Any construction or activity initiated under this License Agreement shall comply with and conform to standards formulated by the Board, and such construction or activity shall be performed and completed according to the plan and within the tolerances given on the Board's CAD drawing(s) 20742-1, a copy of which is attached hereto and made a part hereof. 4. In granting this License, the Board reserves the right to make full use of the property involved as may be necessary or convenient in the operation of the water plant and system under the control of the Board, and the Board retains all right to operate, maintain, repair, remove, relocate, or install any of its facilities within the Board's property at any time and in such a manner as it deems necessary or convenient. The Board will make reasonable attempts to locate the Licensee's facilities; however, should damage occur to the Licensee's facilities, the Board will not be held liable for any such damage. In the event clearing and restoration of the area is not completed within the seven (7) days, the Board may complete that work at the sole expense of the Licensee. 8. At no time shall Licensee interfere with the flow of water in Board facilities, and Licensee shall assume all risks incident to the presence of water in Board facilities. 9. The Licensee will use all reasonable means to prevent any loss or damage to the Board or to others resulting from the construction, operation, maintenance, repair, modification, replacement, or removal of the Licensee's installation. Any repair or replacement of any of the Board's installations on its property made necessary, in the opinion of the Board's representative, because of the construction, operation, maintenance, repair, modification, replacement, or removal of the Licensee's installation, shall be made only by the Board and at the sole expense of the Licensee. 10. The Licensee hereby expressly agrees to defend, indemnify, and hold harmless, insofar as it legally may, the Board, its officers, agents, and employees, against any liability, loss, damage, demand, action, cause of action, or expense of whatever nature (including court costs and attorneys' fees) which may result from any loss, injury, death, or damage incurred by the Licensee, caused by the Licensee's negligence or wrongful act, or which arises out of or is caused by any act or omission of the Licensee, its officers, agents, or employees in connection with or by reason of any work done or omission made by the Licensee, its agents, or employees, in the construction, operation, maintenance, repair, modification, replacement, or removal of the Licensee's installations. 11. The Licensee understands and agrees that it is fully responsible for compliance with all rules and regulations relating in any way to the use, storage, treatment, or disposal of hazardous materials, including, but not limited to, chemicals and petroleum products. The Licensee agrees to strictly comply with all federal, state, and local regulations that in any way relate to hazardous materials. If, as a result of the Licensee's occupancy of the premises and its operation hereunder, any such law, ordinance, rule, or regulation is violated, the Licensee shall protect, save harmless, defend, and indemnify, insofar as it legally may, the Board from and against any penalties, fines, costs, and expenses including legal fees and court costs incurred by the Board, caused by, resulting from, or connected with such violation or violations. 12. Certain Board properties may contain habitat for listed "threatened" or "endangered" species under the Endangered Species Act (ESA). The rights granted to the Licensee hereunder shall not be assigned. 14. The rights and privileges granted in this License Agreement are subject to prior agreements, licenses, and conveyances, recorded or unrecorded, and it shall be the Licensee's sole responsibility to determine the existence of any rights, uses, or installations conflicting with the Licensee's use of the Board's property hereunder and to resolve any conflict. 15. If the Licensee does not use the right herein granted or its installation for a period of one (1) year, or if the Licensee shall at any time fail to or refuse to comply with or carry out any of the conditions of this License, the Board may, at its election, revoke this License Agreement forthwith by written notice to the Licensee in person or by mail at the Licensee's last known address. Upon termination of this License, the Licensee shall have ten (10) days to remove its installation from the Board's property. In the event the Licensee does not remove its installation within the time allowed, the Board, without incurring liability, may remove the installation at the Licensee's expense. 16. Upon abandonment of any right or privilege herein granted, the right of the Licensee to that extent shall terminate, but its obligation to indemnify and save harmless the Board, its officers, employees, and agents, shall not terminate in any event. 17. The Board may, at any time, by giving the Licensee thirty (30) days written notice, terminate this License Agreement. 