following District receipt of all fees. These fee amounts can
be paid directly to the District Office prior to connection, payable to Wheat Ridge Sanitation District, which also collects
Metro Wastewater's "connection fees".
Depending on estimated flow addition associated with the expansion, participation in the District flow study will be
required at a cost of $35.80/SFRE and an additional $600 for analysis.

Dear Mr. Cutler,
This property is within the West Metro Fire Protection District (WMFPD). Fire service will be provided
as long as provisions of the International Fire Code, 2012 edition, including amendments, are met in
development.
WMFPD has no comments or concerns for the proposed site plan.
Building plans must be submitted to the WMFPD to be assessed for required fire protection features.
Permits are required from the fire district all work on automatic fire protection systems, all work on
automatic fire detection systems, underground fire line, solar photovoltaic systems, radio amplification,
and for the storage of hazardous materials including painting operations.
WMFPD reserves the right to provide additional comments/requirements at the time when plans are
submitted and reviewed per applicable codes and amendments.

The Wheat Ridge Community Development Department has received a request for approval of a

Request: The applicant is requesting approval of a consolidation plat to remove existing lot lines at
5440 W. 2911 Avenue, consolidating three substandard lots into one lot. The property is zoned
Commercial -One (C-1) and measures approximately 9,975 square feet (each of the three
parcels is approximately 3,325 square feet). Because there are three parcels involved, it is
considered an administrative subdivision, meaning no public hearings are required.
The City found the site plan for an addition and site improvements on this property to be
approvable on May 30, 2018 (Case No.: WSP-18-01), which was previously referred to you.
As part of the addition, the applicant is required to construct public improvements (curb,
gutter, and sidewalk) along Chase Street. The consolidation plat is required because the
addition would otherwise cross a lot line, which is prohibited by City Code. All site work will
be associated with future building and right-of-way construction permits.
Please respond to this request in writing regarding your ability to serve the property. Please specify any
new infrastructure needed or improvements to existing infrastructure that will be required. Include any
easements that will be essential to serve the property as a result of this development. Please detail the

Hello,
I'm a Planner for the City of Wheat Ridge and received a consolidation plat for a project located at 5440 W 29th Avenue.
We've been working with Jeff Chacon (Structural Design Collaborative) who has been doing the site plan and building
permits side of things, and he recently submitted a plat from CJ Surveying LLC for review. It appears to have been
completed in December of 2017 but was only now submitted.
The application was not complete and I told him to get in contact with your team regarding the following items:
• We need electronic versions (.pdf and .dwg) in order to proceed with the plat review
• Closure sheets are required for all plat submittals; an example is attached
• The Geodetic Surveying Requirements form must be completed and returned:

It might be easiest to get the contact information for the surveyor who completed the plat in order to expedite this
process. A consolidation plat is a very simple process with the City, but it does require specific items which this plat does
