THIS DEED, Made this ..;U, day of 1988, between City of
Arvada, a municipal co poration, 8101 Arvada, CO 80002, Counties of
Jefferson and Adams, and State of Colorado, of the first part, and City of Wheat
Ridge, a municipal corporation, of the County of Jefferson and State of Colorado,
of the second part:
WITNESSETH, That the said party of the first part, for and in consideration
of the sum of TEN DOLLARS AND OTHER GOOD AND VALUABLE CONSIDERATIONS to the said
party of the first part in hand paid by said party of the second part, the receipt
whereof is hereby confessed and acknowledged, has granted, bargained, sold and
conveyed, and by these presents does grant, bargain, sell, convey and confirm,
unto the said party of the second part, its heirs and assigns forever, all the
following described lot or parcel of land, situate, lying and being in the County
of Jefferson and State of Colorado, to wit:

A portion of Tracts 9, 10, 11, and 12, NICHOLAS GARDENS, Jefferson County Records,
described as follows:
Beginning at the northwest corner of said Tract 9; thence south 0 degrees 18' 19"
east (assumed bearing) along the west line of said Tract 9 a distance of 43.98
feet to the south line of Section 17, T3S, R69W, of the 6th P.M.; thence south 0
degrees 15'12" east along said west line 55.52 feet; thence north 12 degrees
14'03" east, 45.81 feet; thence northeasterly along a curve concave to the
southeast, having a radius of 27.00 feet, and a central angle of 73 degrees
15' 09"; thence north 85 degrees 29' 12" east, 221.14 feet; thence north 89
degrees 07' 50" east parallel with the north of said Tracts 9, 10, 11 and 12 a
distance of 366.43 feet; thence easterly along a curve concave to the south,
having a radius of 974.00 feet, and a central angle of 14 degrees 20'54"; thence
south 76 degrees 31'16" east, 16.17 feet; thence easterly along a curve concave
to the north, having a radius of 367.03 feet, and a central angle of 49 degrees
12' 05" to the north line of said Tracts 9, 10, 11, and 12; thence south 89
degrees 07'50" west, 1178.81 feet to the point of beginning.
This description is not to be relied upon as representing a monumented land
survey.
Said parcel contains 0.879 acres more or less.
Should the property described above cease to be used for right-of-way purposes,
then Arvada shall have a right-of-entry with regard to said real property. Said
right-of-entry may not be exercised by Arvada for so long as the City of Wheat
Ridge is defending any legal action regarding creation of any Special Improvement
District pertaining to the construction of West 48th Avenue adjacent to the
property herein conveyed.
TOGETHER, with all and singular the hereditaments and appurtenances thereto
belonging, or in anywise appertaining, and the rents, issues and profits thereof,
and all the estate, right, title, interest, claim and demand whatsoever of the
said party of the first part, either in law or equity, of, in and to the above
bargained premises, with the hereditaments and appurtenances.

appurtenances, unto the said party of the second part, its heirs and assigns
forever. And the said party of the first part, for its heirs, executors, and
administrators, do/does covenant, grant, bargain, and agree to and with the said

it will WARRANT AND FOREVER DEFEND the above bargained premises in the quiet and
peaceable possession of the said party of the second part, its heirs and assigns
against all and every person or persons lawfully claiming the whole or any part
