7. PUBLIC HEARING
A. Case No. ZOA-24-08: An Ordinance amending Chapter 26 of the Wheat Ridge
Code of Laws, concerning regulation of natural medicine services and healing
centers.
Chair DISNEY opened the public hearing.
Mr. Dahl gave a short presentation regarding the ordinance to practice natural
medicine.

In response to a question from Commissioner SCHELKE about the regulation of
hours, Mr. Dahl explained the hours will rely on the medical provider and state
licensing. He added that the hours can also be added to the ordinance at a later
date.
Commissioner QUINN inquired if the City has the ability to say how many
licenses can be granted.
Mr. Dahl confirmed that the City can and this is part of the “regulation of the
manner”. He explained that City Council currently does not want to stand in the
way of therapy so no cap to the number of healing centers in the City.
Commissioner MOORE asked if daycares that have recently applied for a license
will be accounted for in the one-thousand-foot radius.
Ms. Easley mentioned that once the daycare is licensed, it will be accounted for
and added to the map. A new daycare would be able to locate closer than the one-
thousand-foot radius.
In response to questions from Commissioners GRAEVE and QUINONES, Mr.
Dahl confirmed that this license will be for on-site, commercial therapy and not for
the purchase of a recreational substance.
In response to a question from Commissioner QUINONES, Mr. Dahl confirmed
that this ordinance is for on-site therapy only.

B. Case No. WZ-23-12: An application filed by Hammers Construction for approval
of a Specific Development Plan (SDP) for a Bonfire Burritos drive-thru restaurant
on a property zoned Planned Mixed-Use Development (PMUD) and located at
4001 Clear Creek Drive (CC district 4).
Chair DISNEY opened the public hearing.
Ms. Olivas-Loera gave a short presentation regarding the resolution. She entered
into the record the contents of the case file, packet materials, the zoning ordinance,
and the contents of the digital presentation. She stated the public notice
requirements have been met, therefore the Planning Commission has jurisdiction to
hear this case.

In response to a question from Commissioner SCHELKE, staff confirmed that
District 4 [sic District 3] will be the other location that drive-thru restaurants will
be allowed if the ODP amendment is approved by City Council.

QUINN to approve Case No. WZ-23-12, a request for approval of a Specific
Development Plan for a bonfire Burritos drive-thru restaurant on property
located within Planning Area 6 of the Clear Creek Crossing Planned Mixed
Use Development at 4001 Clear Creek Drive, for the following reasons:
1. The specific development plan is consistent with the purpose of a
planned development, as stated in Section 26-301 of the Code of Laws.
2. The specific development plan is consistent with the intent and purpose
of the outline development plan.
3. The proposed uses are consistent with those approved by the outline
development plan.
4. All responding agencies have indicated they can serve the property
with improvements installed at the developer’s expense.
5. The specific development plan is in substantial compliance with the
applicable standards set forth in the outline development plan and with
the City’s adopted design manuals.
With the following conditions:

1. Minor site adjustments may be required to the civil construction plans
to coordinate this development with surrounding infrastructure
improvements and the replat.
2. The associated subdivision plat (Case No. MS-24-01) shall be recorded

3. Building permit submittals shall be consistent with the SDP.

C. Case No. ZOA-24-07: An Ordinance amending Chapter 26 of the Wheat Ridge
Code of Laws creating a new Article XIV entitled “Mixed Use Lutheran Legacy
Campus Zone District” and making conforming amendments therewith.
Mr. Cutler gave a short presentation regarding the resolution.

Commissioner QUINN asked for an explanation on the square footage of the entire
campus that will need to be used for commercial purposes.
Mr. Cutler clarified that the commercial areas, as illustrated in the Master Plan,
will need to include a minimum square footage in Districts 2 and 4 which are
closest to 38th Avenue. Ms. Easley added that there could be some commercial
adaptive reuse of the existing Blue House.
Commissioner GRAEVE asked if there will be any affordable housing required on
the site.
Mr. Cutler and Ms. Easley explained that the City can encourage affordable
housing, but not require it.

MOORE to recommend approval of an ordinance amending Chapter 26 of the
Wheat Ridge Code of Laws, creating a new Article XIV entitled “Mixed Use

amendments therewith.

