HomeMy WebLinkAbout06/16/1970 MINUTES June 16, 1970 The sixtieth regular meeting of the Wheat Ridge City Council was called to order at 7 30 p.m in the Wheat Ridge Council Meeting Room at 7390 West 38 Avenue by Mayor Albert E. Anderson. Aldermen attending were aldson, Robert Howard and absent Dana Bowling, Jack Bramble, Joseph Don- Calvin Hulsey Alderman Ray Pepe was Others attending were Mayor Anderson, Clerk Louise Turner, Admin- istrator Walter Johnson, Assistant Attorney Henry Nieto, Planning Director James Mier, Assistant Engineer Clyde Hobbs and interested citizens WS-7o-1 Wheat Ridge Knolls Subdivision Plat A letter was presented from Mr. Harold Lutz, Attorney for Mr. Mike Leprino requesting that final consideration be tabled for two weeks to enable Mr. Lutz and Assistant Engineer Clyde Hobbs to mark out a drainage plan which would be satisfactory to both the City and Mr Leprino. Mr James Mier read a Resolution from the Planning Department recom- mending denial because of engineering deficiencies. The Plat had not been signed by the Engineering Department Motion by Alderman Bramble "I move that WS-70-1, Wheat Ridge Knolls Subdivision Plat, be denied for the following reasons 1. The Planning Commission recommended denial because of Engineering deficiencies 2. The proper drainage as presented by the Engineering Department has not been met. 3. The drainage will have to be absorbed by private pro- perty " Motion was seconded by Alderman Howard and passed 5-0 WZ-70-12 Decision Applicant Ralph Jacobson had requested a change from R-2 to R-3A on five acres at 48 Avenue and Everett. Motion by Alderman Howard "I move that the change requested in Rezoning Case WZ-70-12 at 48 Avenue and Everett from the present zoning of R-2 to the proposed rezoning of R-3A be denied for the following reasons 1. The comprehensive plan shows single family and low density. 2 The surrounding land use is low density singles and doubles. 3 The ovewhelming majority of the residents in the surrounding area opposed this rezoning." Motion was seconded by Alderman Hulsey Alderman Howard stated that the residents opposing Case WZ-70-12 had done an outstanding job. Motion passed 5-0 with Alderman Bramble abstaining and Alderman Pepe's vote sent in by letter. On direction of Assistant City Attorney, Henry Nieto, the letter from Alderman Pepe is included with the Minutes. WZ-70-13 Decision rezoning from R-C that Council delay returns to town. Applicant Mr. Harold Wellman who had requested a to C-1 at 38 Avenue and Kendall, asked in a letter final consideration of his case until his attorney -2- Motion by Alderman Howard "I move that the rezoning requested in WZ-70-13 at 38 Avenue and Kendall including 3825 Kendall, from R-C (Restricted Commercial) to C-1 (Commercial One) be denied for the following reasons 1. The comprehensive plan shows medium, density residen- tial 2. The Planning Commission and Planning Department have both recommended denial." Motion was seconded by Alderman Hulsey and passed 4-1 with Alderman Bowling voting "nay" and Alderman Bramble abstaining. The rezoning was denied WZ-70-14 Decision Applicant Harold Baumgartner had requested a change from A-1 to C-2 at 4800 Parfet. Motion by Alderman Bowling "I move that ~Z-7o-14 be approved for the follOWing reasons 1 The trend is toward industrial and commercial develop- ment 2 This location doesnl~ have the proper dimensions to fit into an industria~XBEvelopment. 3. It fronts on 1-70." Motion was seconded by Alderman Donaldson and passed 3-2 with Aldermen Howard and Hulsey voting "nay " Police Chief Edward Pinson requested that a change in the Police Budget be made from three Sergeants to four, plus one Sergeant Detec- tive for B total of five Sergeants which does not affect the Budget total. Motion by Alderman Bowling "I move that change in the Police Budget be approved to allow four Patrol Sergeants and one Sergeant Detective, or a total of five Sergeants which results in no change in the Budget total" Motion was seconded by Alderman Donaldson and passed 5-0. Motion by Alderman Donaldson "I move that Resolution No. 69 be amended by the addition of the following paragraph Paragraph (b) Add --' ,and this amount be supplemented by $54,146 92 Federal Grants in 1970.'" Motion was seconded by Alderman Howard and passed 5-0 Clerk was directed to publish the Resolution one time and send a copy of the amended Resolution to the State Tax Commission. GILBERT June 16, 1970 Hon Ed Anderson, Mayor City of Wheatridge Wheatridge, Colorado RE Wheatridge Knolls Subdivision Plat Dear Mayor Anderson Please be advised that I have been retained by Mr Mike Leprino the owner of the property which is the sub- ject matter of a plat known as Wheatridge Knolls, which plat is pending before the City of Council of the City of Wheatridge for possible approval You are familiar with the problem which has arisen in regard to this matter, having to do with the proper drainage provisions of the plat After I was retained by Mr Leprino I had a brief discussion with the Engineer for the City of Wheatridge, Mr Clyde Hobbs, and we both felt that it would be in the interest of all concerned that he and I get together and discuss the possibilities of proper drainage into Kipling Street Since the State Highway Department has written a letter to the City indicating that it would not permit such drainage into Kipling Street, it is necessary for us to discuss this matter seriously with that Department, because even the solution suggested by the City of Wheatridge would provide that the water eventually returned to Kipling Street and be drained down that street Since the heavy rains of last week have kept Mr Hobbs so busy that he has been unable to find the time to discuss this matter with me further, I would respectfully request that the City Council table final consideration of this plat ~~?hc c:;j when it comes up for hearing at the meeting of the City Council tonight, June 16th, 1970, for a period of two weeks or a month, by which time I am hopeful that Mr Hobbs and I can present a workable proper plan for drainage that will be satisfactory to Mr Leprino and to the City of Wheatridge Your kind consideration in this matter is greatly appreciated Yours truly, HDL jr " b#/;1!!~~ HAROLD D LUTZ /" / (..~ ,..... //r; ., LOUI E F- TI-r."""H::-.;.
