DEVELOPMENT AGREEMENT
THIS AGREEMENT, entered into this 29th day of November
1974, between the City of Wheat Ridge, a Municipal Corporation,
hereinafter referred to as City, and Super Service Drug, Incorporated,
6100A Stapleton Drive South, Denver, Colorado, represented by
its president, Mr. Murray Hilibrand, hereinafter referred to as
Drug, Inc.
WIT N E SSE T H:
WHEREAS, Drug, Inc. is lease holder of a building and
tract of land in the City of Wheat Ridge, County of Jefferson,
State of Colorado, located at 10123 West 37th Place; and
WHEREAS, Drug, Inc. has applied for a Certificate of
Occupancy; and
WHEREAS, the storm drainage work is incomplete; and
WHEREAS, Drug, Inc., through its president, Mr. Murray
Hilibrand, has agreed with the contractor, Mr. Donald C. Buckner,
to complete the said storm drainage work.
NOW, THEREFORE, BE IT HEREBY AGREED THAT:
(1) Responsibility for the installation of proper
storm drainage facilities is hereby recognized and affirmed and
that such drainage is to consist of one-hundred feet (100'), more
or less, of fifteen inch (15") sewer pipe running in a gener~lly
north-south direction on the west side of the property bordering
upon Lee Street equipped with one single grate catch basin and
one double grate catch basin with a thirty inch (30") sewer pipe
running from the northern end of the fifteen inch (15") pipe
under Lee Street to Lena Gulch;
(2) Drug, Inc. and its contractor, Mr. Donald C.
Buckner, or their assigns and successors, will provide for the
installation of said storm drainage at its own expense and at
no cost to the City, said installation being completed on or
before 28 December 1974;
(3) Drug, Inc. and its contractor, Mr. Buckner, will
abide by the applicable conditions of the ordinances of the City;
(4) A temporary Certificate of Occupancy will be issued
upon the execution of this Agreement by Drug, Inc. and the con-
tractor, Mr. Donald C. Buckner, and an unqualified Certificate of
Occupancy will be issued, if otherwise applicable, upon completion
of the aforesaid storm drainage work;

(5) The parties hereto agree that this Development
Agreement by its terms shall be binding upon the City, Drug, Inc.,
and the contractor, and upon the assigns and successors thereof,
and shall constitute covenants running with the described property.
This Development Agreement shall be recorded with the County Clerk
and Recorder.
IN WITNESS WHEREOF, the parties have set their hands
and seals on the date first shown.
