This description is not to be relied upon as representing a monumented land survey. Said parcel contains 0.879 acres more or less. Should the property described above cease to be used for right-of-way purposes, then Arvada shall have a right-of-entry with regard to said real property. Said right-of-entry may not be exercised by Arvada for so long as the City of Wheat Ridge is defending any legal action regarding creation of any Special Improvement District pertaining to the construction of West 48th Avenue adjacent to the property herein conveyed. TOGETHER, with all and singular the hereditaments and appurtenances thereto belonging, or in anywise appertaining, and the rents, issues and profits thereof, and all the estate, right, title, interest, claim and demand whatsoever of the said party of the first part, either in law or equity, of, in and to the above bargained premises, with the hereditaments and appurtenances.
