MINUTES
September 4, 1969, a continuance of the September 2, Regular Council
Meeting was called to order by ~ayor Albert E. Anderson at 7:30 PM
in the City Of rice , 7390 w. 38th Ave.
Aldermen present were: Ray C. Pepe, Robert P. Eckhardt, Robert G.
Howard, Calvin O. Hulsey, Jack W. Bramble and Dana L. Bowling.
Others attending were: Mayor Anderson, Clerk Louise Turner, Treas-
urer James O. Malone, Attorney Zarlengo, Gary Latham or the County
Planning Commission. Individuals presenting or interested in Re-
zoning cases, Representatives or Mountain Bell and the Public
Service Co., and interested citizens.
Mr. Anderson showed a gavel presented to him by the East Jerferson
Chamber or Commerce.
Mr. Littleton, from Ft. Collins, who is a planning reasability con-
sulting Engineer who deals in cost control with emphasis on cities,
was introduced and asked to have permission to present a thorough
program when the agenda is not so busy.
Rezoning cases previously presented were reviewed in order that
the council might give a reecommendation or approval or denial to
the County Commissioners.
1st. Case B 69-84 - Request for change at 47th & Kipling from A-I
and R2 to PD for apartments.
Motion - by Alderman Bramble "That the Council re.commend
approval because of location, access to 1-70, and because proper
development could be an asset to Wheat Ridge". 2nd. by Alderman
Pepe. Council was polled - Aldermen Pepe, HUlsey, Bramble and
Bowling voted "aye"; Aldermen Howard and Eckhardt voted "no".
Motion carried 4-2.
2nd Case B 69-100 (request for change from R-C to C-l for Restaurant
and shopette (at 41st and Kipling).
Motion - by Alderman Eckhardt, 2nd by Alderman Bowling "That
denial be re,commended because the proposed rezoning would be even
more incompatible to the surrounding area than the present zoning
and there would be no reason to justify such action". Motion for
denial carried unanimously.
3rd Case B 69-1~O (request for change from A-I to R-3 at 10852 W.
44th Ave. in the path or the Foothills Freeway).
Motion - "That denial be retcommended" 2nd by Alderman Howard;
~~. Zarlengo retcommended not voting on a denial because the appli-
cation was to be withdrawn. Motion was not withdrawn. The Council
was polled and voted 5-1 in favor of denial. Negative vote was
voiced by Alderman Eckhardt.
4th Case B 69-114 (request ror change from A-l to PD at 47th and
Miller to 8.110w doubles, apartments and a woodworking plant.)
Motion - by Alderman Howard, 2nd by Hulsey "That a denial be
reecommended because it doesn't conrorm with the existing plan and
because of the commercial aspect as it adjoins the residences on
the west and the effect on Fruitdale School". Motion carried 5-0.
AlderrrBn Bramble abstained.
5th case B 69-97 (Application for change from I-I to 1-2 to allow a
meat packaging plant at approximately 7800 W. 48th).
Motion - by Alderson Hulsey, 2nd by Dana Bowling "That approval
be re.commended because the area is mostly industrial now, that the
operation would be clean and that would be access to 1-70". Motion
carried unanimously.

6th Case B 69-109 (Request for change from R-2 to R-3 for income
apartments on 47th between Holland and Independence)
11otion - by Alderman Pepe, 2nd by Alderman "That
approval be reccommended because of the density factor and because
it could provide a buffer zone between the Ind on the north and
the R-2 on the south". 1'1otion carried unanimously.
Two new cases were presented:
B 69-120 - A request for a change from R-2 to R-3 South of 48th and
W8.dsworth for the purpose of a two-story townhouses. The area is in
a position that is difricult to develop. Rezoning would conrlict
with masterplan which calls for low-density but could be a buffer
zone. Denver has reccommended R-3A and that care be taken to pro-
tect the single ramily dwellings. Planning Commission would prefer
R-3A but is ror approval subject to platting. Motion Alderman Pepe,
2nd by Eckhardt "to table case until Tuesday 9/9/69." Carried unani-
mously.
B 69-88 - A request for a change rrom R-2 to R-C at 4575 Wadsworth
for the purpose or operating an antique shop. Mr. Latham comented
that other purpoRes less innocuous than an antique shop could be
utilized within the classirication but that probably this case
would receive~_qualified approval from the planning commission.
Notion by Alderman Hulsey, 2nd by Alderman Howard" That case
B 69-88 be tabled until Tues. 9/9/69. Carried unanimously.
The matter of the Telephone Co. occupational Tax was introduced.
The tax will amount to 3% or gross revenue on local service, is to
be paid quarterlY and the 1st payment is to be prepaid.
Alderman Eckhardt suggested the possibility of the payments being
made monthly or interest on a monthly basis being added into the
quarterly payment. Arter some discussion. the ordinance entitled,
"A bill for an ordinance concerning revenue and imposing a business
tax on certain utility companies operating within the City of Wheat
Ridge, providing for the collection of said taxes and penalties
with respect there16''', was introduced by Alderman Ray C. Pepe and
read by the Clerk. The following were changes made: #1 "to the
City of Wheat Ridge" instead of "to the City Clerk" in line :;- v,-?

in line 2 of the Title; #3 the effective date to be included and
#4 "on first reading" to be included at the end.
I'lotion by Alderman Robert P. Eckhardt, 2nd by Jack Bramble "that
the Wheat Ridge City Council adopt the ordinance on first reading and
direct the Clerk to Publish and Post it in six public places." Council
was polled and voted "aye" unanimously.
Motion by Alderman Calvin Hulsey, 2nd by Anderman Robert Howard
"That the ordinance be amended so it would read "furnishing telephone
service" after the word company in section 7. r10tion carried unani-
mously.
Motion by Alderman Eckhardt, 2nd by Alderman Bramble, "That the
ordinance be accepted as read and amended and that it be ordered
published and posted as set out in the previous motion." Carried
unanimously.
Mr. Joseph Donaldson gave a report on additional sources of revenue
and turned over to the clerk a list of licenses and card file of
licenses and permits used in the City of Denver.
A written report on eleven quick sources of revenue was turned over
to the Clerk by ~rr. E. D. ~~ttox.
Discussion of a letter from the Regional Council of Governments was
tabled until Tuesday Sept. 9. so that Senate Bill 309 can be reviewed.

Jl10tion by Alderman Bramble and 2nd by Alderman Pepe "That Aldermen
Bowling, Eckhardt and Bramble be a committee, with Attorney Zarlengo
available for advice, to negotiate with Public Service regarding a
franchise agreement and report back to the Council.
v~. Harvey Kolesar introduced Mr. Paul Cunningham who discussed
what the advantages and expenses might be should Wheat Ridge be
interested in taking over the distribution means or gas and elec-
tricity within the city---a course which has been followed in Ft.
Collins and Colorado Springs and is being conisdered in other cities.
(BOUlder and Aurora).
r~. Zarlengo has been asked to proceed with a lease ror use of office
space downstaires at 7390 W. 38th. Owners are willing for the City
to make whatever improvements it chooses at its own expense. Also
insurance will be looked into.
AppOinted to work on 1969 Budget were Aldermen: HUlsey and Treasurer
Malone. Appointed to work on 1970 Budget were Aldermen Pepe and
Clerk Turner.
Agenda for 9/9/69 will include: Law enforcement with Sherifr Bray
present; Alderman Howard and Attorney Zarlengo are to make a study
of codes to be presented later (and ordinances or other cities).
Motion for adjournment was made, 2nd and carried at 1:15 AM Friday
morn lug .
