SUBJECT: MS -18-01 / Metz Hill Subdivision
Summary of Request: The applicant requested an administrative subdivision (three lots) on
property zoned Residential -One C (R -1C) and located at 3265 Gray Street.
Findings:
• All comments from referral agencies have been addressed.
• Public Works has completed review of the plat and has found it approvable.
• The plat complies with the subdivision design criteria established in Section 26-410 of
the Wheat Ridge Municipal Code.
Recommendations:
Staff recommends approval of the administrative subdivision at 3265 Gray Street (Case No.:
MS -18-01), with the following condition:
1. Each lot is limited to 2,265 square feet of added impervious surface at a request from
Public Works. The added impervious surface square footage shall be shown on the
required Building Permit site plan prior to approval of the plan and issuance of the
permit, and an engineer's letter should accompany this plan.

I have completed my third review of the Final Plat, for Case # MS -18-01 / Metz Hill
Subdivision for the property located at 3265 Gray St. received on December 31, 2018
and the following are my comments:
PLANNING & ZONING
Final Plat:
1. All previous comments have been adequately addressed; PW hereby approves the
plat.
CIVIL ENGINEERING
Drainage Letter:
Public Works accepts the assumption made and the limiting conditions of 2,265
square foot maximum of additional impervious surface per proposed lot. The
Drainage Letter was approved on June 22, 2018; please find an approved copy
with this Memo.
OTHER
Building Permit Application:
The following shall be included with each Building Permit Application prior to
issuance:
a. Site Plan: The impervious surface square footage shall be shown on the
required Building Permit Application Site Plan/plot plan prior to
approval of the Site Plan and issuance of the Permit.

b. Letter from Engineer: A letter from the Engineer -of -Record stating that
the total imperviousness of the proposed building footprint, driveway,
and other improvements does not exceed the accepted 2,265 square foot
maximum.
2. Subdivision Improvement Agreement:
Prior to the issuance of any Building or Right -of -Way Construction Permits or
the commencement of any construction activities, a Subdivision Improvement
Agreement (SIA) shall be executed by the project owner/developer. The project
owner/developer will need to contact the Dept. of Community Development at
303.235.2846 to obtain a copy of the SIA template. Please note that an approved
engineer's itemized cost estimate for the public improvements will be included
in the SIA (see below). SIAs are recorded at the Jefferson County Clerk &
Recorder's Office with the Final Plat.
Public Improvements Cost Estimate & Guarantee:
Upon acceptance of the Itemized Engineer's Cost Estimate, an Irrevocable
Letter of Credit (ILOC) in the amount of reflecting the total amount of the
approved cost estimate plus 25% (125% of the total estimate) shall be submitted
by the owner/developer for review and approval at the time of SIA submittal.
The total amount required for the Irrevocable Letter of Credit will be
determined upon approval of the cost estimate. The ILOC shall remain in force
for the entire duration of the project, and the City reserves the right to request
the ILOC be renewed if deemed necessary. A photocopy of both the itemized
cost estimate and ILOC will be attached to the SIA and recorded at the county.
4. 2 -Year Warranty Period and Guarantee for Public Improvements:
Upon completion of all public improvements and Final Acceptance has been
granted by the City Inspector, the original Irrevocable Letter of Credit shall be
surrendered. At that time a 2 -year warranty period for the completed and
approved public improvements shall commence. If at any time during said 2 -
year Warranty Period the City Inspector deems that the constructed public
improvements are in such condition as to require repairs or replacement, the
Developer shall complete such work upon request. Upon commencement of the
2 -year Warranty Period, a 2nd Letter of Credit in the amount of 25% of the
original itemized engineer's cost estimate shall be submitted to the City of
Wheat Ridge and be dated as to expire on the 2 -year anniversary of the
Warranty Period commencement date. The City shall retain said Letter of Credit
for the entire 2 -year Warranty Period. Upon completion of the 2 -year Warranty
Period, the 2nd Letter of Credit shall be surrendered by the City of Wheat Ridge.
Right -of -Way Construction Permit(s)/Licensing:
a. ROW Permits. Prior to any construction within the public right-of-way
(ROW), the necessary Right -of -Way Construction Permit(s) and
respective licensing will need to be submitted for processing by the City.
Right -of -Way Construction Permits are issued by the City only after
approval of all required technical documents, including but not limited

to, the Final Drainage Report & Plan, Final Plat, Final Development
Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction

b. Licensing. All work within the public Right -of -Way shall only be
performed by a municipally -licensed contractor.