18. Licensee shall pay for all materials joined or affixed to the Board property and shall pay in full all persons who perform labor upon the Board property and obtain lien releases for all such materials and labor, which shall be provided to the Board, and shall not permit any mechanic's or materialman's lien of any kind or nature to be enforced against that Board property for any work done and materials furnished thereon at the instance, request, or on behalf of Licensee. 19. The base license fee includes eight (8) hours of inspection by the Board, and if the Board requires further inspection, the Licensee shall pay therefor at the prevailing rate. 20. All Board roads and fencing that are disturbed by the construction of the Licensee's installation shall be restored to a condition satisfactory to the Board's representative within seven O days from the date of finalization of the initial construction or authorized activity. Board roads and fencing that are disturbed by the reconstruction, operation, maintenance, repair, modification, replacement, or removal of the Licensee's facilities shall immediately be restored by the Licensee to a condition satisfactory to the Board's representative. The Licensee shall at no time obstruct Board roadways or ingress to or egress from such roadways. Restoration of roads shall include, but is not limited to, resurfacing when deemed necessary by the Board's representative. If restoration is not accomplished by the Licensee within the seven O days, the Board at its election may perform such restoration at the Licensee's expense. The Licensee shall conduct all construction, operation, maintenance, repair, modification, replacement, or removal of its installations in such a manner that the Board at all times shall have full and complete access to its property. Planning Commission Minutes June 4, 2020 - 1 — Jahi Simbai, Commissioner/Resident 2690 Pierce Street, Wheat Ridge Mr. Simbai made a statement thanking Chief Murtha of the Wheat Ridge Police Department for his statement released on June 1, 2020 and he invited all to read it on the City of Wheat Ridge website. He asked everyone to stay tough during these trying times and thanked all of the community's essential workers and included the Commission and members of the public. He asked to keep the lines of communication open and reminded all to treat every member of our community with respect. 7. PUBLIC HEARING A. Case No. WSP-20-04: an application filed by Design Edge for approval of a master sign plan for a unified development zoned Commercial -One (C-1) for the property located at 10019 West 26t' Avenue and 2625 Kipling Street. Mr. Cutler gave a short video presentation regarding the master sign plan and the application. He entered into the record the contents of the case file, packet materials, the zoning ordinance, and the contents of the digital presentation. He stated the public notice and posting requirements have been met, therefore the Planning Commission has jurisdiction to hear this case. Adam Radcliff a member of the Design Edge team gave a short video presentation listing six key signs that are imperative to the revitalization of Gold's Marketplace. Commissioner KERNS asked if the roof sign dimensions will change. Mr. Cutler said the sign dimensions will remain the same. Commissioner LARSON asked if the panels on the roof sign will change. Andy Olree, applicant 600 S. Harrison Street, Denver Mr. Olree explained that the steel structure will remain but with any repairs that need to be done. The box of the sign will be similar to the existing one, but replaced. Commissioner ANTOL asked if how long temporary signage can remain in place. Mr. Cutler clarified that there is no time limit on temporary signs but there are restrictions on the quantity. He also mentioned that each individual tenant can have 1 temporary sign each. Ms. Mikulak mentioned that the Code recognized a temporary sign by the type of material used and does not list a time limit. Planning Commission Minutes -2— June 2— June 4, 2020 Commissioner OHM asked if the proposed City of Wheat Ridge monument signs will be installed at a later date. Mr. Cutler mentioned that the monument sign located at the corner of 26th Avenue and Kipling Street will be in the City's right-of-way and the engineering division will in the future have more defined plans for the exact location and what it will look like and it should not conflict with the applicant's monument sign. Commissioner ANTOL asked if there were any comments from the surrounding neighborhood. Mr. Cutler said there were a few inquiries, but no one had stated concerns. Vivian Vos, Resident 6920 W 4711 Place, Wheat Ridge Ms. Vos asked a few questions including how "sign A" will be restored; if Davies Chuckwagon the bowling alley are still expected to be tenants; if there any application fees owed similar to the payments required for a variance application; and she asked for clarity regarding the dimensional depth of window/door signs. Selene Ruiz, Resident 11 Paramount Parkway, Wheat Ridge Ms. Ruiz asked if there will be any neon signage that will be bright at night; about safety of the area in