This Property Merger Covenant is entered into as of the r day of %�c,(L2024, by
and between the City of Wheat Ridge, a Colorado, home rule city (the "City"), whose address is
7500 W. 29d' Avenue, Wheat Ridge, Colorado and TRAVIS KIRKLEY AND ELIZABETH
KIRKLEY (the "Owner"), whose address is 3390 DEPEW STREET.
RECITALS:
A. The Owner is the owner of record of certain contiguous lots located in the City of
Wheat Ridge and described as follows:
LOTS 11 & 12, BLOCK 8 OF THE COLUMBIA HEIGHTS SUBDIVISION,
FILED AT BOOK 1, PAGE 34, DATED NOVEMBER 27, 1889 IN THE
COUNTY OF JEFFERSON, STATE OF COLORADO.
B. The Owner has filed an application with the City to merge the above described
parcels into one parcel pursuant to Section 26-117 of the Wheat Ridge Code of Laws.
C. The Owner declares that the merger of the subject lots into a single parcel will
improve and will not injure or reduce the value of the land.
D. The City finds that the merger of the subject lots in an action which is exempt
from the City's subdivision review requirements.
NOW, THEREFORE, in consideration of the above recitals and other good and valuable
consideration, the receipt and sufficiency of which is acknowledged, the parties agree as follows:
1. The Recitals set for above are incorporated by this reference as if fully set forth
herein.
2. The contiguous lots described in Recital A above are hereby combined and shall
henceforth be and forever remain one single lot (the "Combined Lot"), and may not be
subdivided unless this Covenant is released in the manner permitted at Paragraph 6 below. All
interior lot line(s) lying within the Combined Lot are hereby vacated and shall no longer serve as
boundary line(s) separating legal interests in real property.
3. The Combined Lot shall henceforth be known and referred to as "Combined Lot
11+12, Block 8, Columbia Heights Subdivision, City of Wheat Ridge, Jefferson County,
Colorado."
4. The Owner shall not transfer legal or equitable title to any portion of the
Combined Lot (by deed, deed of trust, inheritance, lien or encumbrances of any kind or
otherwise) without further approval of the City as required by the then -applicable rules,
regulation, policies, and procedures.

5. The Owner authorizes and hereby directs the County Assessor to combine the
contiguous lots described in Recital A above onto one schedule number for purposes of
assessment and taxation, if such combination is deemed appropriate by the County Assessor and
to combine the lots into one lot on the Assessor's maps.
6. The benefits and burdens of this Covenant are acknowledged by the parties to
touch and concern the land, shall be perpetual, and shall run with the land and shall be binding
on all successors and assigns of the Owner, unless released by written instrument executed by the
Community Development Director of the City, acting in his or her sole discretion upon a
submittal of a subdivision or release request, applicable fees, and evidence that this Covenant is
no longer required by law.
