There are unique circumstances due to the property location and topography of the area. 2. The variance will not alter the character of the neighborhood. 3. It would result in a substantial investment in the property. I. REQUEST The applicant is requesting approval of a variance to Section 26- 711.C. 4. of the zoning and development code to increase the height of a billboard from 32' to 48'. Included in the request is a front setback variance of 20' from the 50' required setback prescribed by Section 26- 711.C.3. The purpose of the variance is to allow replacement of a single -faced billboard with a new double -faced billboard. Section 26 -115.0 (Variances and Waivers) of the Wheat Ridge City Code allows that the Director of Community Development (Director) may grant administrative variances from the strict application of the zoning district development standards. Administrative variances are allowed for up to 50% of the development standard. II. CASE ANALYSIS Property description The applicant is proposing to raise an existing billboard, which is 32 feet tall, to the height of 48 feet above ground level. (Exhibit 1, billboard elevation) Included within the request is a setback variance to allow the billboard to be setback less than the required 50' setback. (Exhibit 2, property survey) The proposal would result in the billboard being rebuilt and changing the existing supports from a multiple I -beam columns to a single mono - column pole. The existing billboard is 32' high and appears to be about 30' setback from the front property line. The purpose of the proposal is to increase visibility of the sign from I -70. Due to grade change and existing mature trees, the billboard is very difficult to read at its current height. The front of the structure which is single story in height sits south of the billboard, closer to W. 48 Avenue, also blocking visibility. The existing billboard only has one sign face, which faces east, and the applicant would also like to add a second face on the west side of the sign so that it has a "V" shaped configuration. (Exhibit 3, sign plan view) In addition, due to the unusually large right of way width for 48 Avenue, a front setback variance is included (Exhibit 4, Right -of -way map) The property is zoned Commercial Two (C -2), a commercial district established to provide for areas with a wide range of commercial land uses which include office, general business, more intensive retail sales, wholesale businesses, and light Case No. WA -10 -091 Lamar Advertising 2 manufacturing. The site, which is irregular in shape has an area of 26,354 SF, and is located at the intersection of W. 48 Ave and W. 48' Place. It contains a single -story commercial building which houses an HVAC contractor's business and is approximately 6,940 SF in size. A large parking and outside storage area are located on the western side of the structure, adjacent to 48' Place. The existing billboard is located on the east side of the property to the east of the commercial building in a large landscaped area. The sign has currently has a front setback of 30 feet from W. 48' Avenue and is located just a few feet from the side (east) property line. The new sign would essentially be reconstructed in the same location but would be 18' taller in height. Immediately east and north of the site is a commercial office /warehouse property, zoned Planned Commercial Development (PCD). To the west, across 48' Place, is a commercial property zoned Commercial -One (C -1). The southern perimeter of the property is bordered by W 48 Avenue, with I -70 directly south of that. Agency referral The Wheat Ridge building division was consulted regarding this request. The Chief Building Official indicated that the narrow side setback between the billboard and the east property line was acceptable and should not conflict with the building code since there are no buildings close to the billboard. At the time of applying for a building permit, stamped engineer drawings will be required for the pole and foundation. III. VARIANCE CRITERIA Staff has the following criteria to evaluate variance requests and shall determine that the majority of the "criteria for review" listed in Section 26- 115.C.4 of the City Code have been met. The responses have been written to address both the height variance and setback variance. The applicant has provided their analysis of the application's compliance with the variance criteria (Exhibit 5, applicant letter). Staff provides the following review and analysis of the variance criteria. The property in question would not yield a reasonable return in use, service or income if permitted to be used only under the conditions allowed by regulation for the district in which it is located. If the height variance request were denied, the billboard could still remain with the same visual obstructions. Granting of the variance should increase visibility which in turn may result in an increase in sales for the companies being advertised. The same is true for the setback variance. If the billboard is rebuilt it would have to meet the 50' required setback and would sit 30' north of its current location. Granting of the variance should help visibility which in turn may result in an