1. Call to Order
This meeting was held in person, in the city council chambers located at 7500 W. 29th
Avenue, Wheat Ridge Colorado 80033. Hearing Officer Kendra Carberry called the
Liquor Authority Meeting to order at 1:30 PM.
Also Present: Robin Eaton, Deputy City Clerk; Margy Greer, Sr. Deputy City Clerk; WRPD Detective Kyle Boesel. 2. New Application for a new Retail Fermented Malt Beverage and Wine liquor
license – JVT Group Inc. dba Vinnola’s Italian Market located at 7750 W. 38th Avenue, Wheat Ridge, CO, 80033 Hearing Officer Kendra Carberry (HO) opened the public hearing
HO Carberry asked if the applicants would like to give testimony, where they agreed, and were sworn in. Joseph (JoJo) and Margo Pergola gave testimony to the kind of facility it has been for over the past 50 years as a deli/market/bakery/restaurant. They’ve always been known
for their food along with take home items like lasagna and stuffed shells. They recently are looking more at the theme of the Italian markets where their customers can pair the food with Italian beers and wines to go and they’ve always wanted to add liquor sales to their available products. Margo also added that with all the pieces that of an Italian dinner they offer for sale, with
the Italian wines being included they hope to grow their business sales to help them keep moving forward and become the premier Italian destination in the area. HO Carberry inquired about on premises consumption where the applicants stated that
was a strict no, even if the customers sit at one of the small tables to eat.
When questioned about it, they spoke on the amount of people who would be working, the types of food they serve/sell, and the types of training that will be required, with a no tolerance policy for unlawful alcohol sales
WRPD Detective Kyle Boesel had no questions or concerns with the applicants. HO Carberry ask Deputy Clerk Eaton to enter the Staff Report.
Staff Report Deputy City Clerk Eaton gave the findings for the staff report and entered Exhibits 1-6
into the record, showing the applicant has fulfilled all of the requirements to hold a new
Retail Fermented Malt Beverage and Wine liquor license. DC Eaton also entered evidence Exhibit 7, Bulletin 22-04 from the State describing the allowed exemption to the 500ft rule of law that would allow the new FMBW within the
restricted ft of a licensed Retail Liquor Store., along with the Certificate of Occupancy
issued in 2017. Hearing Officer Kendra Carberry asked for anyone else wishing to speak on the item. There were none.
Hearing Officer Kendra Carberry closed the public hearing. Hearing Officer Kendra Carberry chose to approve the issuance of a Retail Fermented Malt Beverage and Wine liquor license – JVT Group Inc. dba Vinnola’s Italian Market
located at 7750 W. 38th Avenue, Wheat Ridge, CO, 80033 on the basis of the following
findings: 1. Public Notice of the hearing on the Application was published and posted on the property as required by Colorado law;
2. The applicant is qualified to obtain a liquor license pursuant to C.R.S. Section 44-
3-307; 3. The premises are in a location eligible to conduct the proposed liquor licensed business pursuant to C.R.S. Section 44-3-313 and the zoning laws of the City; 4. The applicant is entitled to possession of the premises for which the application
is made;
5. The neighborhood under consideration is within a one-half mile circumference around the proposed licensed premises; 6. The inhabitants of the neighborhood desire an additional establishment that serves liquor;
7. The needs of the neighborhood are not currently being met by the existing
outlets. 3. Adjournment There being no further business to come before the Authority, Hearing Officer Kendra
Carberry adjourned the meeting at 1:47 PM.