Mr. Metz:
This letter is in regards to the application for an administrative subdivision on property located at
3265 Gray Street. The City has reviewed the third submittal of the subdivision plat and all Planning
and Public Works comments have been addressed; the subdivision is now approvable. Please note the
following next steps:
1. Please submit the plat on 24" by 36" mylar with the Owner's Certificate and Surveyor's
Certificate signed, along with a recording fee of $13. The mylars must be signed with a thin
permanent marker or felt tip pen. The margins must by 2" on the left, 1" on top, and Y2" on the
remaining sides. The City will complete the additional signature certifications and route the
document to Jefferson County for recording.
2. Parkland dedication fees are due at the time of plat recording, totaling $4,994.58 ($2,497.29 per
new lot). Credit was given for the existing house.
3. Since you have indicated the desire to pay a fee in lieu of building public improvements, an SIA
will not be required. The fee is $7,853, due at time of plat recording. A refund of that fee is not
available if you choose to construct the improvements yourself in the future, so your final
decision regarding public improvements will need to be made prior to plat recordation. We can
wait to accept the plat for recording until you've made a final decision regarding public
improvements, so that you don't end up paying again to construct the improvements yourself.

CIVIL ENGINEERING
Drainage Letter:
While no resubmittal of the Drainage Letter was received (or needed), I want to
reiterate that the Letter was previously reviewed and Public Works accepts the
assumption made and the limiting conditions of 2,265 square foot maximum of
additional impervious surface per proposed lot. The Drainage Letter was
approved on June 22, 2018, and upon approval of the Final Plat an approved
copy of both will be returned.
OTHER
Building Permit Application:
The following shall be included with each Building Permit Application prior to
issuance:
a. Site Plan: The impervious surface square footage shall be shown on the
required Building Permit Application Site Plan/plot plan prior to
approval of the Site Plan and issuance of the Permit.
b. Letter from Engineer: A letter from the Engineer -of -Record stating that
the total imperviousness of the proposed building footprint, driveway,
and other improvements does not exceed the accepted 2,265 square foot
maximum.
2. Subdivision Improvement Agreement:
Prior to the issuance of any Building or Right -of -Way Construction Permits or
the commencement of any construction activities, a Subdivision Improvement
Agreement (SIA) shall be executed by the project owner/developer. The project
owner/developer will need to contact the Dept. of Community Development at
303.235.2846 to obtain a copy of the SIA template. Please note that an approved
engineer's itemized cost estimate for the public improvements will be included
in the SIA (see below). SIAs are recorded at the Jefferson County Clerk &
Recorder's Office with the Final Plat.
3. Public Improvements Cost Estimate & Guarantee:
Upon acceptance of the Itemized Engineer's Cost Estimate, an Irrevocable
Letter of Credit (ILOC) in the amount of reflecting the total amount of the
approved cost estimate plus 25% (125% of the total estimate) shall be submitted

by the owner/developer for review and approval at the time of SIA submittal.
The total amount required for the Irrevocable Letter of Credit will be
determined upon approval of the cost estimate. The ILOC shall remain in force
for the entire duration of the project, and the City reserves the right to request
the ILOC be renewed if deemed necessary. A photocopy of both the itemized
cost estimate and ILOC will be attached to the SIA and recorded at the county.
4. 2 -Year Warranty Period and Guarantee for Public Improvements:
Upon completion of all public improvements and Final Acceptance has been
granted by the City Inspector, the original Irrevocable Letter of Credit shall be
surrendered. At that time a 2 -year warranty period for the completed and
approved public improvements shall commence. If at any time during said 2 -
year Warranty Period the City Inspector deems that the constructed public
improvements are in such condition as to require repairs or replacement, the
Developer shall complete such work upon request. Upon commencement of the
2 -year Warranty Period, a 2nd Letter of Credit in the amount of 25% of the
original itemized engineer's cost estimate shall be submitted to the City of
Wheat Ridge and be dated as to expire on the 2 -year anniversary of the
Warranty Period commencement date. The City shall retain said Letter of Credit
for the entire 2 -year Warranty Period. Upon completion of the 2 -year Warranty
Period, the 2nd Letter of Credit shall be surrendered by the City of Wheat Ridge.
5. Right -of -Way Construction Permit(s)/Licensing:
a. ROW Permits. Prior to any construction within the public right-of-way
(ROW), the necessary Right -of -Way Construction Permit(s) and
respective licensing will need to be submitted for processing by the City.
Right -of -Way Construction Permits are issued by the City only after
approval of all required technical documents, including but not limited
to, the Final Drainage Report & Plan, Final Plat, Final Development
Plan, Traffic Impact Study, Storm Sewer Plans, Street Construction
Plans, Grading & Erosion Control Plan, Traffic Control Plan, and
easement or ROW dedications
b. Licensing. All work within the public Right -of -Way shall only be
performed by a municipally -licensed contractor.