the parking lots; and also if a traffic study has been done. Chair OHM asked staff to respond to the public comment: Mr. Olree explained they are in discussion with different sign vendors, but they want the rooftop sign ("sign A") to look like it does with parts being restored and cleaned up and the box material being changed out. Mr. Olree also mentioned that Davies Chuckwagon is a current tenant with a lease, but the lease could expire. He explained it is their desire to keep the form and shape of that sign, but the location might change a bit. Mr. Cutler added that if a tenant leaves the signage will remain, but text will be changeable. Mr. Cutler clarified that the relief or variances in this Master Sign Plan are approved by the Planning Commission which is different than a typical residential variance, but there are still application fees owed along with fees associated with any subsequent building permits. Mr. Cutler also explained the request regarding window signage being up to 2 feet away from the window instead of 12 inches. Planning Commission Minutes -3— June 3— June 4, 2020 Ms. Mikulak explained that the tenant will have to apply the City's illumination standards required for lighting if they are proposing changeable copy signs. Ms. Mikulak also explained that with reinvestment on this property and with more activity around the site the safety should increase. She also mentioned that with no change in use, there is no current reason to have required a traffic study. Commissioner LARSON agrees that this is an iconic site and is excited for the applicant to move forward and would like to know the applicant's timeline and a place to learn more. Mr. Radcliffe mentioned that email updates can be received by registering at www.�:oldsmarketplace.com. He also mentioned the civil permits will be started around the end of June, beginning of July. Commissioner OHM added he is also excited about this project moving forward and thanked the developers. It was moved by Commissioner LARSON and seconded by Commissioner DISNEY to approve Case No. WSP-20-04, a request for approval of a master sign plan on property zoned Commercial -One (C-1) located at 10019 West 261 Avenue and 2625 Kipling Street, for the following reasons: 1. The site is eligible for a master sign plan. 2. The master sign plan promotes well-planned and well-designed signage. 3. The master sign plan is consistent with the intent of the sign code and is appropriate for the context of the development. With the following conditions: 1. The applicant will obtain building permits prior to installation of the approved signs. 2. The applicant shall provide a copy of the agreement with Denver Water allowing signage within the easement along Kipling Street. Motion approved 7-0. 8. OLD BUSINESS 9. NEW BUSINESS • Ms. Mikulak mentioned that Commissioner PETERSON will be moving to California so there is now a vacancy in District I. I. REQUEST Case No. W SP -20-04 is an application by Design Edge requesting approval of a master sign plan for the Gold's Marketplace shopping center. A site plan (Case No. WSP-20-01) was recently approved for the shopping center which includes streetscape improvements, parking lot reconfiguration, landscaping, and building fagade upgrades. Section 26-708.D of the City Code establishes the procedure for master sign plan approval by the Planning Commission: D. Master sign plan. The planning commission may approve a master sign plan for any existing or proposed commercial, mixed use, or industrial development of at least two (2) acres or more in size which is under unified control either by ownership, legal association or leasehold. 2. The intent and purpose is to encourage well-planned and designed signage within a large multiple building or multiple use complex which expresses unification and integration by elements of architectural style, size, color, placement and lighting while at the same time allowing for reasonable individual business identification. An additional purpose is to encourage the elimination of existing nonconforming signs. The planning commission may grant as a bonus for well-designed plans additional signs and/or up to a fifty (50) percent increase in maximum square footage for each sign, and/or may permit signs in locations other than normally permitted, based upon a finding that the proposed master sign plan substantially meets the intent and purpose of this subsection relating to unification and integration of signage. Once approved at a public hearing by planning commission, all master sign plans shall be recorded with the Jefferson County Recorder's Office and shall constitute a covenant and must be complied with by all owners, proprietors, lessees or assigns, whether current or future. No substantial variation from the plan shall be permitted without planning commission approval. Noticing requirements for a master sign plan process shall follow the procedures outlined in section 26-109. The City has only a few properties with master sign plans, including the Lutheran Hospital campus, Kipling Ridge (at 38"'/Kipling), the Corners at Wheat Ridge (at 38u'/Wadsworth), and Applewood