EXECUTIVE SUMMARY:
The Urban Renewal Authority has structured its development agreement with Cornerstone to include
the utilization of tax increment financing. Both property and sales tax increments are proposed for the
project area.
The Planning Commission on October 2, 2003 adopted a resolution finding the use of tax increment
financing in conformance with the Comprehensive Plan.
COMMISSION/BOARD RECOMMENDATION:
The Urban Renewal Authority has structured its development agreement with Cornerstone to include
the utilization of tax increment financing.

financing in conformance with the Comprehensive Plan.
STATEMENT OF THE ISSUES:
The use of tax increment financing is typical in an urban renewal project because of the typically
higher costs involved in a redevelopment project. Tax increment financing enables the Authority to
participate in the redevelopment project by absorbing some of the costs of development. Tax
increment financing by an urban renewal authority is authorized under the State Urban Renewal Law.
Under tax increment financing, all taxes currently collected by taxing entities are "frozen." The Urban
Renewal Authority receives the increased taxes above this "frozen" amount to pay the debt obligations
associated with the project. All taxing entities still receive the amount of taxes they currently receive.
The State Urban Renewal Law authorizes the collection of tax increments for up to 25 years. In order
for the Authority to collect the increments, it must have debt or other obligations to be paid which
require the revenue. The collection of the tax increments for this specific project is estimated to
require five to ten years.
ALTERNATIVES CONSIDERED:

FINANCIAL IMPACT:
The City will still receive property taxes in the amount of approximately $600 from properties in the
project area. Sales tax revenue of approximately $4,000 will still accrue to the City. Once the
Authority has paid its debt and other obligations, total sales and property tax generated by the
redevelopment will result in a conservatively estimated $75,000 in additional revenue to the City, not
including inflation,

FIRST AMENDNENT TO THE 38' CORREDOR
REDEVELOPNENT PLAN
The 38' Avenue Corridor Redevelopment Plan ("Plan") is amended
by adding Section-, 5.1 c., d. and e.
c. Utilization of Property and Sales TIP.
Consistent with the foregoing provisions of this Section 5.0
regarding W, there is hereby adopted the utilization of property and
sales tax increment for the proper within the Project Area (which
is within the Redevelopment Area), and is legally described on
Appendix A hereto.
d. No Application.
The provisions of paragraph 5.1 (a)(v) shall not apply to the
utilization of TI for this Project Area.
e. Consistent Interpretation.
All other provisions of this Plan, not specifically
amended hereby, shall be interpreted so as to be consistent 'Arith the
purpose of this amendment to effect the utilization of TIF in the
Project Area described on Appendix A.

the 3 W" Avenue Corridor Redevelopment Plan for its compliance with the Wheat Ridge
Comprehensive Plan.
It has been found by the Wheat Ridge Planning Commission that the proposed
modification is in conformance with the Wheat Ridge Comprehensive Plan.
This Resolution shall be transmitted to the Wheat Ridge City Council pursuant to the
requirements of the Urban Renewal Law,

WHEREAS, the Urban Renewal Authority has solicited development proposals for and
has selected a developer to undertake a redevelopment project on the parcel of land depicted on
Exhibit I hereto; and
WHEREAS, the Disposition and Development Agreement entered into between the
developer and the Urban Renewal Authority authorizes the use of sales and property tax
incremental revenues to finance the public costs related to the redevelopment project; and
WHEREAS, the Urban Renewal Authority has recommended to City Council that the
Urban Renewal Plan be modified to implement sales and property tax increment for the project
area as depicted on Exhibit 1; and
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Wheat
Ridge, Colorado, as follows:
Section 1. The modification to the Urban Renewal Plan implementing the utilization
tax increment financing in the project area depicted in Exhibit I hereto is hereby approved.

Another piece of the financing puzzle for 38"' and Sheridan concerns the sales and
property tax increments. They are currently authorized in the Plan, but no start date has
been established. The plan needs to be amended to for this to occur.
The policy question for the Board to decide is whether the tax increment should be
started for the entire 38 Avenue Corridor, or for just the Walgreens project area. If it is
just the Walgreens project area, any additional projects along the corridor requiring a tax
increment will trigger another amendment to the Plan.
Amendment of the Plan requires adoption of a resolution by the Authority Board, review
by the Planning Commission for conformance with the Comprehensive Plan, and
adoption by City Council.
Enacting the TIF for the entire corridor has the advantage of doing the amendment once
and being done. The disadvantage is that the 25 year limit on the TIF is started and if
another urban renewal project doesn't happen for 10 years, 10 years of TIF collections
are essentially wasted. This is what happened in the Town Center area.
The option of enacting the TIF for just the Walgreens project avoids the potential
"mistake" of triggering the TIF prematurely for other projects, but the disadvantage is
that each subsequent project for which TIF is needed wilt require approval of a plan
amendment by City Council. It is difficult to predict future Council support for urban
renewal activities.
The amendment will need to be presented to the Authority in August for adoption. Staff
needs direction on which TIF option the Board recommends.

terized by a pedestrian-scaled environment, and superior urban design and streetscape, in a
mixed-use development pattern with transitional residential development.

