SUBJECT: WZ-18-11 / Good Times (70 West Business Center PCD)
Summary of Request: The applicant requested an amendment to the existing Specific
Development Plan for the 70 West Business Center Planned Commercial Development to make
a minor addition on the existing Good Times restaurant and upgrade the fagade to current
corporate standards.
The subject property is located at 3230 Youngfield Service Road. Interstate 70 is just to the east
of the site. The requested amendment was Amendment #5 for the 70 West Business Center (for
Lot 2, Block 1, Filing 3).
Findings:
• All comments from referral agencies have been addressed.
• No changes to the site other than fagade upgrades and minor additions are proposed.
• The amendment complies with criteria established in Section 26.305.13 of the Wheat
Ridge Municipal Code.
• Future modifications to the 70 West Business Center will require additional amendments.
Recommendations:
Staff recommends approval of Amendment #5 of the 70 West Business Center Planned
Commercial Development, Case No. WZ-18-11.

Re: Specific Development Plan Amendment for Good Times
Mr. Sponseller:
This letter is in regards to the Specific Development Plan Amendment application for property
located at 3230 Youngfield Service Road.
I have reviewed the second submittal of the amendment and all Planning comments have been
addressed. I forwarded my recommendation of approval to the Community Development Director,
who has found the amendment approvable (Case No. WZ-18-11 / Good Times).
Please submit the SDP plan set on 24" x 36" mylar with the Owner's Certificate completed. The
mylars must be signed with permanent marker or felt tip pins; ball point pens are not sufficient. The
margins for the mylars are: 2" on the left, 1" on top, and '/2" on the remaining sides. The City will
complete the City Certification and route the documents to Jefferson County for recording.

Re: Specific Development Plan Amendment for Good Times

This letter is in regards to the Specific Development Plan Amendment application for property
located at 3230 Youngfield Service Road. I have reviewed the first submittal of the amendment and
have the following comments. Please also refer to the enclosed redlined copy of the draft documents.
General Comments
1. The titles on both pages should be changed to what is indicated on the redlined document.
Page I (Site Plan)
2. Add the Case History numbers as shown on the redlined copy of the draft documents.
3. Re -type or re -format the Owner's Certificate, County Clerk, and City Certification boxes. They
currently load as low -quality scanned images, which will not reproduce when scanned or printed
on mylars for recording.
4. In the Site Data Table:
a. Add "(70 West Business Center)" next to PCD.
b. Provide total square footage of the building with the new addition, after "213 SF
addition..."
5. Add a note in character of development that no changes to parking, landscaping, or the outdoor
seating area are proposed.

6. What is the material of the bands across the top of the building/parapet wall? Add material info if
different from the EIFS "bright white."
The application was also sent on referral to other City departments and outside agencies. Attached are
the comments that were received.
Wheat Ridge Public Works: No comments.
Wheat Ridge Building Division: Once SDP is approvable, respond to comments sent by Brian Tardif
on January 16, 2018. SDP site plan and elevations must match what is submitted for the building
permit review.

Northwest Lakewood Sanitation District: See attached comments from Bill Willis, dated April 23,
2018. There are no objections to the planned work as long as there is no additional seating being
added to the restaurant.

Xcel Energy: There are no apparent conflicts with the request. See attached comments from Donna
George, dated May 4, 2018.

Dear Mr. Cutler,
This letter will acknowledge receipt of your correspondence dated April 23, 2018, regarding the
above referenced project. Based on the submittal it is our understanding minimal site work is
required as this is mainly a structure remodel and small addition.
Please be advised that the property is in an area served by The Consolidated Mutual Water
Company (Company). The existing property is currently receiving domestic water from the
Company. See the attached map for the existing water service and infrastructure information.
Domestic water service may continue to be provided to the property subject to compliance with
the Company's rules, regulations and requirements for such service.
The Applicant must speak with the Company's Tap Administrator Kim Medina at 303/274-7420 (to
discuss a change of use application).
Fire protection requirements should be verified with the West Metro Fire Protection District and those
requirements forwarded to this office. At this time, it appears Company owned infrastructure will
not be required. If a main extension, fire line, or fire hydrant(s) are required a separate meeting
will need to be held with the owner/developer to discuss water infrastructure. Please have the
owner/developer contact our Engineering Department at (303)238-0451.

SUBJECT: Notification of Surface Development (C.R.S. §31-23-215 and §24-65.5)
In 2001, the Colorado Revised Statutes were amended to include an Article which addresses
mineral rights in respect to land use applications. This Article states that any application for
development must be accompanied by a completed notification to mineral estate owners. For the
purposes of this requirement, an application for development includes any application which
requires non -administrative approval from Planning Commission or City Council, including:
• A Final Subdivision Plat
• A Rezoning (including Planned Developments)
• A Special Use Permit (if City Council approval is required)
Building Permit applications are not considered an application for development, therefore
mineral estate owners do not need to be noticed.
A Certificate of Notice is attached, and must be completed and returned to the Community
Development Department no later than ten (10) days prior to each public hearing. Both Planning
Commission and City Council hearings must be noticed. It is the responsibility of the applicant,
not the City, to notify any mineral estate owners prior to public hearing. Failure to notice will
constitute sufficient grounds to reschedule the public hearing.
If there are no mineral estate owners, the appropriate box on the certification can be checked and
the certification can be submitted with the development application.
