HomeMy WebLinkAbout06/02/1970 MINUTES June 2, 1970 The fifty-seventh regular meeting of the Wheat Ridge City Council was called to roder at 7 30 P m in the Council Meeting Room at 7390 West 38 Avenue by Mayor Albert E. Anderson Aldermen attending were Robert Howard, Dana Bowling, Joseph Don- aldson, Jack Bramble, Calvin Hulsey Alderman Ray Pepe was absent Also attending were Mayor Albert E Anderson, Deputy City Clerk Elise McMillen, City Attorney Maurice Fox, Administrator Walter Johnson, City Engineer Ralph Johnson, Assistant Engineer Clyde Hobbs, Planning Director James Mier, Lt Pinson, applicants for rezoning cases, and interested citizens. Wheat Rid~Knolls Subdivision Plat was brought up for a decision. Applicant Mike Leprino was present. Attorney Maurice Fox ruled that a decision at this time would be out of order because Planning Commission had not taken proper action at this time He stated that they had thirty days to take action and that the Plat had been submitted on May 11, 1970 and the deadline would be on June 10, 1970. Motion made by Alderman Bramble "I move that this Wheat Ridge Knolls Subdivision Plat be denied because the drainage in this area is un- satisfactory" Mayor Anderson stated that this Motion was out of order because of the ruling of the City Attorney Motion was withdrawn Motion was made by Alderman Bowling "I move that Wheat Ridge Knolls Subdivision Plat be tabled until June 16, 1970 at 7 30 pm" Alderman Donaldson seconded the Motion and it was passed by a vote of 3-1 with Alderman Hulsey voting "nay" and Alderman Bramble abstaining. Street, Traffic and Drainage Committee Report was given by Chairman Walt Pettit on Street Light Recommendations The full report is on file in the Clerk's office Motion made by Alderman Howard "I move that Council accept the report by the Street, Traffic and Drainage Committee, and refer the report to the Engineering Department for action." Motion was seconded by Alderman Donaldson and passed 5-0 Ordinance No 44 amending Ordinance No. 11 to establish Hospital Zoning was brought up for second reading and ordered read Motion made by Alderman Bowling "I mClE that Section 39 H-2, Two District under B Height Regulation be amended as follows None, and add 'No building shall exceed a height of one hundred fifty feet '"Motion was seconded by Alderman Howard Hospital Delete- and Motion was amended by Alderman Bowling "that height sixty feet instead of one hundred and fifty feet." amendment and Motion passed 5-0 be one hundred and Second agreed to Motion made by Alderman Donaldson "I move that Ordinance No 44 be passed on second reading as amended and be posted and published " Motion was seconded by Alderman Bowling and passed 5-0. Rezoning Case WZ-7o-11 Applicant Harold D. Lutz was present to request a change from R-1 to R-C Zoning at 3950 Kipling Street so the tenant at that property,Mr. Arthur Helburg,could use the brick barn for a part-time car and signs etc. painting shop Planning Commission had recommended denial because the applicant at that time said he would be painting trucks and tractors, and this would be a traffice hazard Planning Commission had also ruled at this time that R-C Zoning would be the only zoning which would allow the proposed purpose. -2- Motion made by Alderman Bramble "I move that Rezoning Case WZ- 70-11 be tabled for study for one week with a decision to be ren- dered at that time" Motion was seconded by Alderman Bowling and passed 5-0 It is to be noted that the Rezoning change was amended to be R-C1 and signed and changed on the application by Mr Harold Lutz. It was stated that the tenant's purpose for rezoning would be allowed under R-C1, and that Case WZ-70-11 is requesting a change from R-1 to H-C1 Zoning. Vacation Case WV-70-3 was brought up Applicant Eugene C Archer was present requesting the vacation of CuI-de-sac Lots 1 and 2 at 4568-70 Hoyt Street. Applicant stated the street is a through street and the cul-de-sac is no longer necessary, and also that the property titles are not clear because the cul-de-sac infringes. Motion made by Alderman Hulsey "I move that an Ordinance be prepared pertaining to Case WV-70-3 vacation request, and that it be brought up at the next Council meeting on Thursday, June 4, 1970" Motion was seconded by Alderman Bowling and passed 5-0 Meeting was adjourned at 10 DO p.m. ,-~ 'h;l , / " / 1/ -( , :;:: ''- ,/4.