3.4 Corridor Redevelopment Plan Objectives
The stated objectives of this Corridor Redevelopment Plan are as follows:
4.0 Redevelopment Activities
Public projects are intended to stimulate private sector development in and around the
Redevelopment Area. The combination of public and private investment will assist in
implementing redevelopment activities consistent with the objectives of this Corridor
Redevelopment Plan for the Redevelopment Area, and contribute to increased property and
sales taxes for the City.

In undertaking all urban renewal projects pursuant to this Corridor Redevelopment Plan, the
Authority may utilize any the following redevelopment techniques and activities, as deemed
appropriate for the elimination or prevention of blighted areas within the Redevelopment
Area, pursuant to the Urban Renewal Law:
A. Demolition
The Authority may provide for the demolition and clearance of buildings, structures and
other improvements in the Redevelopment Area,
B. Public Improvements
The Authority may cause, finance, orfacilitate the design, installation, construction and
reconstruction of any public improvements in the Redevelopment Area.

D. Redevelopment and Rehabilitation
Appropriate activities may include such undertakings and activities authorized by the Urban
Renewal Law or this Corridor Redevelopment Plan, including those redevelopment tech-
niques identified in this section determined to be necessary or desirable.
The Authority shall prepare and implement relocation plans or policies before any business,
family, tenant or individual is relocated. Such plans or policies shall include but will not
limited to the following provisions:
i. Methods for temporary relocations;
ii. Relocation to areas not generally less desirable with regard to public utilities
and public and commercial facilities; at rents or prices within the financial
means of such persons and families; into equally decent and sanitary dwellings
as available to such persons; and in places reasonably accessible to their
employment;
iii. A reasonable relocation payment (as determined by the Authority) for moving
expenses and actual loss of property directly related to relocation;
iv, For businesses, to provide for losses of goodwill and profits which are reason-
ably and directly related to relocation for which compensation is not otherwise
provided.
F. Other Techniques
Other redevelopment activities conternplated by this Corridor Redevelopment Plan may
include changes to applicable zoning, land use and building code requirements.
5.0 Pr , % W*- ) ect Financing
Urban renewal projects may be financed in whole or in part by the Authority under the tax
increment financing (TI) provisions of CRS §31-25-107(9)(a), of the Urban Renewal Law,
or by any other available source of financing authorized to be undertaken by the Authority
tinder CRS §31-25-105.of the Urban Renewal Law

in carrying out this Corridor Redevelopment Plan in the manner contemplated by the Urban
Renewal Law. Any principal and interest on such indebtedness may be paid from property
and sales tax increments, or any other funds, revenues, assets or properties legally available to
the Authority.
5.2 Potential Utilization of Tax Increment Financing (TIF)
The general land use concept envisioned by this Corridor Redevelopment Plan for the
Redevelopment Area is subject to further refinement and revision as future plans and/or
projects are proposed for specific properties within the Redevelopment Area, Such refine-
ments and revisions to the general land use concept of this Plan shall be adopted by the

The general land use concept envisioned by this Plan is to enhance the existing neighbor-
hood and community-oriented retail and service uses that are currently located along 38"
Avenue, while maintaining residential housing as an important component of the corridor's
mixed-use development pattern.
Many of the properties along 38"' Avenue present significant opportunities for improving the
image and function of existing and future activities and businesses within the Redevelopment
Area, Initial efforts for development and redevelopment will likely be focused near
Wadsworth Boulevard and Sheridan Boulevard, in the vicinities of the community commer-
cial centers (Safeway and King Soopers) that anchor each end of the Redevelopment Area.
Over titne, it is anticipated that many of the existing auto-oriented uses, such as car repair
and sales facilities, will decrease as the pedestrian-oriented environment is enhanced. Other
opportunities that might contribute positively to the Redevelopment Area include civic uses,
such as a library, post office, recreation center, or transportation facilities.
For the purposes of presenting the recommendations of this Corridor Redevelopment Plan,
the Redevelopment Area has been divided into three distinct subareas along 38"' Avenue.
Each subarea is described by certain common characteristics, followed by a summary of
potential redevelopment activities that are intended to support the objectives of this Plan.