We have reviewed this referral. The District is prepared to serve an additional two connections on that site. This will
require the purchase of two additional taps from the District with tap fees from the District and System Development
charges to Denver Water. Additionally, due to the age and obsolete size of the this connection (1953), 1 recommend the
replacement of the existing 5/8" tap connection with a %" tap and service line as well as replacement of the meter and
meter yoke to create a new modern 3/4" connection for all three units. The exchange is without charge except for a
$200.00 replacement meter.

This property is within the West Metro Fire Protection District (WMFPD). Fire service will be provided
as long as provisions of the International Fire Code, 2012 edition, including amendments, are met in
development.
Per the Wheat Ridge adopted fire code requirements, future development of the added lot will require the
addition of a fire hydrant so that no exterior portion of the new structure will be farther than 300' from a
fire hydrant. Buildings equipped with an approved automatic sprinkler system will increase the
maximum distance to 500' eliminating the need for the additional fire hydrant.
Permits are required from the fire district for all work on automatic fire protection systems, all work on
automatic fire detection systems, underground fire line, solar photovoltaic systems, radio amplification,
and for the storage of hazardous materials including the removal and placement of fuel storage tanks.
WMFPD reserves the right to provide additional comments/requirements at the time when plans are

following are my comments:

General Comments:
1. For the next submittal, include an initialed and signed Geodetic Surveying
Requirements Checklist and include all requirements specified on the checklist on
the plat.
2. Add the "CITY OF WHEAT RIDGE", to the subtitle.
3. A Vicinity Map is required.
4. Update the Legend as redlined. Note: all text needs to be 0.10" in height (min.)
5. GENERAL NOTES
a. Note 4 — not sure why this is here.
b. Note 5 — Basis of Bearing direction should match between this note and the plan
view callout.
c. Note 1 from the Geodetic Surveying Requirements should be present — please
verify.
6. OWNER'S CERTIFCATE
a. Add the square footage of the property to the first line to the nearest foot and
show the acreage to 4 decimal places (acreages throughout the plat to be to 4

a. PW recommends changing the appearance of the existing lot callouts to drop
them back somewhat so the proposed lot callouts stand out. This will allow you
to add the existing lot callouts to Lots 7 and 8 that are being subdivided.
(Redlines show smaller, italicized style as a suggestion.)
b. Add the zoning to all existing parcels.
c. Add the centerline of Gray St. and show all roadway centerlines as a centerline
symbol to match Legend.
d. Add the existing easements in the Weiland Subdivision and label as shown.
e. Correct the spelling of "Wheat Ridge" at all three section corner descriptions.
f. There appears to be some extraneous text under the metes and bounds for the
project boundary as shown on the redlines.
g. PW recommends pulling the notations surrounding the lots away from the
graphics as much as possible for clarity, such as the coordinate pairs, lot line
callouts, etc. Also, consider the enlarged corner details as redlined. Also, the
City requires the proposed property corners to have coordinates, so on the NE
and SE corners, adjust coordinate values appropriately (which now shows up
clearly in the enlarged details).
h. Dimension NE corner and SE corner of property boundary to Gray St. centerline
as shown.
i. Move the `GRAY ST. (50' R.O.W.) notation to the south to allow more room
around subject property. This space will then accommodate the property
boundary metes and bounds note with the arrow pointing distinctly to the line.
j. Add "HEREBY" CREATED BY THIS PLAT to Lot Line callouts as redlined.
k. Correct individual lot area callouts to 4 decimal places for acreages.