Village Shopping Center. Master sign plans are appropriate on these types of developments where multiple buildings or uses comprise a single cohesive development. The City's sign code works well for single buildings on single lots, but a master sign plan better serves these larger developments, including shopping centers with multiple street frontages. Per City Code, the development is eligible for a master sign plan because it is over two acres in size, is under unified control, and includes commercial development. Planning Commission Case No. WSP-20-04 /Gold's Marketplace Master Sign Plan IL EXISTING CONDITIONS The subject property is located on at the northwest corner of W. 26a' Avenue and Kipling Street (Exhibit 1, Aerial). The site is zoned Commercial -One (C-1) and is located in the Traditional Overlay Area (Exhibit 2, Zoning Map). The site consists of one property that is bounded by four public streets: Kipling Street on the east, W. 26h' Avenue on the south, Paramount Parkway on the west, with a small appendage reaching W. 271h Avenue on the north. The shopping center was built in 1959, ten years prior to the City's incorporation. Given its age and approvals granted under previous zoning designations, much of the development does not meet current City standards, including for signage. The building is partially occupied by tenants, but a large portion of the building is vacant. The property was recently acquired by new ownership, and they have site plan approval for significant exterior upgrades, have obtained approval for urban renewal funds, are proposing this master sign plan, and will sign leases for tenants after renovations are complete. The building has existing wall signage that is generally compliant with City Code, but not uniform in design. There are three freestanding signs, two on W. 261' Avenue and one on Kipling Street that are noncompliant both in design and for setbacks. The Davies' Chuck Wagon freestanding sign, in front of the western portion of the building along 26h' Avenue, is included in that count. Additionally, there is a large roof sign on the southeastern corner of the building that was likely part of the original shopping center, though records are unclear. Photos of these signs are in Exhibit 5, Site Photos. III. CASE ANALYSIS The proposed master sign plan is comprised of 4 sheets (Exhibit 3, Master Sign Plan). • Page 1 contains signature blocks required for recordation, a vicinity map, and a brief explanation of the purpose of the document. Signage for the site is expected to comply with the standards in Article VII of Chapter 26 (the "sign code") except as modified by the master sign plan. This page also includes the proposed signage standards for freestanding signs, wall signs, leasing signs, window/door signs, and roof signs. • Page 2 includes a site plan for the entire property and the proposed signs, and elevations for the freestanding and roof signs. • Pages 3 and 4 show the elevations of the building with signage locations. The standards proposed in the master sign plan are summarized below in the order they appear on Page 1. For each type of sign, the provided analysis compares the standards proposed in the master sign plan with the standards in the City's sign code. All other signage proposed on the property will comply with the City's sign code. The applicant's letter of request is provided in Exhibit 4, Applicant Request. Freestanding Signs • Allowed per Code: Up to two (2) freestanding signs are permitted per development, with a maximum size of 400 square feet. Setbacks are based on height and found in the chart at right. Planning Commission Case No. WSP-20-04 /Gold's Marketplace Master Sign Plan Sign Height Required Setback Under 7 feet 5 feet 7-15 feet 10 feet Over 15 feet 30 feet Proposed by Applicant: The master sign plan proposes three (3) freestanding signs for the development. o Preservation of the existing Davies' Chuck Wagon sign, with a maximum size of 200 square feet and height of 25 feet (copy permitted to change, sign to shift north) o New freestanding multi -tenant sign on Kipling Street (to replace existing): maximum size 200 square feet, maximum height 16 feet o New freestanding multi -tenant sign on W. 26th Avenue (to replace existing): maximum size 200 square feet, maximum height 15 feet Elevations of these proposed signs are on Page 2 of the Master Sign Plan. Setbacks are required to be 7 feet from the right-of-way if the sign is 7-16 feet in height, and 25 feet for signs over 16 feet in height. The new signs are proposed to match, with painted masonry or metal bases. Findings: The code limitation of two freestanding signs for each development can be limiting for larger shopping centers, or developments with multiple street frontages. This property directly abuts four public streets and is over 700 feet wide, which is a large city block. The proposed maximum sign sizes are well under the 400 square foot maximum designated by City Code, and the proposed heights of the new signs (15 and 16 feet) are not unreasonable given the size and scale of the development. Staff is supportive of the preservation of the