A Subdivision Improvement Agreement (SIA) was recorded for the property in September 2018 with the Jefferson County Clerk and Recorded under reception number 2018086889. Public improvements were approved to be installed in two phases (Phase 1 and 2) as documented in the SIA and detailed in Exhibit C. We understand that several factors have resulted in your request for the issuance ofbuilding permits in Phase 1 prior to the completion of all public improvements. Section 6 of the SIA allows for administrative amendment to the phasing plan. Please allow this letter to confirm the City's approval of the enclosed modified phasing plan. Sincerely, Steve Nguyen Kenneth mnnstone Director of Public Works Community Develop>pent Director Enclosure CC:case.file Lauren Mikulak, Planning Manager Dave Brossman, Development Rei,ievt'Engineer Lars Monson, Thrive Home Builders www.ci.wheatridge.co.us L A EXHIBIT C Phasing Plan for Public and On-Site Improvements REVISED MAY 2019 The public and on-site improvements for the property shall be installed in two (2) phases as outlined below and illustrated in the attached phasing plan: Phase 1 Notwithstanding anything to the contrary contained in the Agreement, prior to the completion of the horizontal infrastructure in Phase 1, building permits for the following lots may be issued: • Yarrow Gardens Filing No. 3, Block 1, Lots 1 -4 • Yarrow Gardens Filing No. 3, Block 5, Lots 19-24 Prior to the issuance of additional building permits, the following improvements shall be completed: a) Drainage facilities and certification (except the trickle channel adjacent to Block 4 and the 6 area inlets and associated piping indicated in the phasing plan as Phase 2); b) Drive lanes, including Streets 01,02,03, 04 and 05 (excepting top lift); c) Curbs and gutters; and d) On street parking (excepting top lift). Prior to issuance of Certificates of Occupancy in Phase 1, the following must occur: e) All public improvements within the Yarrow Street and W. 42nd Avenue rights-of- way shall be completed prior to the issuance of the first Certificate of Occupancy. f) The following on-site improvements shall be completed: a. The trickle channel adjacent to Block 4 shall be installed prior to the issuance of the first CO in Block 4. b. The top lift of asphalt on Streets 02,03,04 and 05 shall be installed prior to issuance of the first Certificate of Occupancy. c. Prior to issuance of any Certificate of Occupancy, the adjacent on-site improvements shall be complete including sidewalks, alleys, and landscaping providing logical connections to adjacent streets Prior to issuance of any Certificate of Occupancy, all furnishings including lighting shall be installed. As exceptions to the above requirements: g) Installation of landscaping, street trees, and irrigation is not required prior to Certificate of Occupancy if issuance of the C.O. occurs outside of the planting season, generally October to June. Refer to Section 12 of the Subdivision Improvement Agreement. h) The final lift of asphalt shall not be required for Street 01 as part of Phase 1; material shall be acceptable to the Fire Marshall. Phase 2 Prior to issuance of the first Certificate of Occupancy in Phase 2, the following must occur: a) All on-site improvements as shown on the city-approved construction documents shall be completed. Prior to issuance of any Certificate of Occupancy for lots within Phase 2, the adjacent on-site improvements shall be complete including sidewalks, alleys, and landscaping. Installation of landscaping, street trees, and irrigation is not required prior to Certificate of Occupancy if issuance of the C.O. occurs outside of the planting season, generally October to June.