Drainage Letter:
1. The Drainage Letter has been reviewed and Public Works accepts the

returned.

This letter serves to demonstrate the suitability of the drainage concept for the proposed re-
development at 3265 Gray Street and the conformance to the drainage design standards
as detailed in the City of Wheat Ridge Site Drainage Requirements (drainage criteria). The
property is located between W 33rd Avenue and W 32 d Avenue and abuts other residential
lots and a dance hall parking lot. The current site has a total area of 0.48 acres. It is
comprised of a single family home, a shed, paved area, and lawn area.
Baseline Engineering understands the proposed project will subdivide the property into
three lots with single family homes on each lot. Drainage will be conveyed from new
rooftops via gutters and roof drains away from adjoining properties with the majority of the
roof drainage to be directed out to Gray Steet to minimize potential negative impacts to the
adjacent properties.
The minor redevelopment category is proposed be achieved by limiting the overall
impervious area increase by no more than 3,000 square feet. This configuration is to be
achieved by having a building footprint of 2,000 square feet and paved area of
approximately 265 square feet for each lot. With a minor redevelopment the Water Quality
Capture Volume would not need to be detained on-site.
The proposed project is estimated to disturb the entire 0.48 acre site but increase the
impervious area by no more than 3,000 square feet. The square footage of the existing
impervious surfaces is 3,795 square feet. To achieve the Minor category the owner is
willing to limit the size of the homes being constructed and hold the total impervious
surface to 6,795 square feet or less (2,265 square feet for each lot) to achieve the Minor
category
The existing site percent impervious is 18.7% and will increase to 32.4% after the
additional impervious area is added.

allowable impervious area for each lot. Upon project completion, a Drainage Certification
Letter from the Engineer -of -Record stating the site has been completed and the drainage

shall be required prior to issuance of the C. O. The Drainage Certification Letter is to be
accompanied by As -Built plans with adequate spot elevations to support the statements
made in the Letter.

Hydrologic soil groups are based on estimates of runoff potential. Soils are
assigned to one of four groups according to the rate of water infiltration when the
soils are not protected by vegetation, are thoroughly wet, and receive
precipitation from long -duration storms.
The soils in the United States are assigned to four groups (A, B, C, and D) and
three dual classes (A/D, B/D, and C/D). The groups are defined as follows:
Group A. Soils having a high infiltration rate (low runoff potential) when
thoroughly wet. These consist mainly of deep, well drained to excessively
drained sands or gravelly sands. These soils have a high rate of water
transmission.
Group B. Soils having a moderate infiltration rate when thoroughly wet. These
consist chiefly of moderately deep or deep, moderately well drained or well
drained soils that have moderately fine texture to moderately coarse texture.
These soils have a moderate rate of water transmission.
Group C. Soils having a slow infiltration rate when thoroughly wet. These consist
chiefly of soils having a layer that impedes the downward movement of water or
soils of moderately fine texture or fine texture. These soils have a slow rate of
water transmission.
Group D. Soils having a very slow infiltration rate (high runoff potential) when
thoroughly wet. These consist chiefly of clays that have a high shrink -swell
potential, soils that have a high water table, soils that have a claypan or clay

GENERAL INFORMATION
Purpose: The Real Property Transfer Declaration provides essential information to the county assessor to help ensure fair and
uniform assessments for all property for property tax purposes. Refer to 39-14-102(4), Colorado Revised Statutes (C.R.S.).
Requirements: All conveyance documents (deeds) subject to the documentary fee submitted to the county clerk and recorder for
recordation must be accompanied by a Real Property Transfer Declaration. This declaration must be completed and signed by the
grantor (seller) or grantee (buyer). Refer to 39-14-102(1)(a), C.R.S.
Penalty for Noncompliance: Whenever a Real Property Transfer Declaration does not accompany the deed, the clerk and recorder
notifies the county assessor who will send a notice to the buyer requesting that the declaration be returned within thirty days after
the notice is mailed.
If the completed Real Property Transfer Declaration is not returned to the county assessor within the 30 days of notice, the assessor
may impose a penalty of $25.00 or .025% (.00025) of the sale price, whichever is greater. This penalty may be imposed for any
subsequent year that the buyer fails to submit the declaration until the property is sold. Refer to 39-14-102(1)(b), C.R.S.
Confidentiality: The assessor is required to make the Real Property Transfer Declaration available for inspection to the buyer.
However, it is only available to the seller if the seller filed the declaration. Information derived from the Real Property Transfer
Declaration is available to any taxpayer or any agent of such taxpayer subject to confidentiality requirements as provided by law.

