Recommend Development Agreement with Kipling 5000 Subdivision covering curb, gutter and sidewalk and also street improvements on the west side of Independence Street and north side of West 49th Avenue rather than requiring the construction as a condition for the Certificate of Occupancy. The reasons for this recommendation are as follows: 1. West 49th Avenue design status is unknown since the Colorado Highway Department has proposed this street as a frontage road to 1-70. 2. The existing design of Independence Street requires considerable change in grade which has not been provided - for in the existing right-of-way for the east half of the street, Constructing half of the street section would render the street unusable.
