Case No. WZ-12-10: An application filed by Arturo Fernandez for approval of a zone change from Restricted Commercial (RC) to Mixed Use Neighborhood (MU-N) for the property located at 4335 Harlan Street. Commissioner OHM asked if under the MU-N zoning the applicant be required to provide a 10-foot wide buffer on the west side of the property which is adjacent to residentially zoned. Ms. Mik replied that development standards only apply to new developments, and if there were to be new development on the property, the 10- foot wide setback would apply. Commissioner OHM stated that he is concerned about the narrow 8.9 foot wide drive aisle on the south side of the property' Ms. Mikulak confirmed that it is substandard to the current standards for a drive aisle. If the property is redeveloped in the future current standards would need to be met. In response to Commissioner OHM's question, Ms. Mikulak confinned that this would be a nonconforming site design. Ms. Reckert added that this was sent out on referral and a negative response was not received from the fire department. He explained that the narrow drive is not an issue since he does not intend to use it regularly. He intends to maintain the property, upgrade it, and keep it nicely landscaped. 0 6 John Lang 4375 Harlan St., Wheat Ridge, CO Planning Commission Minutes - 2 -- December 6, 2012 Mr. Lang stated that his only objection is that the backyard was paved by the previous owner and when it rains his property gets the excess water runoff. He would like to see some kind of drainage system put in to take care of the water problem. In response to Commissioner BRINKMAN's question, Ms. Mikulak replied that Mr. Lang resides in the single family home to the north. MEMI= It was moved by Commissioner BUCKNAM and seconded by Commissioner B• INKMAN to recommend approval of Case No. WZ-12-10, a request for approval of a zone change from Restricted Commercial to Mixed Use-Neighborhood, for property located at 4335 Harlan Street, for the following reasons: 1. The proposed zone change will not adversely impact the public healt safety, or welfare. 2. The proposed zone change is consistent with the goals and objectives the City's Comprehensive Plan. 3. The proposed zone change is compatible with the surrounding area. would be willing to do. Motion carried 6-0. Ms. Mikulak said that this case will go to City Council for first reading on January 14, 2012. B.
