WITNESSETH:

herein, City of Wheat Ridge, County of Jefferson, State of Colorado, which tracts are
hereinafter referred to as the "ROW Property"; and
WBEREAS, Owner is in the process of constructing a new commercial structure and
associated site improvements • adjacent property, as more fully described in Exhibit C,
attached hereto and fully incorporated herein by this reference, ("Owner's •r•perty") and
is desirous of obtaining a building permit for the construction; and

WBEREAS, in order to conform to future plans for the widening of Wadsworth
Boulevard adjacent to the ROW Property-and7-Owner's Property, the Parties wish to ent]
into this Development Covenant. M
I The responsibility for dedicating right-of-way along the Wadsworth Boulevard
street frontage of the ROW Property, is hereby acknowledged by the Owner.
2. The Owner has caused certain improvements to be constructed on the Owner's
Property.
