I have reviewed your third submittal and all Planning comments have been addressed. At this time, please submit a full size (24 in x 36 in) site plan set on bond paper with your signature in the "Owner's Certificate" section. The Community Development Department has a notary on staff if you would prefer to sign the document here. The plan set should consist of the three pages reviewed as part of the site plan process: the site plan/cover sheet, and both elevations pages. Once the site plan is signed by the Community Development Director, it is considered approved. The Building Division will require the new rear elevation sheets showing the windows be submitted as a building permit revision. Work with the Building Division to determine what specifications need to be included with the new windows, if any. Once the revised sheets are submitted to the Building Division, I can sign off on the permit. Other revisions may be required by the Building Division. When the project is constructed, contact staff regarding a landscaping escrow so that a Certificate of Completion can be issued for the building. Planting will need to be completed by a certain date agreed upon in the spring. For new developments in the Commercial -One (C-1) zone, at least 20% of the property must be landscaped. Seyfer currently has 542 square feet of landscaping, or approximately 2.7% of the total lot area. The proposed site plan adds 286 square feet of landscaping in the form of large planters along the north and south property lines. This brings the total amount of landscaping on the property to 828 square feet, or 4.1 %. The existing planters on the front patio will remain, as will the existing trees on the north side of the property. Because no landscaping is being removed, the nonconformity is not being expanded. The amount of landscaping has not decreased in the past, based on aerial photography dating back to 2001. Based on the current utilization of the site, there is no additional location that is feasible or practical to add landscaping. The entire site, with the exception of the small landscaped area on the northern property line, is covered by either asphalt or building. Findings: • At the initial pre -application meeting and in subsequent conversations, staff encouraged the applicant to increase the amount of landscaping provided on the property, and the applicant has responded with a good faith effort to provide landscaping. • Large planters are being added to the north and south property lines, including xeriscape and irrigation. • The nonconformity is not being increased. • No variance is necessary and alternative landscape designs have been considered. We are requesting a reduction to 18% of the required 50% based on square footage. The landscaping proposal for 4509 Harlan Street, Wheat Ridge, CO includes the following: • Landscaping on both the North and South Side of the existing parking lot that is not present today. • The South Side of the property will include xeriscape beautifying an area between two existing properties that currently is asphalt. • The North side of the property will include irrigated vegetation to ensure proper growth and appearance of plants and shrubs. • The East facing side of the new addition will include similar material and color scheme of the original building to ensure the continuity of the design. • A Trash (dumpster) enclosure will be built and will include similar materials and color scheme to ensure the continuity of the design. We believe this request demonstrates that a majority of the required criteria has been met: 1. The property in question would not yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located. a. This is due to the fact that the strict application of the zoning standards would cause the loss of 50% amount of parking space effecting the customer's and vendor's ability to park at the location on a daily basis. b. Additionally, because Seyfer Specialties repairs and restores vehicles, it is important to our business to have space for parking of completed vehicles for customer pick-up. c. Finally, the loss of parking spaces would cause congestion in the non -parking space areas inhibiting movement in and out of the lot and building, which is necessary for conducting business. 2. The variance would not alter the essential character of the locality. a. The character of the locality will not be altered, it will only be improved by the expansion of the building through continuation of the matching color, material and InMA nine b. The surrounding buildings are commercial buildings that have very minimal landscaping. 3. We are proposing a substantial investment in the property with this application, which would not be possible without the variance. a. Our continued investment is this property will be over 400,000 and is required in order for us to expand our business. b. Without the variance we would not be able to do the necessary expansion, causing us to look for a new location. 4. The particular physical surrounding, shape or topographical condition of the specific property results in a particular and unique hardship. a. The hardship is more than a mere inconvenience because it will result in the loss of 50% of parking spaces from our lot. b. It is critical that we have space for customers and employees to park as well as cars waiting to be worked on or picked up. 5. If there is a particular or unique hardship, the alleged difficulty or hardship has not been created by any person presently having an interest in the property. Hardship is only created by the mere lack of space left on the property due to the expansion. 6. Granting this variance is not detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located. a. The variance is merely a reduction in landscaping requirements allowing for parking and the ability to move cars around, on and off the property. b. This variance does not impair the appropriate use or development of adjacent property, it does not impair the adequate supply of light and air to adjacent property. c. This variance does not increase the congestion in public streets or increase the danger of fire or endanger the public's safety or diminish or impair property values within the neighborhood. 7. The unusual circumstances or conditions necessitating the variance request are present in the neighborhood and are not unique to the property. a. The landscaping plan we are proposing provides more vegetation and color present in any of the existing properties in the area. b. Seyfer Specialties' original renovation of this property included landscape that was not present as well as a substantial investment in the outside appearance of the building resulting in Seyfer Specialties receiving a City of Wheat Ridge Reinvestment Award in 2014. 8. Granting of the variance will allow for reasonable accommodation of a person of disabilities allowing them a designated spot and loading/unloading zone. 9. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual.
