The sixteenth regular meeting of the Wheat Ridge City Council was
called to order by Mayor Albert E. Anderson at 7:30 p.m. in the
Wheat Ridge City Office at 7390 West 38th Avenue.
Aldermen attending_ were: Ray Pepe, Robert Eckhardt, Calvin Hulsey,
and Dana Bowling. Alderman Robert Howard arrived later.
Other attending were Mayor Anderson, Clerk Louise Turner, Treasurer
James Malone, City Attorney Maurice Fox, Administrator Walter Johnson,
members of the Park Committee and citizens.
Motion was made by Alderman Pepe that the issuance of a 3.2 carry out
license for Rally SS at 41st and Kipling be denied. Complete motion
is on file. Motion was seconded by Alderman Bowling and passed 3-1
Alderman Howard being absent and Alderman Eckhardt voting "nay".
Attorney Virgil Boatright requested a copy of the Motion.
Ordinances 114 and 417 were tabled until December 2, 1969.
Ordinance #13 placing an occupational tax on beer and liquor was
brought up for discussion. It was suggested that a pro-rata clause
and a provision for extended hours be included. Motion was made by
Alderman Howard and seconded by Alderman Hulsey "that Ordinance 413
be tabled for study." Motion passed 5-0.
Resolution #34 establishing and outlining the functions of a Building
Code Advisory Board was introduced by Alderman Hulsey.
Motion was made by Alderman Bowling and seconded by Alderman Howard
that Resolution 934 setting up a Building Code Advisory Board be
adopted. Motion passed 5-0.
Resolution #32 was introduced by Alderman Pepe. Motion was made by
Alderman Bowling "that Resolution #32 setting up a water and sewer
committee be adopted as read." Motion was seconded by Alderman Pepe
and passed 5-0.
Resolution r30 was introduced by Alderman Eckhardt and was discussed
and amended.
Motion was made by Alderman Howard and seconded by Alderman Eckhardt
"that Resolution 330 setting up a citizen police powers committee be
adopted as amended". Motion passed 5-0.
Resolution r31 was introduced by Alderman Bowling, and amendments in
wording were made. Motion was made by Alderman Howard "that Resolution
,431 pertaining to a committee on streets, traffic and drainage be
adopted as amended." Motion was seconded by Alderman Bowling. There
was discussion regarding whether recommednations from this committee
should g❑ to the planning committee first or directly to Council.
Motion passed 4-1 with Alderman Sramble being absent and Alderman
Eckhardt voting "nay".
Report of the Park Committee was given by Mr. Felix Lepore. Mr.
Lepore emphasized that arrangements must be made for transferring
park property to the city before December 31, 1969. Fie requested
that the city attorney meet with the commissioners in hopes of getting
a written agreement so that the property will be transferred and so

that money "in the park district might be placed in trust to be
used for capital improvements.
A proposed park committee function resolution was discussed and Mr.
Edgar Johnson recommended some minor changes in terminology. The
resolution will be introduced at a later meeting.
Tree limb removal report indicated that over 65D loads have been
removed. Special notice was given to help donated by Jefferson High
School Key Club over the weekend. A map was shown of the areas
covered and not covered.
Mr. Walter Johnson reported that Jack Prose, 4135 Ingalls Street
has been hired as part-time buildin inspector.
Mr. Howard Buchanan reported that the planning commission will have
5 cases for consideration by the council on December 2,1969. They
are:
WZ-69-1 A-2 to I-3 at 5055 Tabor Street
WZ-69-2 C-1 to I-1 at 48th and Allison
WZ-69-3 R-2 to R-C al r'90 West 44th Avenue
WZ-69-4 R-2 & R-3 to „3A at 6209 West 26th Avenue
WZ-69-5 R-1 to A-1 at 6475 and 6131 West 29th Avenue
The Planning Commission will have a public hearinri on December 3
concerning adoption of subdivision regulations.
Motion was made by Alderman Pepe and seconded by Alderman Bowling
"that Ordinance ,#12 be read. Motion passes 5-0.
The title of Ordinance #12 was read and the reading of the remainder
of the ordinance was dispensed with on a Motion by Alderman Pepe
which was seconded by Alderman Bowling and passed 5-0.
Motion was made by Alderman Bowling "that Ordinance 7'/12 which establishes
a planning commission be passed on second and final reading and be ordered
published and pasted." Motion was seconded by Alderman Eckhardt and
passed 5-0.
The list of citizens selected to fill committees established by
resolutions was read. A complete list is attached to the minutes.
Treasurer James Malone asked that council take action regarding the
proposed Pierce Street Storm Sewer --the contract for which was to have
been let by October 17.
Motion was made by Alderman Eckhardt "that the Mayor --as city adminis-
trator --send a letter to the commissioners, with carbon copies to
Karl Williams, Sam Heider and Mr. Wood, saying "that the publicly
promised storm sewer 'project should be reviewed and a report sent to
the city council." Motion was seconded by Alderman Hulsey and passed
5-0.

Mr. Walter Johnson reported that the section of ordinance 410--the
Building Code, which pertains to signs is in conflict with the section
pertaining t❑ signs in ordinance #11--the Zoninn Ordinance. The
matter will be reviewed on Tuesday, Decomber 2, 1969.

MOTION TO DENY ISSUANCE OF LICENSE
BY ALDERMAN PEPE
I move that the issuance of a 3.2 per cent Fermented
Malt Beverage License as applied for to the City of !,heat Ridge
by Robert J. Hartman be DENIED for the following reasons:
After due consideration of all evidence pr{�sented and
the offical records submitted by the Planning Departnent of the
County of Jefferson, which records included a market analysis
showing the following outlets within the neighborhooJ;
1. Safeway Store 3/10 mile
10050 West 38th Avenue
2. Zip Food Store 8/10 mile
913❑ West 44th Avenue
3. Ridgeview Super Market 9/10 mile
8005 West 44th Avenue

It appears that the needs ❑f the neighborhood are being
served adequately by the existing outlets.

for a 3.2 per cent Fermented Malt Beverage License Le DENIED.