Davies' sign, even if the copy will change, because of the character it adds to the frontage, and because it is not intended to be converted into additional multi -tenant signage. The new signs will replace outdated signage in poor condition. The reduced setbacks allow the site's parking lot improvements to flow without interruption from signage and will allow the new freestanding signs to be located in landscaped areas. Sight triangle is not of concern. The signs proposed are a modest height particularly when compared to signage across the street to the south in Lakewood. Wall or Painted Signs • Allowed per Code: Wall signs are allowed on building fagades that are adjacent to a public street or major interior drive. Size is limited to 1 -square foot for every linear foot of the fagade to which the sign is affixed (a 1:1 ratio). Signs are allowed to project up to 15 inches beyond the building wall; signs on marquees, canopies, or awnings are considered wall signs. Wall signs are permitted on frontages facing public streets or major interior drives. • Proposed by Applicant: The master sign plan proposes an increased allowance of 1.5 square feet for every linear foot of the fagade (1.5:1 ratio), and will also be allowed to face parking lots not on major interior drives, such as on the north facade. All copy shall be channel letters except in areas designated as wall art locations. Tenants are granted one sign per frontage, and only on the side of the building where their entrance is located. Letter size is limited on portions of the building for consistency and so that larger tenant spaces cannot have oversized signs. Lastly, three wall signs are proposed to act as directional "up -down" signs to identify stairwells for building access, and are limited to 30 square feet. Findings: Staff finds that while the size allowance is larger than City Code, the other restrictions put in place the requirement for channel letters and maximum letter size result in a more cohesive development with minimal overall impact. The additional directional signs will help customers navigate the site and access stairs and parking areas. Planning Commission Case No. WSP-20-04 /Gold's Marketplace Master Sign Plan Leasing Signs • Allowed per Code: City Code does not specifically define or regulate leasing signs, but a leasing sign would be considered a temporary sign subject to these regulations: Two (2) large yard signs are permitted per commercial development, with a maximum size of 32 square feet, minimum setback of 5 feet, and maximum height of 7 feet. Proposed by Applicant: The plan requests an increase to four allowed leasing signs, with a maximum height of 8 feet and a minimum setback of 3 feet. The signs would be allowed to be banners or wood, and the maximum size would be 32 square feet, both of which are in compliance with City Code. Window sign banners/decals depicting renderings for the project are also allowed on the south side storefront windows during construction. Findings: Staff finds that these changes are acceptable given the size of the property, number of frontages, and amount of empty tenant spaces that need to be advertised. Master sign plans may create new sign categories not otherwise found in the code, and this is an example of an acceptable category and one found on other master sign plans for commercial development in the City. Window/Door Signs • Allowed per Code: May not obstruct more than 25 percent of the door or window area, and must be affixed to, painted on, applied to, or hanging within 12 inches of the window. Proposed by Applicant: To plan proposes that window or door signs may be within 2 feet of the window (as opposed to 12 inches) and would otherwise comply with City Code. • Findings: Staff has no concern with this request and its impacts would be minimal. Roof Signs • Allowed per Code: Not permitted. Proposed by Applicant: The master sign plan will preserve the existing roof sign that was approved/constructed under different standards. It is intended to identify the shopping center property as a whole and will not be tenant signage. The size and height may not increase. Findings: Staff does not have concerns with preserving the existing roof sign. While new roof signs are not permitted by City Code, this plan will preserve the roof sign that has become a noticeable identifier of the property and an iconic sign at the entrance of the City. Keeping the sign in place will preserve the identity of the shopping center even after the significant renovations and site changes are made. The sign is set back significantly from the street and neighboring properties, limiting its impact. As noted above, the site will comply with the signage standards in the City Code except as modified by the master sign plan. Ultimately, the master sign plan is cohesive and modestly -sized compared to the overall scale of the development. The preservation of the existing Davies' sign and the roof sign add to the character of the development and provide unique features dating back to the mid-century Modern era of the shopping center's construction. Planning Commission Case No. WSP-20-04 /Gold's Marketplace Master Sign Plan IV. STAFF CONCLUSIONS AND RECOMMENDATION Staff concludes that the subject property is eligible for a master sign plan and that the proposed plan promotes well-planned and well-designed signage. Staff further finds that the sign plan is reasonable in its requests and is consistent with the intent of the sign code. For these reasons, staff recommends approval of the site plan. V. SUGGESTED MOTIONS Option A: "I move to APPROVE Case No. W SP -20-04, a request for approval of a master sign plan on property zoned Commercial -One (C-1) located at 10019 W. 26u' Avenue and 2625 Kipling Street, for the following reasons: 1. The site is eligible for a master sign plan. 2. The master sign plan promotes well-planned and well-designed signage. 