erations of the LETTER OF AGREEMENT hereunto attached, hereby do sell/~
and convey to the city of Wheat Ridqe, a municipal corporation in the
state of Colorado, whose address is 7500 West 29th Avenue, Wheat
Ridge, County of Jefferson, state of Colorado, 80215-6797, the follow-
ing real property, in the City of Wheat Ridge, county of Jefferson,
state of Colorado, to wit:
A tract of land lying in the NW 1/4 of Section 26, Township 3
south, Range 69 West of the 6th principal Meridian, city of
Wheat Ridge, county of Jefferson, state of colorado, de-
scribed as:
A portion of that parcel of land described in Book 3023 at
paqe 6 of the official records of the County of Jefferson,
state of Colorado, described as: Beqinninq on the west line
of said parcel and 30 feet south of the north line of said
parcel; thence south 1 foot along the west line of said
parcel; thence easterly parallel with said north line, 61
feet more or less; thence on a deflection angle of 45 degrees
to the right to the east line of said parcel; thence north
alonq said .ast line, 15.00 feet; thence west alonq a line 30
feet south of and parallel with said north line to the point
of beginninq.

LETTER OF AGREEMENT .
THIS AGREEHBNT, made on the zJl-l!!. day of mtj/U'~ ,AD. 1993,
between JACK D. and FAYE L. HORTON, the owners of the real prop- ~
erty known as 8060 W. 38th Ave., Wheat Ridge, Colorado, herei-
nafter called the "OWNERS", and the CITY OF WHEAT RIDGE, a munic-
ipal corporation of the State of Colorado, hereinafter called the
"CITY".
WITNESS: the Payments and conditions hereinafter mentioned:
THE CITY AGREES TO THE FOLLOWING, SUBJECT TO ACCEPTANCE OF
THE RIGHT-OF-WAY BY CITY COUNCIL:
1. Construct a 16' wide driveway at location of current
drive way.
2. Remove the pine trees along West property line at
the Northweat property corner.
3. Remove the 4 Northerly Elm trees along the West
property line (stumps not to be ground). Trees to
be cut as close to the ground as possible.
4. Construct curb, gutter and sidewalk along W. 38th
Ave. and Allison ct. frontages.
5. Construct a catch basin in the lawn near the North-
east corner of the property.
THE OWNERS AGREE TO THE FOLLOWING:
1. Sign easement, quit claim deed, & ~arranty
deed.
THE OWNERS ACKNOWLEDGE AND AGREE:
1. New driveway will be at a slightly steeper grade
than currently exists.
2. New driveway is acceptable and approved for con-
struction.