JURISDICTION:
All notification and posting requirements have been met; therefore, there is jurisdiction to hear this
case.
I. REQUEST
Case No. WZ-24-02 is an application for approval of a Specific Development Plan (SDP) for the
purpose of developing three restaurant/retail buildings situated around a central park plaza, being
coined ‘the Lookout.’ The buildings are proposed to be one to two stories (twenty to thirty feet in
height) and vary in size from 6,800 sq. ft. to 8,730 sq. ft. in size. The ownership line-up thus far
includes Prost Brewing (north building), a local restaurant group who operates Recess in Denver and
the Patio at Sloan’s Lake (middle building), and the Longs Peak Metro District (park and shared
infrastructure). Tenants have not yet been secured for the south building, but it is anticipated to
accommodate up to three tenants.
The subject site is located on the west side of Clear Creek Drive and south of the W. 40th Avenue and
Clear Creek Drive intersection, within the Clear Creek Crossing planned development, known as
Planning Area 6 of Clear Creek Crossing. It is a part of Block 4 of Clear Creek Crossing which is
being resubdivided from two lots into six concurrently with this SDP.
This request for SDP approval is the second step in a two-part approval process pertaining to planned
developments. The first step occurred in 2018 when Planning Commission and City Council
approved the Clear Creek Crossing Planned Mixed Use Outline Development Plan (ODP) which
established zoning (Case No. WZ-16-07). The zone change also included approval of a Vision Book
that establishes the intended design and architectural themes and materials, as well as a Design
Pattern Book (DPB) that includes the more substantive development regulations.
The second step is approval of the subject Specific Development Plan (SDP), which focuses on
specific details of a development such as site design, architecture, landscaping, and drainage. Section
26-302 of the Municipal Code allows for concurrent or sequential applications for the ODP and SDP.
This is one of many SDP applications to be heard before the Planning Commission for the different
phases or “Planning Areas” as the mixed-use project at Clear Creek Crossing is developed. SDPs
must be found to be compliant with the ODP and supporting documents in order to be approved.
Each SDP application must be heard at a public hearing before the Planning Commission.
Planning Commission Review
Planning Commission is the final authority for approval of a SDP. The intent of the public hearing is
to allow a publicly appointed body and the public at large to verify staff’s conclusion that the project
meets the intent and standards of the underlying zoning. The plan sheets and exhibits relevant to this
purpose are included. Construction details, such as final utility and grading plans, are not included for
review by Planning Commission and are under review by the Engineering Division.
II. PROPERTY HISTORY
Property History & Development Status
Rezoning to a planned development in the City of Wheat Ridge involves a two-step process, and for
the subject property, the 2018 approval of the ODP and DPB comprised the first step. These two

regulatory documents establish the allowed uses and development standards for the property and
establish access configurations for vehicles, pedestrians, and bicycles. While rare in Wheat Ridge, a
design pattern book is common for developments of this size, for which formatting flexibility
including photos and graphics are necessary to explain substantive development standards. An ODP
amendment was recently approved, which included changes to standards in this planning area. Links