which the real property is located or that county treasurer's authorized agent unless the proposed insured provides
written instructions to the contrary. (for an Owner's Policy of Title Insurance pertaining to a sale of residential real
property).
(C) The information regarding special districts and the boundaries of such districts may be obtained from the Board of
County Commissioners, the County Clerk and Recorder, or the County Assessor.
Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing in the clerk
and recorder's office shall contain a top margin of at least one inch and a left, right and bottom margin of at least one half of
an inch. The clerk and recorder may refuse to record or file any document that does not conform, except that, the
requirement for the top margin shall not apply to documents using forms on which space is provided for recording or filing
information at the top margin of the document.
Note: Colorado Division of Insurance Regulations 8-1-2 requires that "Every title entity shall be responsible for all matters
which appear of record prior to the time of recording whenever the title entity conducts the closing and is responsible for
recording or filing of legal documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recording the legal documents from the
transaction, exception number 5 will not appear on the Owner's Title Policy and the Lenders Policy when issued.
Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion of Exception no. 4 of
Schedule B, Section 2 of the Commitment from the Owner's Policy to be issued) upon compliance with the following
conditions:
(A) The land described in Schedule A of this commitment must be a single family residence which includes a
condominium or townhouse unit.
(B) No labor or materials have been furnished by mechanics or material -men for purposes of construction on the land
described in Schedule A of this Commitment within the past 6 months.
(C) The Company must receive an appropriate affidait indemnifying the Company against un -filed mechanic's and
material -men's liens.
(D) The Company must receive payment of the appropriate premium.
(E) If there has been construction, improvements or major repairs undertaken on the property to be purchased within six
months prior to the Date of Commitment, the requirements to obtain coverage for unrecorded liens will include:
disclosure of certain construction information; financial information as to the seller, the builder and or the contractor;
payment of the appropriate premium fully executed Indemnity Agreements satisfactory to the company, and, any
additional requirements as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured has contracted for or agreed
to pay.
Note: Pursuant to CRS 10-11-123, notice is hereby given:
This notice applies to owner's policy commitments disclosing that a mineral estate has been severed from the surface
estate, in Schedule B-2.
(A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise conveyed from the
surface estate and that there is substantial likelihood that a third party holds some or all interest in oil, gas, other
minerals, or geothermal energy in the property; and
(B) That such mineral estate may include the right to enter and use the property without the surface owner's permission.
Note: Pursuant to CRS 10-1-128(6)(a), It is unlawful to knowingly provide false, incomplete, or misleading facts or
information to an insurance company for the purpose of defrauding or attempting to defraud the company. Penalties may

This Commitment shall be effective only when the identity of the Proposed Insured and the amount of the policy or policies committed for have been inserted in Schedule A
by the Company. All liability and obligation under this commitment shall cease and terminate six months after the Effective Date or when the policy or policies committed for
shall issue, whichever first occurs, provided that the failure to issue such policy or policies is not the fault of the Company.
Conditions and Stipulations
1. The term "mortgage", when used herein, shall include deed of trust, trust deed, or other security instrument.
2. If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or
mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to Company in writing, the
Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so
disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any
such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such
amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations.
3. Liability of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of Insured in the form of
policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof or (b) to
eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate or interest or mortgage thereon covered by this Commitment. In no event shall such
liability exceed the amount stated in Schedule A for the policy or policies committed for and such liability is subject to the insuring provisions and the Conditions and
Stipulations and the Exclusions from Coverage of the form of policy or policies committed for in favor of the proposed Insured which are hereby incorporated by
reference and are made a part of this Commitment except as expressly modified herein.
4. This commitment is a contract to issue one or more title insurance policies and is not an abstract of title or a report of the condition of title. Any action or actions or
rights of action that the proposed Insured may have or may bring against the Company arising out of the status of the title to the estate or interest or the status of
the mortgage thereon covered by this Commitment must be based on and are subject to the provisions of this Commitment.
5. The policy to be issued contains an arbitration clause. All arbitrable matters when the Amount of Insurance is $2,000,000 or less shall be arbitrated at the option of
either the Company or the Insured as the exclusive remedy of the parties. You may review a copy of the arbitration rules at www.alta.org.
Standard Exceptions
In addition to the matters contained in the Conditions and Stipulations and Exclusions from Coverage above referred to, this Commitment is also subject to the following:
1. Rights or claims of parties in possession not shown by the Public records.

