The eleventh regular meeting of the Wheat Ridge City Council was called
to order at 7:30 p.m. by Mayor Albert E. Anderson in the Wheat Ridge City
Office. Aldermen attending were Robert Eckhardt, Robert Howard, Calvin
Hulsey, Dana Bowling, Ray Pepe and Jack B~amble. Also attending were
Mayor Anderson, Clerk Louise Turner, Attorney Maurice Fax, City Engineer
Ralph Johnson, Coordinator Walter Johnson and citizens.
Resolution #19 regarding the transfer of functions from the County to the
City was discussed. Included in the discussion were: speculation as to
whether Fees would cover the cost of inspections, the use of fee personnel
for inspections, the advantages of adopting the Jeffco Code by resolution
for temporary use and the additional time required when something is
adopted by reference because a hearing is necessary.
Motion was made by Alderman Pepe, seconded by Alderman Howard "that the
Council adopt a resolution adopting the County Building Code until January
1 and that County Inspectors be hired to do the job for the fee involved.
After some discussion, the matter was tabled on a motion by Alderman Pepe
until the City Attorney can give an opinion as to the legality of such
action. Motion was seconded by Jack Bramble; passed 6-0.
Other points mentioned in connection with Resolution #19 were the per-
centage of Road and Bridge fund money which the County would refund to the
City and when, snow and ice removal and street maintenance, a law enforce-
ment contract, storm drainage and highway users tax. It was suggested that
the original dates proposed be used. Alderman Eckhardt stated that any
agreements with the County should be signed by both the City and the County
so there would be no questions later.

Resolution ~ calling for a personnel committee which would be responsible
for screening of applicants and the setting up of a merit system was
tabled until a later date.
Or. Jim Feucht, Horticulturist from CSU, spoke to the Council on the
penetration and discovery of the Dutch Elm Disease in the Denver Metro-
politan area. He left information including samples of legislation which
have been used in other areas in an effort to check the disease which is
the result of a fungus carried by a beatle which breeds in dead and dying
elm wood. Mainly the American Elm is affected and though not native to
Colorado, has been planted in quantity in Denver. If no control is effected,
99% of the American Elm population may be killed in any infected area in ten
years time. The Siberian (or Chinese Elm--more common in the suburbs is
resistant to the disease but can perpetuate the disease by supporting the
beatles.
Dr. Feucht, a resident of Wheat Ridge, will head a committee made up of
Mrs. Harry Smith, Walter Pettit, Jr., and Harvey Kolesar to study the
situation and make recommendations for control in Wheat Ridge.
Tree limb report indicated that much time was lost over the weekend in
waiting in line to enter the County Dumps. The project will be continued
during the week with county trucks and hired personnel. If Denver opens
the dump on 52nd and Gray Streets, then it can continue on weekends also.
One citizen suggested that the city ask people not to put limbs around
fire plugs.

Ordinance #9 "enabling the Mayor to call a state of emergency and allowing
him specific powers in the event of such emergency " was introduced
by Alderman ~. Pepe and read by the Clerk.
Alderman Hulsey stated that possible, as written, too much burden, respon-
sibility or power is on one person's hands and recommended t.hat a statement
"that the Mayor is to contact the council as quickly as possible" be
included in the ordinance. Some discussion followed regarding whether the
authority to call a state of emergency should be with the Chief of Police
or with the elected official who is responsible to the people.
Motion was made by Alderman Pepe, seconded by Alderman Bowling, that
Ordinance #9, amended to include the statement "that upon declaration of
a state of emergency the Mayor would arrange to contact the council as soon
as possible", be passed on first reading and be ordered published in the
Arvada Citizen and posted in six pub~ic places. Motion passed 6-0.
Attorney Maurice Fox suggested that the adoption of the Arvada Building
Code be tabled until the 23rd of October and recommended that the County
Code be adopted by resolution to cover November 17th and 18th until the
Building Ordinance is in effect.
Harvey Kolesar stated that the UBC is a good code and that adopting Arvada's
version of it and contracting with Arvada for inspections might eliminate
many complications.
A reasonable fee basis was recommended. Walter Anderson stated that
probably there would be one paid individual and the rest free personnel.
It was announced that personnel to staff citizen committees would be taken
up at a later time.
At 11 p.m. the meeting was declared continued until 7:30 p.m., October 23rd.