The second step for development in a Planned Mixed Use Development (PMUD) requires approval
of Specific Development Plans for each building, lot, or phase. Several SDPs have already been
approved at Clear Creek Crossing, including a Bonfire Burritos, Primrose School, Home2 Suites
hotel, Outlook apartments (Phases I and II), Intermountain Health Lutheran hospital campus,
Hampton Inn hotel, Life Time Fitness Facility, Foothills Credit Union, Maverik (previously Kum &
Go) gas station, and Dutch Brothers coffee shop.
Related Application
Planning Commission recently reviewed Case No. WZ-24-01, an application which amended the uses
and development standards for the Clear Creek Crossing zoning and Design Pattern Book which
allowed the primary restaurant and entertainment district of Clear Creek Crossing to be relocated to
the furthest west side of the development to ultimately facilitate the development of the subject SDP.
Land Uses and Zoning
The site is currently vacant. A Life Time fitness facility lies adjacent to the site on the south side. A
Hampton Inn hotel is currently under construction to the north; and applications were recently
approved for a Bonfire Burritos drive-thru restaurant and Primrose School to the northeast. The site
to the southeast is the last remaining vacant lot on the west side of Clear Creek Drive within Clear
Creek Crossing. The internal roadway system and utility infrastructure bordering the site on the east
side were completed in late 2022, with some anticipated improvements to Crossing Drive slated to be
constructed concurrently with the Lookout site. A trail bordering the west side of the site is currently
under construction. See Exhibits 1 and 2, Aerial and Zoning Map.
III. SPECIFIC DEVELOPMENT PLAN
The site is located in Planning Area 6 (PA 6) which is part of the Harvest Commercial District
denoting this area as a commercial subdistrict in the development (Exhibit 3, Design Pattern Book
Excerpts). This area is slated for commercial uses and retail, restaurant, and entertainment uses are a
permitted in this area. Key components of the site design are described below. The site data table on
the cover sheet confirms the SDP complies with the development standards provided by the ODP
(Exhibit 4, Specific Development Plan).
Site Design & Internal Circulation
The vacant, 4.74-acre site is proposed to be developed with three restaurant/retail buildings totaling
approximately 28,278 square feet in size bordering a 0.67-acre park/plaza. The primary vehicular
access point is proposed into the site via a roundabout extending from Crossing Drive to the east,
which is planned to be constructed concurrently with the Lookout site and will connect users from W.
40th Avenue to the subject site and feed into surrounding signalized intersections. Cross-access
connections are provided to Hampton Inn to the north and Life Time to the south. Pedestrian

connections are also accommodated to the north, west, south, and east to tie into surrounding streets,
trails, and planning areas.
Parking
The SDP reflects 226 proposed parking spaces, including seven accessible spaces and 57 EV parking
spaces, plus 30 bike parking spaces. The parking is situated north, east, and south of the buildings and
is broken into smaller lots to avoid large spans of parking areas. Parking is screened from
surrounding streets by landscaping. Bicycle parking is split between multiple locations: at the
building/plaza entries on the east side, and dispersed along the west side trail, to provide convenient
locations for customers, trail users, and general users of the overall Clear Creek Crossing
Development. Restaurant uses are required to provide one parking space per 100 square feet of
public-facing floor area, and vehicular parking reductions of up to ten percent of required parking are
allowed where in close proximity to a bus stop, which the applicant has elected to use here with the
planned RTD bus transfer station being planned along Clear Creek Drive, just east of the subject site
and along the Primrose School frontage. The amount of parking provided complies with the Design
Pattern Book for the use and size of the building.
Building Orientation
The Design Pattern Book establishes setback and building orientation requirements specific to each
development district within Clear Creek Crossing. For Planning Area (PA) 6 within the Harvest
District, and because of the Denver Water easement which traverses the site along Clear Creek Drive,
there are no build-to requirements. Instead, buildings must be oriented proximate to primary
pedestrian routes. The buildings and plaza space are primarily oriented to the internal plaza and west
side trail.
The proposed building orientation will result in an enhanced pedestrian experience along the trail to
the west and Crossing Drive to the east, and will allow for easy pedestrian and bicycle access to the
trail as well as to the internal roadway network, surrounding signalized intersections, and adjacent
commercial uses. The buildings comply with setback standards of the ODP and Design Pattern Book.
Architecture
The architectural style is driven by the Clear Creek Crossing Design Pattern Book and Vision Book
which call for a modern agrarian aesthetic that blends traditional agrarian forms and materials with a
modern feel. It also requires strong attention to be paid to the pedestrian realm. The applicant has
evolved the building design based on feedback from staff over the past six months resulting in
building form, massing, and materials that are consistent with the vision of Clear Creek Crossing and
surrounding development.
The northern Building A, to be owned by Prost, is proposed to be single-story and approximately 28
feet tall. Architecture is comprised of primarily Corten metal, glass, and wood, and takes on a
traditional barn aesthetic integrated with a modern glass storefront. The building features material
variation to enhance the pedestrian realm and a pitched roof that strongly reflects the agrarian theme.
The middle Building B, to be owned by a local restaurant group who operates Recess in Denver and
the Patio at Sloan’s Lake, is proposed to be single-story with an upper-level mezzanine and a rooftop
patio on the north side, and is the tallest of the three buildings at approximately 31 feet tall.
Architecture is comprised of primarily glass and metal with wood accents and includes architecturally
integrated metal planters at the pedestrian level that project out to create additional interest. While the