Subarea Two contains a larger number of auto-oriented businesses as well as a significant
amount of residential housing of varied density and quality. It also includes a number of
single-family residential structures that have been converted to commercial uses.
Potential development opportunities should encourage the retention and upgrading of the
existing housing stock, and promote redevelopment and building improvements for addi-
tional neighborhood and regional-serving businesses.
The King Soopers Shopping Center located at the northwest corner of Sheridan Boulevard
and 38th Avenue anchors this end of corridor. It establishes a gateway and design character
for the eastern edge of the Redevelopment Area, and generates a significant amount of
activity that could benefit existing and future businesses along this portion of 38" Avenue if
the area was more pedestrian friendly. The businesses and uses within this area are less
pedestriati-oriented than those found in Subarea One, which creates unsafe pedestrian
movement due to numerous points of uncontrolled vehicular access along 38" Avenue. The
City is currently undertaking plans to improve the image and appearance of this area through
a comprehensive streetscape improvement program. This program will improve the Redevel-
opment Area's image, and increase pedestrian safety with more controlled and concentrated
vehicle access points along 38 Avenue.
Development opportunities should build on the existing strengths of this subarea by encour-
aging redevelopment and building improvements for additional neighborhood and regional-
serving businesses. Over time, as improvements occur, it may be appropriate for the auto-
oriented businesses to relocate, allowing opportunities for businesses and uses that foster
more pedestrian activity.

7.0 Land Use Plan
Land use within the Redevelopment Area shall conform to those uses (by right or otherwise)
permitted by the City's adopted comprehensive plan, zoning code, and other applicable
ordinances and regulations.
The approved Corridor Redevelopment Plan may be modified pursuant to requirements and
procedures set forth in CRS §31-25-107 of the Urban Renewal Law governing such modifi-
cations.
9.0 Reasonable Variations
In specific cases, where a literal enforcement of the provisions of this Corridor Redevelop-
ment Plan constitute an unreasonable limitation beyond the intent and purpose of the Plan
(as determined by the Authority), the Authority may allow reasonable variances from these
provisions.

3.3 Boundaries of this Corridor Redevelopment Plan
The boundary of the area to which this Corridor Redevelopment Plan applies is generally
described as the properties along 3 81h Avenue, from Wadsworth Boulevard on the west to

3.4 Corridor Redevelopment Plan Objectives
The stated objectives of this Corridor Redevelopment Plan are as follows:
• Strengthen the identity of 38"' Avenue as the City's "Main Street", defined as
being the center of cultural, entertainment and economic activity, accessible by
vehicle, transit and pedestrian, and identified by the inclusion of certain urban
design elements.
• To promote a mixed-use development pattern designed to service the surrounding
neighborhoods and community, to include a balanced mix of residential, retail and
service businesses.
• To improve pedestrian and vehicular circulation and safety.
• To minimize pedestrian and vehicular conflicts.
4.0 REDEVELOPMENT TECHNIQUES
Public projects are intended to stimulate private sector development in and around the
Redevelopment Area, The combination of public and private investment will assist in the
redevelopment of the Redevelopment Area, consistent with the objectives of this Corridor
Redevelopment Plan, and contribute to increased property and sales taxes for the City.

4.1 Redevelopment Techniques
In undertakin all urban renewal

deemed appropriate for the elimination or prevention of blighted areas within the
Redevelopment Area, pursuant to the Colorado Urban Renewal Law:
a. Demolition. The Authority may provide for the demolition and clearance of
buildings, structures and other improvements in the Redevelopment Area.
b. Public Improvements, The Authority may cause, or finance, or facilitate the
design, installation, construction and reconstruction of any public improvements in
the Redevelopment Area.
d. Redevelopment and Rehabilitation. Appropriate activities may include such
undertakings and activities authorized by the Colorado Urban Renewal Law or this
Corridor Redevelopment Plan, including those redevelopment techniques
identified in this section determined to be necessary or desirable.
a. Methods for temporary relocations;
b. Relocation to areas not generally less desirable with regard to public utilities
and public and commercial facilities at rents or prices within the financial
means of such persons and families; into equally decent and sanitary dwellings
as available to such persons; and ill places reasonably accessible to their
employment;
c. A reasonable relocation payment (as determined by the Authority) for moving
expenses and actual losses of property directly related to relocation;

Urban renewal prqjects may be financed in whole or in part by the Authority under the tax
increment financing (TI F) provisions of CRS §31-25-107(9)(a), of the Colorado Urban
Renewal Law, or by any other available source of financing authorized to be undertaken by

