If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disclose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations. 3. Liabilitv of the Company under this Commitment shall be only to the named proposed Insured and such parties included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate of interest or mortgage thereon covered by this Commitment. Mauro, am the legal owner of the above mentioned property as recorded in book 2104, page 249, ~lay 20, 1969 in Jefferson County, per attached copy. The above mentioned property is 66 ft in width and 174.58 ft in length, and is now zoned C-1. I listed this property on r10vember 29, 1976 with RE/MAX Suburban, Inc. and they actively searched the market for a buyer. RE/MAX, in their efforts to market the property, uncovered thru the Planning and Zoning Commission of the City of "Jheat Ridge that the City of \.Jheat Ridge could at any time take 25 ft of width of my property running in a Southerly direction on Depew St. from \.Jest 38th {we. If this were done at the present time the buildinQ that occupies this site would set directly on the new proposed street and possibly lose one of its walls. I also found out that I cannot erect another structure on this property because of the 25 ft street dedication. The property would then be in conflict with Ordinance # 90 of the City of Wheat Ridge. I now have a contract on the above mentioned property but it is expressly contin!Jent on the Planning and Zoning Corrnnission of the City of t'/heat Ridge granting the purchasers permission to renovate or destroy and erect a new structure on the above mentioned property on or before June 15, 1977.
