HomeMy WebLinkAbout09/16/1969 HINUTES September 16, 1969 The sixth meeting of the Wheat Ridge City Council was called to order at 7:30 p.m. in the City Office by Mayor Albert E. Anderson. Attending were: Aldermen Pepe, Eckhardt, Hulsey, Bramble, Bowling. Also attending were Mayor Anderson, Clerk Louise Turner, Attorney Anthony V. Zarlengo, Gary Latham and citizens. Mrs. Louise Barish talked to the Council about a drainage problem at 33rd and Pierce. The County had said it needed City approval in order to proceed with its plans. A motion "as made by Alderman Bowlin,;, 2nd by Alderman Hulsey, for Resolution 1#4 stating that the City recommends that the County proceed with its plans in the area. Council ~Ias polled and voted "Aye" 5-0. The County will be notified and City Engineer, Ralph Johnson, will look into the the plans. Mr. Hilker appeared and stated he would like to see the City designate the Wheat Ridge Sentinel as the City's legal newspaper. The Arvada Citizen has been used because of a question as to the legality of the Sentinel. Rezoning cases were presented by Gary Latham. IFB 69-104 requesting a change from R-C to C-l on property owned by Mr. Harold Wellman at 38th and Kendall. Change is requested soley for the purpose of holding occasional auctions and possibly this may be permitted under R-C, subsection 8. The request may be withdra~'IU. Motion was made by Alderman Eckhardt, 2nd by Alderman Bm'lling "that case be tabled until applicants and staff can confer, get a legal interpretation, and decide whether or not to withdraw." Hotion carried 5-0. #B 69-101 Change has been requested from R-2 to C-l at 44th and Garrison for retail sales, transfer and distribution of bakery goods. Motion by Alderman Eckhardt, 2nd by Alderman 3ramble to table the case until Friday, Carried 4-1. Pepe "Nay". Zoning decision of B 69-ll9-an area where a violation is suspected in regard to present use. Motion by Alderman Hulsey, 2nd by Alderman Pepe, "that the council recommend denial because the present land use recommendation of low density should be followed until a future plan is decided upon: Clerk was directed to inform the Commissioners by letter. Alderman Eckhardt read a 6 point proposal ~'Ihich he, Alderman "lulsey and men from the two I-mill recreation districts had worked out: 1. That the city assume the duties, functions, properties, and responsibilities of the 1 mill recreation districts within the City. 2. That the existing mill levy of these said recreation districts be transferred to the City general fund and earmarked for recreation. 3. That the City Council set up a Park and Recreation Board composed of members(2) from Prospect Recreation District, two from Wheat Ridge Recreation District and two from the Wheat Ridge City Council. This board shall be known as the Wheat Ridge Park and Recreation Board. 4. That the following are recommended to be appointed to aforesaid Board: Felix Lepore, Walt Aecker, Herb Fightmaster, Vern Hizel, Robert Eckhardt and Calvin Hulsey. 5. That the following be appointed as consultants to this Board and that appropriate fees be determined by said Board with approval of the Council: Edgar Johnson and Leonard Homan. 6. That this Board begin dieeuesione with the North Jeffco Park and leereation District to explore the poeeibility of excluding the District's area .Tithin the City from that District. Mr. Homan stated that Prospect would like to have the 1 mill districts continue for one year more but that if the commissioners refused, then they were all for the 6 point program. ';'//c- /C-:. / (~ \ The possibility of assessing an occupational tax in conjunction with Liquor Licenses was discussed. There will be a separate resolution for each liquor application. A Safeway Beer Application and a Gem Store Package Liquor application are on hand. Preliminary hearings are to be set for September 23. Applicants are to be notified. Hotion ';TaS made by Alderman 3m.7ling and 2nd by Alderman Hulsey "that Wheat Ridge adopt by