Existing Site Conditions:
The subject property is located at 3265 Gray Street. The site is zoned Residential -One C (R -1C) and is
generally surrounded by residential zones. The majority of parcels to the east, south, and north are also
zoned R -1C and contain single family homes. The parcel immediately to the south is zoned R -1C but
contains the Sons of Italy Lodge and parking lot. Properties to the west across Harlan Street are zoned
Residential -Two (R-2) and consist of single family homes and duplexes. Some Residential -Three (R-
3) lots are interspersed through the area, and are across W. 32nd Avenue to the south.
The property consists of two lots in the Weiland Subdivision, with 75 feet of street frontage each for a
total of 150 feet. Based on Jefferson County records, both lots have an area of 10,530 square feet, for a
total area of 21,060 square feet (0.48 acres). There is an existing home on the property which was built
in 1954 and straddles the lot lines. It has a footprint of approximately 987 square feet.
Applicant/Owner Preliminary Proposal:
The applicant intends to subdivide the property into three lots in order to construct three new single-
family homes. The three lots would be 50 feet wide, and approximately 7,000 square feet each. The
applicant wishes to preserve the existing single-family home for a year, while the home on the new
southern lot is built. Then, the existing home would be demolished, and 2 additional single-family
homes would be constructed on the northern two lots.
Will a neighborhood meeting need to be held prior to application submittal?
A neighborhood meeting will not be required.
Planning comments:
The following items were discussed based on the applicant's proposal:
Zoning & Use
The property is zoned Residential -One C (R -1C), a zone district which is established to provide high
quality, safe, quiet and stable, medium -density single-family residential neighborhoods. For each
single family residence, a minimum of 5,000 square feet of land area is needed with 50 feet of street
frontage. The applicant's proposal meets the standards and intent of the R-1 C zone.
Bulk plane standards apply to all new single-family homes, additions, and accessory structures in the
R -1C zone. Please refer to the attached bulk plane standards document for more detailed information.
Bulk plane standards apply to all property lines.
Parkland Dedication
Parkland dedication is required for all residential development or subdivisions based on the
assumption that additional residents in the City will impact the demand for parks and open space.
When land is not dedicated for a public park, a fee is required in lieu. The fee is $2,497.29 per new
residential unit. Because the property currently has a home, the applicant will receive credit for this
unit and will be required to pay the fee for the added two units, a total of $4,994.58.
Landscaping
For single-family residential uses, one front yard tree is required per 70 feet of street frontage, to be
placed within the front setback prior to the issuance of a certificate of occupancy. No less than 25% of
the lot area and no less than 100% of the front yard (excluding driveways and sidewalk areas) shall be
landscaped. No more than 50% of the total landscaped coverage on the lot shall be comprised of turf.
The use of low water demand turf varieties such as buffalo grass, blue grama grass, and tall fescue is
encouraged. For this subdivision, 3 total street trees will be required, 1 per lot.
Utility Providers
The City of Wheat Ridge is not a full-service city. The utility and service providers for this property
include:

All land use applications will be sent out on referral to these agencies for comment; however, staff
encourages potential applicants to contact service districts ahead of time. This may help to understand
any design or infrastructure requirements and potential costs associated with the proposed project.
Building Division comments:
New construction will require building permits, and the issuance of a Certificate of Occupancy upon
completion of the project, and only after passing all of the required inspections.