RESOLUTION NO. 25-2001
TITLE: A RESOLUTION APPROVING THE 38 1H AVENUE
CORRIDOR REDEVELOPMENT PLAN
WHERE AS, with the adoption of Resolution No. 12-2001 on April 23, 2001, the
City Council determined that blight existed in the vicinity of the 38` Avenue Corridor
between Sheridan Boulevard and Wadsworth Boulevard; and
WHEREAS, such resolution created the 38"' Avenue Corridor Redevelopment
Area (Area), an urban renewal area within the City; and
WHEREAS. Resolution No. 12-2001 also directed the Wheat Ridge Urban
Renewal Authority (Authority) to effect the preparation of an urban renewal
(redevelopment) plan (Plan) for the Area for consideration by City Council; and
WHEREAS. the Council has been presented with a proposed Plan; and
WHEREAS, the Authority has endorsed and recommended approval of the Plan
by Council; and
WHEREAS, the City Planning Commission has submitted its written
recommendation to the City Council that the Plan is in conformance with the Wheat
Ridge Comprehensive Plan; and
WHEREAS, a copy of the Plan and information regarding the impact of the Plan
were submitted to the Jefferson County Board of Commissioners; and
WHEREAS, the Jefferson County School District also received a copy of the Plan
and has been advised and permitted to participate in an advisory capacity with respect to
the potential use of tax increment financing; and
WHEREAS, notices of the public hearing for consideration and approval of the
Plan by City Council were provided by publication and by written notices to property
owners. residents and business owners in the Area in compliance with the Urban Renewal
Law, C.R.S. ' ) 1-25-101 feLtseq., and
WHEREAS, a public hearing on the Plan was held on October 22, 2001,
providing a full opportunity for property owners, residents, taxpayers, people and
business owners in the Area and all interested persons to be heard and
WHEREAS, the inclusion of certain areas and properties designated in the Plan
within the Area would provide for the elimination and prevention of blight and the
WHEREAS, the City Council has determined that it is in the best interests of the
City of Wheat Ridge and the Wheat Ridge Urban Renewal Authority to adopt the Plan as
proposed.
NOW THEREFORE BE IT RESOLVED by the Wheat Ridge City Council as
follows:
Section 1, That the City Council hereby makes the following findings with
respect to the proposed Plan:
A, A feasible method exists for the relocation of families or
individuals who may or will be displaced by redevelopment projects in decent,
safe and sanitary dwelling accommodations within their means and without undue
hardship.
B, A feasible method exists for the relocation of business concerns
that may or will be displaced by redevelopment projects either in the Area or in
other areas that are not generally less desirable regarding public utilities and
public and commercial facilities,
C. The City Council has caused its staff to take reasonable efforts to
provide written notice of the public hearing to property owners. residents and
business owners in the Area at their last known addresses at least 30 days prior to
this public hearing of October 22, 2001.
D. ' Section 31-25-107 (4) (d) C.R.S. of the Urban Renewal Law does
not apply in that not more than 120 days have passed since the first public hearing
on this Plan, because this is the first public hearing.
E, Section 31-25-107 (4) (e) C.R.S. of the Urban Renewal Law does
not apply in that City Council did not fail to previously approve this Plan,
F. The Plan conforms to the City's Comprehensive Plan.

G, The provisions of the Plan, consistent with the needs of the City,
provide maximum opportunity for redevelopment of the Area by private
enterprise.
H. Section 31-25-107 (5) C.R.S. of the Urban Renewal Law is not
applicable to this Plan.
I City Council has determined that the boundaries of the Area have
been drawn as narrowly as feasible to accomplish the planning and development
objectives of the Plan in accordance with Section 31-25-107(1) C.R.S. of the
Urban Renewal Law.
Section 3. The Jefferson County School District was permitted to participate
in an advisory — capacity regarding this Plan.
Section 4. The Jefferson County Board of Commissioners was provided a
copy of the Plan and information regarding its impact. in compliance with the Urban
Renewal Law.
Section 5. The Wheat Ridge Urban Renewal Authority is authorized to
exercise the powers of eminent domain to carry out, effect and administer the Plan.
Section 6. The Proposed Plan accompanying this Resolution and incorporated
herein is adopted as the 38` Avenue Corridor Redevelopment Plan for the City of Wheat
Ridge and may be referred to as the 38' Avenue Redevelopment Plan. The Plan is an
urban renewal plan as defined in Section 31-25-103(9) C.R.S. of the Urban Renewal