increase in sales for the companies being advertised. (Exhibit 6, photos and photo simulations). Case No. WA -10 -09 /Lamar Advertising Staff finds this criterion has been met. 2. The variance would not alter the essential character of the locality. If the requests are granted, the character of the area would not be negatively impacted. This is an area which is fairly industrial in nature. There are also other billboards in the immediate vicinity. Billboards have existing on this property since 1973. Staff finds this criterion has been met. 3. The applicant is proposing a substantial investment in the property with this application, which would not be possible without the variance. The applicant is proposing a substantial investment in the property by rebuilding the sign structure that would not be logical if the variances increasing visibility are not granted. If the variances are denied, the outdated looking sign structure would remain. (Exhibit 7, View of existing billboard structure) Staff finds this criterion has been met 4. The particular physical surrounding, shape or topographical condition of the specific property involved results in a particular and unique hardship (upon the owner) as distinguished from a mere inconvenience if the strict letter of the regulations were carried out. The location of the property, the topography relative to the level of the freeway and mature trees in the area has created a unique hardship for the applicant. Staff finds this criterion has been met. 5. The alleged difficulty or hardship has not been created by any person presently having an interest in the property. A person who has interest in the property has created the hardship by wanting to rebuild the billboard. Staff finds this criterion has not been met. 6. The granting of the variance would not be detrimental to the public welfare or injurious to other property or improvements in the neighborhood in which the property is located, by, among other things, substantially or permanently impairing the appropriate use or development of adjacent property, impairing the adequate supply of light and air to adjacent property, substantially increasing the congestion in public streets or increasing the danger of fire or endangering the public safety, or Case No. WA -10 -091 Lamar Advertising 4 substantially diminishing or impairing property values within the neighborhood. Staff concludes that granting the requests would not be detrimental to public welfare and would not be injurious to neighboring property or improvements. The variance would not hinder or impair the development of the adjacent property. The request would not increase the congestion in the streets. The request will most likely not have an effect on property values in the neighborhood. There could be a slight impact to the supply of air and light to surrounding properties. Staff finds this criterion has been met. 7. The unusual circumstances or conditions necessitating the variance request are present in the neighborhood and are not unique to the property. The conditions necessitating the variances are present in this area. There have been other height variances granted for billboards in the vicinity due to the elevation of I -70 and mature trees in order to increase visibility. The right -of -way for W. 48` Avenue continuing around the curve to Marshall is excessive in width. Many of the businesses in this stretch have received setback variances with justification being the overly wide right -of -way. Staff finds this criterion has been met. 8. Granting of the variance would result in a reasonable accommodation of a person with disabilities. Accessibility requirements are not applied to billboards. Staff finds this criterion is not applicable. 9. The application is in substantial compliance with the applicable standards set forth in the Architectural and Site Design Manual. The Architectural and Site Design Manual does not apply to billboards. Staff finds this criterion is not applicable. IV. STAFF CONCLUSIONS AND RECOMMENDATIONS Having found the application in compliance with the majority of the applicable review criteria, staff recommends approval of the variances to the height and setback standards applicable to billboards for property zoned C -2 located at 6285 W. 48` Avenue. Staff has found there are unique circumstances attributed to this request and that conditions that warrant approval of the variance are prevalent in the vicinity. ME L2 ST. t\( EXHIBIT 4 Lamar Advertising / Major Heating Billboard Improvement Project September 2, 2010 Attached you will find for your review a variance application to raise the Lamar Advertising Billboard located at 6285 West 48' Avenue in Wheat Ridge. The property is owned by the Major family who run their business Major Heating and Air Conditioning on the property. We request that Lamar be allowed to increase the height of the sign from 32 feet to 48 feet so that it can be read from I -70 as it was intended when it was originally built. Since the sign was built there has been a great deal of growth in trees in the area. Because the property sits below the grade of I -70 and due to the growth of the trees the sign is virtually unreadable. This project would involve removing the existing