The City has adopted and currently enforces the 2012 Edition of the International Codes and the 2014
Edition of the National Electric Code. The City uses the ANSI 117.1-2009 Standard in determining
requirements related to accessibility.
Public Works comments:
Right-of-way Dedication
The existing right-of-way (ROW) along Gray Street is currently substandard. To bring this up to
compliance, a 1.5 foot wide strip of ROW will be required to be dedicated along the Gray Street
frontage.
Public Improvements
The existing curb, gutter, and sidewalks along Gray Street are substandard to today's standards. A 5 -
foot attached monolithic sidewalk with 6 -inch vertical curb and gutter is the standard design
requirement along Gray Street; the approximate fee -in -lieu required at the time of plat recording will
be $7,853. The applicant may construct these improvements or choose to pay fees -in -lieu of
construction. Public Works recommended paying fees -in -lieu instead of building improvements.
Please refer to the Public Works comments and fee estimation table.
Drainage
The added impervious surface will likely be between 3,000 and 10,000 square feet, which is
considered a "Moderate Development" under the Site Drainage Requirements. Please refer to the
attached Public Works comments. The project will require a stormwater detention and water quality
facility in a separate, non -buildable tract. Staff believes the three lots, plus a stormwater detention tract
can be accommodated and still meet the 50 -foot lot width requirement, and the 5,000 square foot
minimum lot size.
Please note that site grading and stormwater drainage facilities will need to meet design requirements
as well as engineering requirements. The purpose of these design standards is to ensure that grading
and drainage is integrated into site development and provide enhancements to the site through low
impact design approaches. For grading plans, this can include terracing and rolling grades. For
drainage facilities, this can include incorporation of natural features (such as boulders and
landscaping) as well as surface treatments on concrete structures. Refer to Sections 26-507 and -508 of
the municipal code for code requirements and to the Architectural and Site Design Manual for
explanatory images.
Subdivision Review Process
A subdivision consisting of 3 or fewer lots or parcels is considered an administrative plat. Review and
approval of this type of subdivision plat is an administrative process that does not require a public
hearing. Following the pre -application meeting, an application packet shall be submitted to the
Community Development Department by appointment. Staff will review the application for
completeness.
Upon submittal of a complete application, the case manager will review the application, send it out on
referral to outside service agencies (Xcel Energy, water district, fire district, etc.) and other City
agencies (Public Works, Economic Development, etc.) for review. The referral period is 15 days,
during which time the referral agencies and departments may submit comments on the application.
These comments, as well as those from the case manager, will be forwarded to the applicant.
Modifications to the subdivision plat may be required as a result of these comments. The applicant
must address comments and resubmit relevant documents. This process may need to occur several
times.
After the review period, staff will prepare written findings with a recommendation. The Community
Development Director shall review the plat and approve, approve with conditions, or deny the plat.
Once approved, a blackline mylar copy of the plat must be submitted to the City of Wheat Ridge in
order to be recorded with Jefferson County Clerk and Recorder with fees for recording.
The plat must be approved and recorded prior to the issuance of any building permits.

Re: 3265 Gray Lot Split
We propose splitting the property situated at 3265 Gray, lots 7&8, in the Wieland
Subdivision, into a total of 3 conforming R -1C lots. After the process there would be
3 lots with 50 feet of frontage each and approximately 140 feet of depth for a
approximate area of 7000 square feet.
These would all be street loaded lots with no alley in the rear.
Currently there is a primary structure situated on the lot as well as a small accessory
structure directly behind the primary.
It appears that all the services will be able to service due to the water, sewer, and
gas service in Gray Street. There may need to be a small main line extension (10 ft)
for the sewer or possibly an easement through the new middle lot.
The reason for the lot split is to be able to build at first 1 additional single-family
home on the southern most lot and then follow that with 2 new single-family homes
on the northern 2 lots after the house is removed.
Our surveyor was out today to start the ISP and we hope to have a draft in hand on
the 281h.

Requirements for Final Plats

4 Initial each item as completed. This form shall accompany the Final Plat submittal.
1. All distances for the above referenced Plat are shown using (ground) modified State Plane
measurements (U.S. survey feet rounded to the nearest 0.01') consistent with the Current City
Datum, AND the following datum information is shown on the Final Plat:
a. The Current Cite Datum Coordinate System used is a ground-based modified form of the
NAD83/92 State Plane Coordinate System, Colorado Central Zone 0502.
b. Vertical Datum used is the North American Vertical Datum of 1988 (NAVD88).