Resolution 25-2001 was introduced by Mr. Mancinelli, who also read the title, summary and
background,
Planning Director, Alan White, introduced consultants Terry Ware, who prepared the 38"
Avenue and Wadsworth plans; his firm also prepared blight studies. Art Anderson prepared
the plan for the 44 & Ward area and he prepared the blight study for the 44" and Ward area.
Terry Ware, presented the findings and recommendations on the 38" Avenue Corridor
Redevelopment plan and referred to Mr. Windholz' memo of October 22, 2001, which
recommended revisions.
Marilyn Force, member of Urban Redevelopment Authority, stated that 38 1h Avenuejsan
enhancement plan, not to give new structure to the City; bonds are sold so that everybody can
invest in their community,

The consultant's artomev and NWRA's bond counsel have reviewed the proposed plans and
documents, conferred with me and provided suggested revisions to the Plans and Resolutions
The Planning Commission has also recommended revision to the 44 Avenue/Ward Road PI
to assure compliance with the Comprehensive Plan. Therefore, I recommend the following
revisions to the proposed Plans and Resolutions for your consideration: I
The Wadsworth Boulevard Corridor Redevelopment Plan
V L At the end of the first paragraph of Section 1.1. add the following sentence:
"The term "Redevelopment Area" shall have the same meaning as "urban renewal
area"in Section 3 ) 1-25-10. C.R.S. of the Urban Renewal Law,"

RE: Consideration of Redevelopment Plan
Notice is hereby given that a Public Hearing to consider adoption of a Redevelopment Plan will be
held before the City of Wheat Ridge CITY COUNCIL on Monday, October 22,2001, at 7:00 p.m.
in the City Council Chambers of the Municipal Building at 7500 W. 29th Avenue, Wheat Ridge,
Colorado.
The area included in the proposed plan is generally the 38th Avenue Corridor from Sheridan
Boulevard to Wadsworth Boulevard. The general scope of the urban renewal project under
consideration is to redevelop the area as the "main street" or downtown of the City as a mixed use
commercial area.
All interested parties are invited to attend the public hearing. Copies of the proposed plan are available
at the Planning Department, 7500 W. 29th Avenue, Wheat Ridge, Colorado.

WHEREAS, the Urban Renewal Law • Colorado (§31-25-101 et seq
C.R.S.) authorizes the analysis and consideration of factors within the City of Wheat Ridge to
determine if blight exists within certain areas of the City to utilize the provisions of the Urban

WHEREAS, such analysis has been undertaken to determine whether factors of blight
exist within the vicinity of the 38" Avenue Corridor between Sheridan Boulevard and
Wadsworth Boulevard, which study area is depicted on Exhibit I hereto (hereafter the "Study
Area"); and
WHEREAS, following requests for proposals and responses thereto, HNTB,
Corporation was chosen to conduct such blight analysis; and
WHEREAS, the Board of Cortunissioners of the Wheat Ridge Urban Renewal
Authority (the Authority) was presented with such analysis, and reviewed and considered the
evidence and factors of blight presented to it at its public meeting on April 17, 2001 by HNTB,
Corporation representatives; and
WHEREAS, based upon the blight analysis and information presented to it, the
Authority enacted Resolution No. 01-01 advising the City Council • its opinion of the
existence
• factors of blight in the Study Area recommending that City Council hold a public
hearing
• consider evidence and determine if such factors of blight exist in the Study Area; and
that if Council makes findings
• blight, that it establish an urban renewal area; and
WHEREAS, in compliance with §31-25-104 C.R.S. of the Urban Renewal Law, notice
of a public hearing was provided to hear evidence and determine if factors of blight existed in
the Study Area; and
WHEREAS, in accordance with §31-25-104 C.R.S. of the Urban Renewal Law, a
public hearing was held on April 23, 2001, at which public hearing a full opportunity to bo
heard was provided to all residents and taxpayers of the City of Wheat Ridge and all other
interested persons; and
WHEREAS, at such public hearing the City Council was presented evidence of the
existence of factors of blight within the Study Area.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Wheat
Ridge as follows:
A. Slum, Deteriorated or Deteriorating Structures. Of the properties
surveyed in the Study Area, nearly one-quarter ( had some form of secondary or
exterior deterioration, including finishes, windows, doors, soffits and fascia, loading
areas, mechanical equipment, fences, walls and gates.
Except for the residential properties in the entire Study Area and the
new development at 38"' Avenue and Sheridan Boulevard, all properties have some
forms of deteriorated site conditions.