sign and installing a single pole sign in the same location. It would not alter the existing set back from 48' Avenue. The sign currently has an approximate set back of thirty feet from the front property line. The Wheat Ridge ordinance requires a 50' setback. We also request a variance from this requirement. You will notice from the survey that the property line is located inside the concrete parking area in front of the Major's property. The property has an unusual shape and for practical purposes the sign is set back more than 50' from 48 a ` Avenue. Any further setback from where the sign sits today would increase the difficulty of reading the sign from I -70. When the sign is raised we would also like to add a second face to the west side of the sign. The sign will look much better with a second face. The Wheat Ridge sign code allows for billboards to have two faces. In remodeling this sign Lamar will convert the sign from its current four pole configuration to a single pole. This will improve the look of the sign while making it less obtrusive to the use of the property. Thank you for your consideration. This billboard is one of the sixteen (16) billboards permitted in that district pursuant to Code Section 26- 711.C. The proposal is to reconstruct the billboard to a larger height, and to make it a double face billboard with two sides. As described below, I have concluded that this is a reconstruction, not a new billboard: • Reconstructing the billboard to add a second face does not constitute construction of a "new" billboard which would trigger the requirement of Code Section 26- 711.C.6 ( "no new billboard may be located closer than six hundred (600) feet to any other billboard facing in the same direction on the same roadway..." The billboard in question is an existing billboard and its location closer than 600 feet to a highway is permitted under the Code. • Repair and reconstruction of existing billboards does not thereby make them "new" billboards within the meaning of Code Section 26- 711.C.6 as to location. • Neither does adding a second face to an existing billboard constitute a "new" billboard within the meaning of the location requirements of Code Section 26- 711.C.6. Existing Conditions: The property is zoned Commercial Two (C -2), a commercial district established to provide for areas with a wide range of commercial land uses which include office, general business, more intensive retail sales, wholesale businesses, and light manufacturing. The site, which has an area of 26,354 SF, is located at the intersection of W 48` Ave and 48`' Place. It contains one single -story commercial building, approximately 6,940 SF in size. The existing billboard is located on the east side of the property, behind the commercial building. The sign has a front setback of 30 feet from W 48` Avenue, is located just a few feet from the side (east) property line. Immediately east and north of the site is commercial property, zoned Planned Commercial Development (PCD). To the west, across 48 Place, is a commercial property zoned Commercial - One (C -1). The south of the entire property is bordered by W 48 Avenue, with I -70 directly south of that. Planning comments: Section 26 -711 of the Wheat Ridge Zoning Code pertains specifically to billboards. The code divides the city into two sections, B -1 and B -2, and only allows billboards in the B -2 district, which is close to I -70. This site is within the B -2 district and contains one of the existing 16 allowable billboards in the city. Section 26 -711 also sets a maximum height of 32' for any billboard. In order to raise the billboard above this height, a variance will be required. If the proposed new height for the billboard is 48 feet or less, which is a 50% or less variance from the 32 -foot height maximum, an administrative variance process will apply. If the full 50 -foot height is requested, because this is a variance of greater than 50% from the standard, a non - administrative variance process will apply. Please see the process section below for more information. The billboard meets required setbacks for the zone district (C -2) and the location will not be changed as part of this proposal. The current sign has one face, facing east. The applicant would also like to add a west - facing sign. Staff is conferring with the City Attorney to determine whether the code will allow the second face and will follow -up with the applicant as soon as a determination is made. Variance Process The next step in the process is to submit a variance application. The variance application (administrative or non - administrative) must include the following items: 1. Completed Land Use Case Application including an explanation of the request. 2. A $200 application fee (administrative); $300 application fee (non - administrative). 3. A minimum publication/public notice fee of $180 (non - administrative). 4. Proof of ownership (i.e., copy of deed). 5. Survey of the property. 6. A plot plan of the property graphically showing the variance proposal. 