3. The master sign plan is consistent with the intent of the sign code and is appropriate for the context of the development. With the following conditions: 1. The applicant will obtain building permits prior to installation of the approved signs. 2. The applicant shall provide a copy of the agreement with Denver Water allowing signage within the easement along Kipling Street. Comment Responses: Please use the provided Word file of this letter to respond to the subsequent comments and provide it as part of the second submittal. 2. Provide color elevations of the proposed freestanding signs at time of next submittal. This will be a useful exhibit for the Planning Commission hearing. 3. Roof/animated sign: Roof and animated signs are prohibited by City Code. The existing roof sign on the property is considered nonconforming for these reasons, and per Code should have been removed 60 days after Gold's Grocery closed. The sign has not been animated for decades. As discussed in the pre -application meeting, the City is not supportive of an animated sign at this location but is willing to support the preservation of the roof sign as a project ID sign. Staff will not be able to prove support for the animated sign at Planning Commission, and request that those provisions be removed from the MSP. The comments provided in this letter reflect this request. 4. Wall art: The placeholders for potential future wall art are acceptable. Per Code, the art may not advertise or promote a particular business, service, or "branded" product. Permits are not required for wall art but designs must be submitted to the Planning Division for review to determine if the design is an artistic mural or a sign; if it is determined to be a sign, it will count towards the overall wall sign square footage for that tenant and permits will be required. The proposed maximum areas for the signs are significantly larger than the areas shown on the elevations sheet (what is shown is roughly 150 sf per face, even less for the existing sign). Confirm that 3 signs are needed (one on north, one on south, and one on interior west). Add a maximum square footage based on proposed size (appears to be 15-20 sf). c. Remove Blade Signs since they will follow City Code. d. Change Nonconforming Sign to Roof Sign. This is for consistency and clarity. i. Add this definition: "A sign erected, constructed, and maintained above the eaves and attached to the roof of the building." ii. Remove "spinning" from requirement #1. iii. Add maximum number of one. This shall replace requirement #2 which must be removed. iv. Add an item #5: "Sign area and height may not increase from existing conditions." e. Remove Animated Signs. Sheet 2 — Site Plan 7. The future City monument sign may block visibility of the lower portions of the proposed freestanding sign in the southeast corner. No action required but worth considering moving the sign north of the ped crossing, which would require the removal of one parking space. 8. The way the Davies' sign overhangs to the south would likely have it overhang into the proposed drive based on the location of the base as shown on the plan. Show the outline of the sign overhang with the base in bolder linework so we can confirm the sign does not affect the path of travel on the drive aisle. The base may need to be moved north a few feet. 9. Remove the note for the roof sign regarding rotation. Sheet 3 — Elevations 10. I assume the directional signs (tenant wayfinding) identified by #5 will comply with City Code (4 sf per side) since they were not in the Sign Standards section. If not, you will need to propose a revised definition in Sign Standards. I recommend following City Code for these signs and not proposing a larger allowance. 11. Remove "animated" from note 7. Sheet 4 — Elevations 12. Regarding the 2625 sign, that was/is a valid address for the former Paramount Bowl. However, if you wish to change addresses for the rest of the shopping center, we can review address changes at this time, prior to building permit submittals. You will need to provide floorplans that show all existing suites, identify the addresses you wish to change or retain, and confirm the owner has notified tenants of their desire to change the addresses, especially if 2625 Kipling is the desired address for the entire center (the majority of tenants are currently addressed on 26' Ave). 13.