C. Faulty Lot Layout In Relation To Size, Adequacy, Accessibility
or Usefulness. Many of the lots are outdated because of age, are narrow or shallow
and not adequate to provide safe and accessible parking or pedestrian access and
movements,
E. Deterioration of Site or Other Improvements. Nearly one-half
of the properties analyzed exhibited deterioration of the sites and improvements. Such
legal factors
• blight included parking surface deterioration (in some cases severe
deterioration of parking lots), significant lack of landscaping, unscreened junk, trash
and trash containers and unscreened mechanical equipment in/on commercial facilities,

clearly delineated as sidewalks. Most of the properties have unsightly and heavy
overhead utilities throughout the Study Area. There is a lack of adequate provisions for
the disabled.
Section 2. The City Council finds that the 38' Avenue Corridor from Sheridan
Boulevard to Wadsworth Boulevard, in its present condition and use and by reason of the
presence of the foregoing factors of blight, substantially impairs the sound growth of the City of
Wheat Ridge, constitutes an economic or social liability and is a menace to the public health,
safety and welfare of the community.
Section 3. An urban renewal area within the City of Wheat Ridge in the general

evidence related thereto is hereby accepted by the Board of Commissioners.
Section 2. Consistent with §31-25-103(2) C.R.S, of the Urban Renewal
Law, the Board of Commissioners hereby finds that the following six factors of blight
exist in the 38" Avenue Corridor Study Area:

D, Unsanitary or unsafe conditions; and
Section 3. The Board of Commissioners finds that the 38' Ave. Corridor

foregoing six factors of blight, substantially impairs the sound growth of Wheat Ridge,

Section 4. The Board of Commissioners respectfully recommends to the

B. That if the data and evidence at the public hearing is sufficient to
comply with the Urban Renewal Law, it make findings of the existence of

C. Based upon such blight factors, it establish an urban renewal area
in the general vicinity of the 38 Avenue Corridor between Sheridan Boulevard
and Wadsworth Boulevard, as it deems appropriate; and
D. If it makes such findings of blight and establishes the urb
renewal area, that it authorize the procedures for commencement of the
preparation and consideration of an urban renewal plan for the area. I

SUMMARY AND BACKGROUND: City Council, upon recommendation of the Urban Renewal
Authority, approved the hiring of the consulting firm of HNTB to perform an evaluation of the physical
conditions of sites and structures along 38 Avenue from Sheridan to Wadsworth. Their analysis is contained in
the attached Blight Study.
HNTB concluded that there was sufficient evidence of factors of blight along the corridor. The Blight Study
was presented to the Urban Renewal Authority on April 17, 2001 and the Authority adopted Resolution 01-01
finding the existence of factors of blight and forwarding this recommendation to City Council. The Authority
recommended addin g three parcels and deleting two parcels to the recommended renewal area. These are
shown on Exhibit I to the resolution.

WHEREAS, such analysis has been undertaken to determine whether factors of blight
exist within the vicinity of the 38 Avenue Corridor between Sheridan Boulevard and
Wadsworth Boulevard, which study area is depicted on Exhibit I hereto (hereafter the "Study
Area"); and
WHEREAS, following requests for proposals and responses thereto, HNTB,
Corporation was chosen
• conduct such blight analysis; and
WHEREAS. the Board of Commissioners of the Wheat Ridge Urban Renewal
Authority (the Authority) was presented with such analysis, and reviewed and considered the
evidence and factors of blight presented to it at its public meeting on April 17, 2001 by HNT
Corporation representatives, and
I WHEREAS, based'upon the blight analysis and information presented to it. the
Authority enacted Resolution No. 01-01 advising the City Council of its opinion of the
existence of factors of blight in the Study Area recommending that City Council hold a public
hearing to consider evidence and determine i f such factors of blight exist in the Study Area: and
that if Council makes findings of blight, that it establish an urban renewal area� and
WHEREAS. in compliance with §31-25-104 C,R.S, of the Urban Renewal Law. notice
of a public hearing was provided to hear evidence and determine if factors of blight existed in
the Study Area, and
WHEREAS. in accordance with §31-25-104 C.R,S. of the Urban Renewal Law, a
public hearing was held on April 23, 2001, at which public hearing a full opportunity to be
heard was provided to all residents and taxpayers of the City of Wheat Ridge and all other
interested persons. and
WHEREAS, at such public hearing the City Council was presented evidence of the
existence of factors of blight within the Study Area.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Wheat
Ridge as follows:
A Slum, Deteriorated or Deteriorating Structures. Of properties
surveyed in the Study Area, nearly one-quarter (V4) had some form of secondary or
exterior deterioration, including finishes, windows, doors, soffits and fascia, loading
areas, mechanical equipment, fences, walls and gates.
Except for the residential properties in the entire Study Area and the
new development at 38' Avenue and Sheridan Boulevard, all properties have some
forms of deteriorated site conditions.
C. Faulty Lot Layout In Relation To Size, Adequacy, Accessibility
or Usefulness. Many of the lots are outdated because of age, are narrow or shallow
and not adequate to provide safe and accessible parking or pedestrian access and
movements.
E. Deterioration of Site or Other Improvements. Nearly one-half (50%)
of the properties analyzed exhibited deterioration of the sites and improvements. Such
legal factors of blight included parking surface deterioration (in some cases severe
deterioration of parking lots), significant lack of landscaping, unscreened junk, trash
and trash containers and unscreened mechanical equipment in/on commercial facilities.