reference that Littleton Resolution for the issuance and transfer of 3.2 licenses and that this be known as Wheat Ridge Resolution No.5. (Reading of the resolution was dispensed \dth motion by Alderman Hulsey \-[hich was 2nd by Alderman Bramble and carried). Council was polled and those present voted unanimously to adopt Resolution No.5. The Police Chief is to make a report on the Ridgeview Supermarket ';7hich has sent in renewal fee for 3.2. If nothin~ derogatory is found, the license will be automatically renewed. The 1970 Budget was presented to the Council for study. The "Model Traffic Code for Colorado }1unicipalities" was introduced for reading by Alderman 3ramble. The reading was dispensed with on motion of Alderman Eckhardt which was 2nd by Alderman Pepe and carried. Motion to adopt Model Traffic Code was made by Alderman Hulsey, 2nd by Alderman Bowling and to publish in the Arvada Citizen and post in six public places on September 18th and 25th the notice of a public meeting to be held October 7. Motion carried unanimously by those present. Second reading of Ordinance No. 1 on the Cigarette Tax. Hotion by Alderman Bowling, 2nd by Alderman Hulsey to change 5/. to 8% in Section 10. Carried. Motion by Alderman Bowling, 2nd by Alderman Hulsey to change word "Code" to "Ordinances" in Section 14. Carried. Motion by Alderman Bowling, 2nd by Alderman Pepe to change "18th" to "19th" in Section 16, Carried. Motion by Alderman Bramble, 2nd by Alderman Pepe to put the word "Introduced" before the vlord "Passed" in Section 16. Hotion Carried. Motion by Alderman Bramble, 2nd by Alderman Bowling "that the Cigarette Tax Ordinance No. 1 be passed on 2nd and final reading and ordered published in the Arvada Citizen on September 28 and posted in six public places. Council was polled and all present voted "Aye". Motion was carried. Notice was received by the Attorney of Jefferson City stating that a hearing will be held in District Court on October 3 to determine the boundaries of Jefferson City. Motion VTaS made by Alderman Eckhardt, 2nd hy Alderman Pepe and carried unanimously by those present "that Anthony V. Zarlengo be appointed Hunicipal Judge as of October 1st at a fee to be determined at a later date. 110tion was made, 2nd and carried at 1:15 a.m. that the meeting be continued on Friday, September 19. All \ldermen, Mayor, Clerk, City Attorney and citizens attending. Ralph Johnson, City Engineer, reported that County plans are to extend a 54" drain which now ends at 44th south to 38th Avenue and to the east and west on 38th but no farther to the south this year. Contract is to be let in November with work to start in December. The local situation at 33rd and Pierce will be corrected by a drain into an existing 20-24" drain. 7//<'./CC: (~J .f City Engineer stated that he doesn't foresee a problem in the vicinity of Lutheran Hospital and that he ,qill look into the situation at the Gem Store. Motion by Alderman Pepe, 2nd by Alderman Howard "that Wheat Ridge authorize lease of a Xerox machine. Hotion carried. Motion by Alderman Howard, "nd by Alderman Hulsey "that the Council approve the Civil Defense plan for Jefferson County~ Motion carried. Ordinance #2 dealing with the Occupational Tax of the Telephone Company came up for second reading. Motion by Alderman Pepe, with." Motion Carried. second and final reading 2nd by Alderman Howard "that the reading be dispensed Council was polled and voted unanimously to pass on of Ordinance lft2. Motion by Alderman Hulsey, 2nd by Alderman Howard "that the renewal of the 3.2 beer license for Ridgeview Supermarket be approved~ Carried unanimously. ZONING B 69-101 Request for change from R-C to C-l at 44th and Garrison. Motion by Alderman Eckhardt, 2nd by Alderman Hulsey "that the council recommend approval because the proposed zoning is ;cg"lFnt'hl~, ~ surrounding zoning and recommend that the developer do whatever:,he can by means of hedging or fencing to alleviate any undesirable effects on houses to the south".
