CASE NO: WA-98-15 APPLICANT'S NAME: George Feeney LOCATION: 3869 Union Court, Wheat Ridge Upon a motion by Board Member ABBOTT, seconded by Board Member HOVLAND, the following resolution was stated: WHEREAS, the applicant was denied permission by an administrative officer; and WHEREAS, Board of Adjustment application Case No. WA-98-15 is an appeal to this Board from the decision of an administrative officer; and WHEREAS, the property has been posted the required fifteen days by law and there were no protests registered against it; and WHEREAS, the relief applied for may not be granted without detriment to the public welfare and without substantially impairing the intent and purpose of the regulations governing the City of Wheat Ridge. NOW, THEREFORE, BE IT RESOLVED that Board of Adjustment Application Case No. WA-98-15 be, and hereby is, DENIED. TYPE OF VARIANCE: Request for approval of a 9% building coverage to the 25% maximum building coverage requirement for the purpose of building a single family home. FOR THE FOLLOWING REASONS: 1. This request for 1,141 square foot variance would seem unreasonable given the described hardships and/or circumstances i.e., errors by design professionals. A 3,176 square foot structure may be completed without need for a variance. Approval of this request does not comply with the intent and purpose of the Residential-One Zone District and the low density residential character. Resolution WA-98-15/Feeney Page I 4.