7. Written response to variance criteria 8. Elevations Please schedule an appointment with a planner when you are ready to submit your application. No incomplete applications will be accepted. When the application is submitted, a staff planner will be assigned to handle your case. This person is the project manager for your case and will be your contact at the City throughout the entire variance process. The case manager will review your application for content. Once reviewed, the proposal may be referred to outside agencies and other City departments for review and comment. All comments 2 received will be forwarded to you so you are aware of their comments, recommendations, and requirements. The variance case can now be scheduled for administrative review or for a public hearing in front of the Board of Adjustment which meets the fourth Thursday of every month. If the application meets the criteria for administrative review, the Community Development Department shall notify adjacent property owners by certified letter and posting of the site for 10 days. Once the applicant has posted the public notice sign, a posting certification form is to be completed and returned to the Community Development Department. If no written objections to the variance request are received during this 10 day period, the Community Development Director can take action on the variance application. The Community Development Director can approve, approve with conditions, or deny the variance. There is a specific set of criteria used to evaluate and determine approval status by the Director. Conditions of approval may be placed upon the variance to ensure compliance with the criteria for review. Upon receipt of a written objection by an adjacent property owner or upon appeal by an applicant of a decision by the Community Development Director, the variance request will be heard by the Board of Adjustment through a public hearing process. Any written objections must be directly related to the variance request. Objections regarding existing land use conditions or issues not related to the request will not be considered a valid reason for objection. Once a Board of Adjustment public hearing date is established, public noticing will be given in a manner consistent with Section 26 -109. The case manager will prepare a staff report to be presented to the Board of Adjustment. There is a specific set of criteria used to evaluate a requested variance. At the hearing, after the staff report is given, you (the applicant) and members of the audience will be given a chance to give testimony regarding the application. Generally, a decision for approval or denial will be made that same night. Sometimes a case will be continued to another hearing date for further study and input. A super majority vote (or votes) is required to approve an application. (For example: if 8 members are present, 6 affirmative votes are needed.) Our sign currently sits on the east side of the property. The sign height is only 32 feet above ground level. As it sits today our sign is almost totally obstructed from any I -70 view by the elevated nature of I -70 and a number of trees which have grown in the CDOT Right of Way making it of little to no value to local advertisers, the Majors or Lamar. Our request is that you allow us to raise our sign to 50 feet and convert the supports from multiple `I beam' columns to a single mono -pole column. This will simplify the structure aesthetically and at the same time free up the property below the sign faces for the Majors. Obviously, Lamar will pay all cost associated with this project. We believe this proposed project is in the best interest of all parties. The structure will be simplified and much more aesthetically pleasing. The advertising space becomes much more viable for businesses and the associated revenue potential for the Majors and Lamar will be much greater. The Majors will also realize an increase in their property value because of the increased revenue and the less obtrusive structure. As long time business owners and residents of Wheat Ridge we would like to be able to maximize the value of our property. As it stands today Lamar's sign sits below the grade of I -70. It is also blocked by numerous trees in the CDOT right of away. The lease we have with Lamar allows for us to receive 30% of the sign's revenue. With the sign's current location it is almost unreadable from I -70 and its value for advertising is significantly diminished. We seek to leave the sign at its current location on the property. We ask that Lamar be allowed to convert this sign to a single pole sign and raise it to 50 feet above ground. At this height the sign will be more readable to I -70 and increase its value to both Lamar and us as property owners. Converting the sign to a monopole will enhance the look of the sign and the property. The use of the sign as a billboard is consistent with cmrunercial uses in the neighborhood. We feel that the growth of the trees in the right of way along with the elevated highway has created a hardship which is out of our control. By allowing the sign to be raised Wheat Ridge will be returning the value of the sign and property to its original condition when the sign was built. We enjoy the income the sign provides us and are not sore Lamar can continue with its operation of the sign if the current conditions continue. We appreciate your consideration in this matter.
