Chair Germano called the Liquor Authority Meeting to order at 9:05 a.m. Liquor Authority Members present: Lenny Ortiz, Rocco Germano, Cynthia Shaw, Paul Shaver, Carolyn Peterson, Bruce McIntyre Absent: Anthony Davia, Elizabeth Nazarenus Also present: City Clerk, Steve Kirkpatrick; Assistant City Attorney, Joe Rivera; Applicant Shawn Kordouni APPROVAL OF MINUTES OF July 9, 2020 Motion by Member Shaver to approve the minutes of July 9, 2020; seconded by Member Peterson; Motion carried 5-1 , with Member McIntyre abstaining. Item 1. Introduced by Chair Germano Hearing for a new Fermented Malt Beverage (Beer) Off-Premises Liquor License – Spectrum Inc. dba I-70 & Harlan Service, located at 6065 W. 48th Avenue, Wheat Ridge, CO 80033 Chair Germano opened the public hearing City Clerk Kirkpatrick and Asst. City Attorney Joseph Rivera gave the initial findings for the staff report and entered Exhibits 1-6 into the record, showing the applicant has fulfilled all of the requirements to hold a fermented malt beverage liquor license. He explained that Spectrum Inc. is a new Fermented Malt Beverage (FMB) license applicant, wishing to sell beer at his location in Wheat Ridge and that Mr. Kordouni consents to the virtual hearing. They explained that the applicant had requested concurrent review with the State and that the hearing had been re-scheduled a few times since originally being applied for in February 2020. It was explained that during the pandemic that new procedures are in place so that the applicant mailed out notice of the application and hearing, instead of the usual procedures of petitioning for the needs and desires of the neighborhood. Chair Germano swore in the owner Shawn Kordouni Mr. Kordouni offered testimony as to why his application should be approved and added that he was available to help answer any questions that the board may have. Chair Germano asked for discussion on the item. Member Shaver asked the applicant if they have been trained in the proper manner to check and verify I.D.’s. Mr. Kordouni responded that yes they are going to implement what the State currently requires and check the I.D.s of people under the age of 40. Much as they currently already do when selling tobacco products. Chair Germano reminded the applicant that there is no on-premises consumption allowed, which Mr. Kordouni acknowledged and agreed to. Motion by Member Peterson to approve the issuance of a new Retail Fermented Malt Beverage License for Spectrum Inc. dba I-70 & Harlan Service, located at 6065 W. 48th Avenue, Wheat Ridge, CO 80033 on the basis of the following findings: 1. Public Notice of the hearing on the Application was published and posted on the property as required by Colorado law; 2. The applicant is qualified to obtain a liquor license pursuant to C.R.S. Section 44- 3-307; 3. The premises are in a location eligible to conduct the proposed liquor licensed business pursuant to C.R.S. Section 44-3-313 and the zoning laws of the City; 4. The applicant is entitled to possession of the premises for which the application is made; 5. The neighborhood under consideration is considered to be within a one-half mile circumference around the proposed licensed premises; 6. The inhabitants of the neighborhood desire an additional establishment that serves liquor; 7. The needs of the neighborhood are not met by the existing outlets.