overall material palette is similar to Building A, this building takes on a more modern character
incorporating sleek, straight lines and an angled roof. The taller portion of the building is fully glass
with a metal border and accents, and the single-story portions on each end are primarily wood. Metal,
wood, and glass are used consistently throughout the project and while each building is distinctly
different, the material palettes and style create a unique cohesion between the three buildings. This
building is proposed to be owned by a local restaurant group who intends to operate up to four
different restaurant concepts within Building B.
The southern Building C, is a speculative or “spec” building for which users are not yet known. It is
proposed to be single-story at approximately 24-feet tall and is the most modern of the three with flat
roofs that vary in height and plane. Architecture is comprised of primarily metal, fiber cement, wood,
and glass with brick and stucco accents. The use of storefront glass, wood, and metal tie into the other
buildings. The southern façade of this building is anticipated to contain a mural of farming aesthetic
to further accentuate and tie into the theme.
All three buildings incorporate outdoor seating areas fronting the internal plaza with wood, metal,
and glass elements reflective of the modern agrarian theme. The building materials carry over to all
sides of the buildings resulting in four-sided architecture. Overall transparency is substantial and
meets or exceeds requirements of the DPB for the facades facing the street and public spaces. Black
and white architectural elevations are found on pages 16-25 of the SDP (Exhibit 4, SDP), and colored
architectural perspectives can be found in Exhibit 5.
Landscaping, Open Space, and Amenities
The project includes 17.9% overall landscaping where 20% is called for in the Design Pattern Book.
That said, the design standards in the DPB are intended to have some flexibility, and it specifically
stipulates that an alternative may be considered if concurrence is achieved by the Community
Development Director. In this case, staff and the Community Development Director find the
proposed modification to be justified because the proposed landscape and open space design is in
keeping with the intent of the design standards. Most developments spread open space throughout a
site, but the plaza and gathering space proposed in this SDP creates a substantially more consolidated,
usable, and attractive design. Additionally, perimeter landscaping, corner plazas, parking lot
landscaping islands, streetscape trees, planting beds near the buildings and integral planters (with a
variety of trees, shrubs, ornamental grasses and perennials) have been maximized to the greatest
extent feasible. With parking reductions already in place, there is no way to increase the landscape
coverage. Staff finds the design meets the intent despite being slightly below the 20% goal.
The Design Pattern Book includes plaza requirements for PA 6, with a minimum of 10,000 sq. ft. of
plaza required in this subdistrict. The interior plaza almost triple the minimum requirement at 29,503
sq. ft. in size. It is 21% landscaped and offers entertainment and amenities including an amphitheater,
bike station, picnic tables, benches, playground, artificial turf gaming area for cornhole and the like,
and fire pits. The plaza incorporates overhead string lighting and artistic elements such as a tractor
slide and water tower public art feature that create a unique public space. The plaza will be owned
and maintained by the metro district and will be publicly accessible. The applicant’s intent is to
acquire a common consumption liquor license to cover the restaurants and plaza. The plaza will take
on a more urban feel and be primarily hardscaped with trees in tree grates. Landscaping is situated
primarily in planting beds close to the buildings, entries, and trail to leave open plaza area for active
recreation.