Section 2. Consistent with §31-25-103(2) C.R.S. of the Urban Renewal
Law, the Board of Commissioners hereby finds that the following six factors of blight
exist in the 38" Avenue Corridor Study Area-

B. Defective or inadequate street layout; and
C. Faulty lot layout in relation to size, adequacy, accessibility or

Section 4. The Board • Commissioners respectfully recommends to the
Wheat Ridge City Council the following:
A. That, in compliance with the Urban Renewal Law, it give notic
of and hold a public hearing regarding consideration of blight factors in the 3
Avenue Corridor Study Area; and I
B. That if the data and evidence at the public hearing is sufficient J
comply with the Urban Renewal Law, it make findings of the existence of
factors of blight; and
C, Based upon such blight factors, it establish an urban renewal area
in the general vicinity of the 38' Avenue Corridor between Sheridan Boulevard
and Wadsworth Boulevard, as it deems appropriate; and
D. If it makes such findings of blight and establishes the urban
renewal area, that it authorize the procedures for commencement of the
preparation and consideration • an urban renewal plan for the area.

6. NEW BUSINESS
(Prior to this presentation, City Council Member Vance Edwards announced that,
upon the advice ofthe Urban Renewal attorney, he would leave the meeting
because of the conflict of hearing this matter before it is presented to City
Council. He left the meeting at 7:05 p.m.)
A. Presentation of Blie:ht Studies - (1) 38th Avenue between Sheridan
and Wadsworth and (2) Wadsworth Boulevard between 35th Avenue
and 44th Avenue.
Terry Ware reviewed the blight study that revealed a fmding offive
elements of blight. Each member of the Authority received a copy ofthe
study.
Marilynn Force expressed concern that many areas in the study area do not
meet ADA standards and questioned whether the City was at risk. Jim
Windholz responded that was a question for the City Attorney, but
commented that lack of ADA compliant facilities should be included in
the study.
B. Public Comment on Blie:ht Studies
Chair Matthews asked ifthere were any present who wished to comment or
ask questions regarding the blight study.
Unidentified man - Stated that he was glad the Authority only chose two
areas rather than the entire city. Chair Matthews explained that the purpose
of the study is not to identify "slum areas" but rather to identify significant
barriers to redevelopment.
Unidentified man - He then asked how the Wadsworth Corridor
improvements would affect the study area. Alan White explained that it is
not planned to widen the entire length of Wadsworth through the city but to
widen the street along major intersections which would leave more room
for redevelopment. Where there are plans for six lanes, the outside lane
would be local commercial access.
Unidentified man - He asked if the blight study is preliminary to
redevelopment. Alan White replied that the blight study and Wadsworth
corridor study would start coming together as the next step in the process.

Terry Ware recommended the following two amendments to the map:
(1) Two parcels located on the south side of Reed and Quay and
between Fenton and Depew are zoned R-3 and should be removed
from the urban renewal area.
(2). Those parcels between 41" and 3-Acre Lane which are presently
excluded from the urban renewal area should be included.
Chair Matthews asked the reason that property at 3830 High Court was not
included in the area. Alan White explained that the consultant was working
off a map supplied by staff and may have missed some commercial properties.
Jim Windholz advised that boundaries may be changed but it would require
modification of the plan.
It was moved by Elwyn Kiplinger and seconded by Margy Platter to
include the property at 3830 Higb Court in the urban renewal area. The
motion passed unanimously.
It was moved by Elwyn Kiplinger and seconded by Marilynn Force to
include the property at 3720 Pierce in the urban renewal area. The
motion passed unanimously.
It was moved by Sandra Collins and seconded by Marilynn Force to
include the Affiliated Carpet Store located at Kendall and 38th Avenue in
the urban renewal area. The motion passed unanimously.
Jim Windholz cited CRS 3125-103 (2) regarding findings of blight. He noted
that some findings of blight appear under more than one factor and he would
determine, after a thorough review of the study, that there are actually six
elements of blight. He explained that the law requires that, once a finding of
blight is made, the areas are to be defined as narrowly as possible and staff as
well as the consultant have been very cautious in making findings of blight.
Jim Windholz advised members that they are actually appointed as the Board
of Commissioners of the Urban Renewal Authority under the urban renewal
statutes.
In response to a question from Kandi McKay regarding whether or not all lots
are of sufficient size for redevelopment, Terry Ware replied that lot size would
be included in the next phase of the study.

