HomeMy WebLinkAbout03/24/1970 ./ 1i"";1"'- MINUTES March 24, 1970 The thirty-eighth regular meeting of the Wheat Ridge City Council was called to order at 7:30 p.m. in the Wheat Ridge Council Meeting Room at 7390 West 38 Avenue by Mayor Albert E. Anderson. Aldermen attending were: Ray Pepe, Joseph Donaldson, Robert Howard, Calvin Hulsey and Dana Bowling. Alderman Bramble was absent. Others attending were Mayor Anderson, Clerk Louise Turner, City Attorney Maurice Fox, City Administrator Walter Johnson, Planning Director James Mier, applicants and attorneys involved in zoning cases and interested citizens. Rezoning Case WZ-69-12 Applicant William Mc Bride requested a change from A-l to 1-2 for a sign painting shop at 48 Avenue and Parfet. The following Motion was made by Alderman Pepe "I move that the zoning req~ested in WZ-69-12 be granted because the area tends to be going to industrial and because the Planning Commission has recommended approval.1I Motion was seconded by Alderman Donaldson and was defeated 3-2 with Aldermen Howard, Hulsey and Donaldson voting IInay." Rezoning Case WZ-7o-1 Applicant and owner Mike Leprino requested a change from present zoning of R-l to proposed R-1A at 32 Avenue and Kipling Street. Mr. Leprino stated the average lot size would be in excess of 14,000 Sqware feet and that minimum requirements for R-l are 12,500 square feet. Also, he stated that houses would be in the $30,000 to $35,000 price range and would be equally as good as others in the neighborhood. Homeowners in the area who spoke in opposition to the rezoning were: 1. Ross Westover, 9965 West 34 Drive 2. Ernest Johnson, 3370 Kipling 3. Russell Roe, 3385 Independence Court 4. Jim Kleen, 9870 West 34 Drive 5. LeRoy Cook, 9775 West 32 Avenue 6. Art Shannon, 9737 West 32 Avenue 7. Glen Christianson, 9890 West 34 Drive 8. Hermina Goldfar, 3333 Independence 9. Roy S. Anderson, 9940 West 34 Drive. Feelings expressed were: That the rezoning would benefit Mr. Leprino and not the neighbors, that houses could be placed closer together than under R-1 and this would interfere with the view of neighbors and aggravate an already bad drainage situation, that there might be an access problem to adjacent property, that a change of zoning might result in such a change on adjacent property and that residents have attended several meetings because they like the area as R-l and want to keep it that way. The following Motion was made by Alderman Donaldson III move that Council take Rezoning Case WZ-70-1 under advisement for one week and render a decision on March 31, 1970.11 Motion was seconded by Alderman Hulsey and passed 4-0 with Alderman Bowling abstaining. Motion was seconded by Alderman Bowling and passed 5-0. The Ordinance is to be approved by Attorney Hite before it is presented to Council. -2- Case WZ-70-4 Applicant MB~y G. Weynand requested a change from A-1 to C-1 at 4711 Klplln~ for use as a motel site. Applicant was repre5ented by Attorney Herbert 5. 5chant5. A150 5peaking in favor of the C8se was Roger L. Welend of the American Family Lodge Motel chain which will build the motel. The following Motion wa5 made by Alderman Pepe "I move that Case WZ-70-4 be tabled for one week and that Council render a decision on March 31, 1970." Motion was seconded by Alderman Howard and passed 4-0, with Alderman Bowling abstaining. Ordinance No. 29 The following Motion was made by Alderman Pepe "I move that Ordinance No. 29 amending the Sales Tax Ordinance No.3 be read on second reading." Motion was seconded by Alderman Howard and passed 5-0. The following Motion was made by Alderman Donaldson "I move Ordinance No. 29, amending Ordinance No.3 be approved on second reading and be ordered published in the Arvada Citizen and posted." Motion was seconded by Alderman Hulsey and passed 5-0. Ordinance No. 30 The following Motion was made by Alderman Bowling "I move that Ordinance No. 30 be considered on second reading, that the title be read and the reading of the balance of the Ordinance be dispensed with." Motion was seconded by Alderman Donaldson and passed 5-0. The following Motion was made by Alderman Hulsey "I move that Ordinance No. 30 be passed on second reading and that it be published and posted." Motion was seconded by Alderman Bowling and passed 5-0. The following Motion was made by Alderman Pepe "I move that the 1970 Chevrolet, 3/4 ton Fleetside truck, serial number CE240 S15Z630, be paid for from funds available to the City of Wheat Ridge from its share of the Jefferson County Road and Bridge Funds." Motion was seconded by Alderman Bowling and passed 5-0. The following Motion was made by Alderman Pepe "I move that the rental of a 1961 Ford dump truck, serial No. F81 Fu1152187, at $17.00 per day from January 29, 1970, to March 20, 1970, figured at 6 working days a week for a total of $782.00 be approved for payment by the City of Wheat Ridge from its share of the Jefferson County Road and Bridge Funds." Motion was seconded by Alderman Donaldson and passed 5-0. Resolution No. 55 pertaining to smoking during Council meetings was introduced by Alderman Donaldson.