Grading, Utilities, Drainage and Traffic
This SDP complies with all grading, utilities, drainage, and traffic plans for the overall Clear Creek
Crossing development. Sanitary sewer and water service will be provided by Applewood Sanitation
District and Consolidated Mutual Water Company, respectively. All internal site utilities will be
privately owned and maintained by Longs Peak Metro District and will be placed in utility
easements. The utilities are generally located beneath the streets and drive aisles.
Grades on the site present a unique challenge. There is about twelve feet of grade change across the
site from north to south and about fourteen feet of grade change from west to east. Building C and the
associated southern parking area are approximately fourteen feet above the trail. Tiered retaining
walls along the southwest parking area as well as a cantilevered deck for Building C, have been
incorporated to create usable space. While Applewood Sanitation District has indicated support of the
design, a condition of approval has been added to confirm the sanitation district approves of the
retaining wall encroaching into their easement.
The grades are highest at the south end and level out to trail-level north of the plaza amphitheater
where an accessible entrance to the trail will be provided. A section view of the tiered wall and
cantilevered deck can be found on page 25 of the SDP (Exhibit 4, SDP), and colored architectural
perspectives showing grade changes at the buildings can be found in Exhibit 5.
IV. SDP CRITERIA
Staff has provided an analysis of the zone change criteria outlined in Section 26-305.D. The Planning
Commission shall base its recommendation in consideration of the extent to which the following
criteria have been met:
1. The proposed specific development plan is consistent with the purpose of a planned
development as stated in section 26-301 of this article.
The purpose of utilizing planned development zoning is to provide flexibility while
accommodating well-designed, innovative developments that demonstrate efficient use of land
and may not be feasible under a standard zone district. The SDP achieves these goals and
proposes a high-quality building product in close proximity to the interstate, residential, and
commercial facilities, supporting the mixed-use and interstate-oriented vision for the area. The
site and building were designed to reinforce the character of Clear Creek Crossing as established
in the Design Pattern Book.
Staff concludes this criterion has been met.
2. The proposed specific development plan is consistent with the design intent or purpose of
the approved outline development plan.
The SDP is consistent with the intent and character statements of the outline development plan.
The site incorporates quality landscaping and places of passive and active recreation for site and
trail users and follows architectural guidelines to fit the modern agrarian theme of Clear Creek
Crossing. The goal is for the Lookout to become the premiere model of the modern agrarian
theme and to provide a premiere destination and gathering space.

approved by the outline development plan.
The SDP is consistent with the use standards of the outline development plan. Restaurant, retail,
and park uses are permitted uses in PA 6 or the Harvest District of Clear Creek Crossing which
includes the subject site.
Staff concludes this criterion has been met.
4. The site is appropriately designed and is consistent with the development guidelines
established in the outline development plan.
The site and buildings are designed to adhere with development standards for the Harvest District.
This includes the setback and building placement requirements applicable to PA 6, landscaping
coverage, vehicle and bicycle parking, and gathering space. The design integrates with the
existing and proposed development sites surrounding it and takes into consideration vehicular,
bicycle, and pedestrian circulation.
Staff concludes this criterion has been met.
5. Adequate infrastructure/facilities are available to serve the subject property, or the
applicant will upgrade and provide such where they do not exist or are under capacity.
All responding agencies have indicated they can serve the property with improvements installed
at the developers’ expense. All required infrastructure and services are provided for within this
SDP. Some regional infrastructure updates are being coordinated separately by the master
developer.
Staff concludes this criterion has been met.
6. The proposed specific development plan is in substantial compliance with the applicable
standards set forth in the Architectural and Site Design Manual, Streetscape Design Manual,
and other applicable design standards.
As described above, the SDP is in compliance with the Clear Creek Crossing amended ODP, and
Design Pattern Book, which addresses architectural, site, and streetscape design as well as the
new paseo design.
Staff concludes this criterion has been met.

V. AGENCY REFERRAL
All affected service agencies were contacted for comment on the SDP and subdivision, specifically
regarding the ability to serve the property. There were no concerns expressed by the City of Wheat

Ridge Engineering Division, Building Division, Parks and Recreation, Police Department, Economic
Development, or Urban Renewal Authority. More detailed referral responses from City departments
and outside districts follow:
Wheat Ridge Engineering Division: The SDP is approvable. Minor corrections remain on the
construction documents and plat and will be approved prior to issuance of building permit.
Coordination is required between the Lookout team and LPMD who is managing the regional
infrastructure improvements on Crossing Drive.
Wheat Ridge Public Works: Coordination on surrounding public infrastructure will continue
through development.
Wheat Ridge Building Division: Review against the current IBC to be conducted with building
permit. Coordination will continue through development.
Wheat Ridge Parks and Recreation: The development will not impact Parks & Recreation
operations.
Wheat Ridge Economic Development/Urban Renewal Authority: No conflict with the
I70/Kipling Corridors Urban Renewal Area.
West Metro Fire District: Can serve. Coordination will continue through development.
Xcel Energy: Can serve. Utility coordination is ongoing.
Century Link: Can serve. Utility coordination is ongoing.
Comcast/Xfinity: Can serve. Utility coordination is ongoing.
Consolidated Mutual Water District: Can serve. Utility coordination is ongoing.
Applewood Sanitation District: Can serve. Utility coordination is ongoing.