Chair Matthews commented that as areas are redeveloped, adjacent areas
should increase in value.
Jim Windholz explained that the next step would be to send out requests for
proposals for a consultant to do the actual redevelopment plans.
C. Resolution 01-01
Resolution 01-01 was presented to the Authority for consideration and
recommendation to City Council.
It was moved by Marilynn Force and seconded by Margy Platter to
approve Resolution 01-01, a resolution finding the existence of blight
in the vicinity of 38th Avenue between Sheridan Boulevard and
Wadsworth Boulevard. The motion passed unanimously.
D. Resolution 01-02
Resolution 01-02 was presented to the Authority for consideration and
recommendation to City Council.
It was moved by Sandra Collins and seconded by Kandi McKay to
approve Resolution 01-02, a resolution finding the existence of blight
in the vicinity of the Wadsworth Boulevard Corridor between 35th
Avenue and 44th Avenue and recommend that City Council adopt such
studies.
It was moved by Kandi McKay and seconded by Sandra Collins to
amend the resolution to include vacant property west of Wardle Feed.
The amended motion passed unanimously.
7. OTHER MATTERS
Kandi McKay inquired as to whether sufficient infrastructure is in place for the
proposed redevelopment. Chair Matthews explained that there are water and
sewer needs that must be met which were detailed by Walt Pettit at an earlier
WRURA meeting. Alan White also explained that tax increment financing could
be used to offer assistance for infrastructure.
Margy Platter asked how long it would take for actual redevelopment to take
place. Chair Matthews explained that the next step is to do a redevelopment plan

Area should be recommended for such urban renewal efforts as the Authority and the
City of Wheat Ridge may deem appropriate to prevent further deterioration and blight,
"Blighted area" means an area that, in its present condition and use and, by reason
• the presence of at least four of the following factors, substantially impairs or
arrests the sound growth of the municipality, retards the provision of the housing

The Study Area is located in Wheat Ridge, Jefferson County, Colorado. The City of
Wheat Ridge is located in north central Colorado, directly northwest of Denver off of I-
70 and 4 miles from 1-25.
The 38th Ave Corridor is a major East-West shopping corridor for the city of Wheat
Ridge, running from Sheridan Blvd. on the east to Wadsworth Blvd. on the west. The
Study Area consists of a wide mix of uses from neighborhood commercial to large
commercial outlets with some residential uses mixed in.

Due to the vastness of the Wadsworth Corridor, identification of blight across the entire
Study Area was not feasible. Instead, key physical conditions (those which contribute
most toward the possibility of finding blight) are described according to the three
categories outlined previously. These conditions are described below.

Deterioration of Site or Other Improvements was found throughout the Study Area on 60
difTerent properties. The most prominent examples are parking surface deterioration,
lack of landscaping and unscreened trash or mechanical equipment.
4.6 Inadeauate Public Improvements

While some properties in the Study Area are in standard or sound condition, there exist
deteriorated and substandard conditions, which could lead the legislative body to find this
area is blighted. It should be noted that this conclusion is for the Study Area as a whole,
and is not based on separate individual properties.
As described in this study, conditions existing in the Study Area constitute at least four
(4) of the factors supporting a finding of blight under the Urban Renewal Law are
present. The conclusion of this study is based on the following summaries of the blighted
conditions found in the Study Area and described previously in this report:
Defective and Inadeguate Street Layout. There is a presence of faulty street
layout including poor vehicular access and internal circulation, substandard
parking layout.
2. Faulty Lot Layout. There is a presence of faulty lot layout in relation to size.,
adequacy, accessibility and usefulness in the Study Area. This includes
inefficient and unworkable layout of parking spaces in relation to commercial
structures, which creates poor and dangerous traffic circulation, a lack of
pedestrian walkway system and poor internal pedestrian circulation.

4. Deterioration of Site or Improvements. There is the presence of deteriorated site
and other improvements within the Study Area. This includes (a) missing or
damaged signage; (b) trash, debris and weeds; (c) substandard improvements
such as unscreened trash, deterioration of parking surfaces and lack of
landscaping.
5. Inade quate Public Improvements. There are inadequate public improvements in

the Study Area, and conditions, which do not meet current City development
standards. These include the presence of overhead utilities, lack of adequate
sidewalks, substandard parking and a lack of landscaping through out the Study
Area,

in the community, as well as to ensure that the Consultant Team's involvement is
used to address the right issues, answer the right questions, and identify appropriate
tools for implementation. During a meeting with select members of the City and

audiences, will be defined.

their location and extent, for presentation in the final document.