VI. STAFF CONCLUSIONS AND RECOMMENDATION
Staff has concluded that the proposed SDP is consistent with the planned development regulations,
with the goals and policies of the City’s guiding documents, and with the amended ODP and
supporting documents. Because the review criteria support the SDP, staff recommends approval of
the Specific Development Plan.
As noted above, the Planning Commission is compelled to review the application against the SDP
criteria for review. The intent of the Planning Commission’s review is to allow a publicly appointed
body and the public at large to verify staff’s conclusion that the project meets the intent and standards
of the underlying zoning.
VII. SUGGESTED MOTIONS – SPECIFIC DEVELOPMENT PLAN
Option A:
“I move to APPROVE Case No. WZ-24-02, a request for approval of a Specific Development Plan
for a three-building restaurant and park corridor on property located within Planning Area 6 of the
Clear Creek Crossing Planned Mixed Use Development southwest of W. 40th Avenue and Clear
Creek Drive, for the following reasons:
1. The specific development plan is consistent with the purpose of a planned development, as
stated in Section 26-301 of the Code of Laws.
2. The specific development plan is consistent with the intent and purpose of the outline
development plan.
3. The proposed uses are consistent with those approved by the outline development plan.
4. All responding agencies have indicated they can serve the property with improvements
installed at the developer’s expense.
5. The specific development plan is in substantial compliance with the applicable standards set
forth in the outline development plan and with the City’s adopted design manuals.
With the following conditions:
1. Minor site adjustments may be required to align with civil construction plans and the replat to
coordinate this development with surrounding infrastructure improvements.
2. Approval from Applewood Sanitation District for easement encroachments shall be required
prior to issuance of building permits.
3. The associated subdivision plat (Case No. MS-24-02) shall be recorded prior to recording of
the subject SDP.
4. The developer shall enter into a development agreement with the City to be recorded with the
County Clerk & Recorder prior to issuance of building permits.
5. Building permit submittals shall be consistent with the SDP.

Clear Creek Crossing – A portion of Block 4, Lot 1
Dear Ms. Stevens,
On behalf of Evergreen – Clear Creek Crossing, L.L.C. I am pleased to present a formal Site Development
Application for review by City Staff. This application consists of a new ground up development project
within Clear Creek Crossing.
The proposed development consists of three (3) buildings totaling approximately 25,000 square feet
whose primary use is sit down eating and drinking establishments. Prost Brewing is planned for the
northern building, Q-1, and is planned to be just under 7,000 sf. They plan to serve German style beer
and food including pretzels, sausages, etc. The eastern building, Q-2, is planned to be owned and
operated by Recess which is an existing restaurant in the LoHi neighborhood of Denver. The operators
plan to create a central bar surrounded by multiple different food options as well as a golf simulator.
The total proposed area for this building is just under 9,000 sf. The southern building, Q-3, is not
completely planned out currently but is conceptually planned to be a multi-tenant building totaling just
under 9,000 sf with additional restaurant space and/or service-related offerings.
The Site consists of a total of 4.77 acres and the buildings are planned to be oriented in a U-shape with
the open side facing west. The development is named “The Lookout” as it overlooks the Coors ponds
and faces Lookout Mountain to the West. The parcel is planned to be subdivided into four parcels, one
for each building and its associated parking field along with a tract that will be dedicated to Longs Peak
Metropolitan District (LPMD). This tract will be a public park that is owned and maintained by LPMD.
Amenities in the park and plaza areas include a tractor slide, turf area for kids, boulders, firepits, various
seating options, and a small amphitheater on the west side with a stage that can be used for
musical/theatre performances as well as a screen for sporting events. The property boundary will be
established with a Subdivision of Block 4, Lot 1 Clear Creek Crossing Subdivision Filing No. 3. This
proposed plat is being submitted for concurrent review and approval.
