HomeMy WebLinkAbout07/16/1970 MINUTES July 16, 1970 The sixty-sixth regular meeting of the Wheat Ridge City Council was called to order at 7 30 P m by Mayor Albert E Anderson at 7390 West 38 Avenue Aldermen attending were Dana Bowling, Joseph Donaldson, Robert Howard, Calvin Hulsey and Ray Pepe Alderman Jack Bramble was absent Others attending were Mayor Anderson, Clerk Louise Turner, Trea- surer James Malone, City Attorney Maurice Fox, Director of Admini- strative Services Walter Johnson, Director of Development Jerome Zohn, Planning Director James Mier and interested citizens Preliminary Hearing pertaining to property formerly known as Cobbs Res- taurant was held. Applicants Theodore and Virginia Boerstler had made application for the transfer of a 3-way Liquor License from Cobbs to Boerstler Farms Motion by Alderman Pepe Mrs Boerstler be August Bowling and passed 5-0 "I move that the Public Hearing for Mr and 20, 1970" Motion was seconded by Alderman Budget and Appropriations Report for June 30, 1970 was given by Trea- surer James Malone The Report indicated that 40 6 percent anticipated income has received and 31 percent of appropriations have been expended. complete report is in the general file been The A proposed street vacation for a portion of Kipling Street in Tract D, Blevins Subdivision was brought up for discussion Motion was made by Alderman Donaldson, seconded by Alderman Howard and passed 5-0 "that the matter of the street vacation be tabled for two weeks and be placed on the agenda July 30, 1970 " Motion by Alderman Bowling "I move that an Ordinance amending Ord- inance No 11 by a section pertaining to Planned Unit Developments be tabled until Council can have a recommendation from the Planning Commission" Motion was seconded by Alderman Howard and passed 5-0. Ordinance No 55 pertaining to Parks was introduced by Alderman Hulsey for first consideration and read Motion by to Parks posted " Alderman Hulsey "I move that Ordinance No 55 pertaining be passed on first reading and that it be published and Motion was seconded by Alderman Howard and passed 5-0. Ordinance No 51 pertaining to Greenhouse Zoning was introduced by Alderman Donaldson Motion by Alderman Donaldson "I move that Council amend Ordinance No 51 by reading of the amended version" Motion was seconded by Alderman Pepe, passed 5-0 and the Ordinance was read Attorney Dean Norris stated that any rezoning to G-1 will be spot zoning Motion by Alderman Howard "I move that Council defeat Ordinance No. 51 pertaining to Greenhouse Zoning on first reading." He stated he felt the Ordinance was not needed Motion was seconded by Alderman Hulsey In answer to questions asked, the City Attorney stated That a destroyed greenhouse under present zoning could not be rebuilt -2- That G-1 would be considered spot zoning and That the intended purpose of the Ordinance could be achieved by amending Ordinance No 11 to allow grenhouses in residential districts Council was polled and the Motion to defeat Ordinance No. 51 pertaining to Greenhouse Zoning passed 4-1 with Alderman Pepe voting "nay" Rezoning Case WZ-70-16 was heard Applicant H J Fightmaster of 11661 West 44 Avenue had requested a change from A-1 to R-3 zoning for approximately 2 7 acres Planning Director James Mier stated thffithe area is from 45 Avenue to 46 Avenue and from Simms to Swadley, that the surrounding zoning is North R-2, South A-1 and R-3, East A-1, West A-1 and R-2; that the Comprehensive Plan calls for medium density, that the Planning Com- mission recommended denial, and that the Planning Director recommended approval Mr H J Fightmaster stated that he had formerly farmed the area, but could not any more and that there is very little that can be done with it with agricultural zoning, and that he wanted the change in order to be able to do something with it. Mr Herbert Fightmaster of 11641 West 44 Avenue gave the following reasons for requesting R-3 Zoning They wanted income property. It would help to beautify the area It would improve the traffic situation They wanted it to be planned rather than a group of unplanned doubles, and If the whole area is to become industrial, they would like to build this first and keep this part residential. Speaking in opposition was Mr Bruce Jurney of 4675 Swadley who stated that objections were That his neighborhood would be boxed in Traffic would be increased Schools would be crowded, and That there would be an additional 100 cars and that Swadley Street would be the most direct way to 1-70 Mrs. Junker of 4615 Swadley presented petitions containing 55 names of neighbors who opposed the rezoning Motion by Alderman Howard "I move that Council and announce a decision one week from tonight " by Alderman Donaldson and passed 5-0 table Case WZ-7o-16 Motion was seconded Ordinance No 56 amending Ordinance No 41 pertaining to Police Salaries was introduced by Alderman Howard. Motion by Ordinance posted " Alderman Howard "I move that Ordinance No 56 amending No. 41 be passed on first reading and be published and Motion was seconded by Alderman Bowling and passed 5-0. Ordinance No 52 amending the Sales Tax Ordinance No 3 to allow 3 1/3 percent return to retailers was brought up for second consideration and the title read. Motion by Alderman Pepe "I move that the Clerk dispense with the reading of the remainder of the Ordinance" Motion was seconded by Alderman Bowling and passed 4-1 with Alderman Howard voting "nay " Motion by Alderman Donaldson "I move that Ordinance No 52 amending the Sales Tax Ordinance No 3 be passed on second reading and be pub- lished and posted" Motion was seconded by Alderman Hulsey and passed 5-0 -3- Ordinance No 53 pertaining to long term leasing was brought up for second consideration and the title read Motion was made by Alderman Pepe, seconded by Alderman Bowling and passed 5-0 "that the title having been read the reading of the balance of Ordinance No 53 be dispensed with " Motion by Alderman Donaldson "I move that Ordinance No. 53 pertain- ing to long term leasing be adopted on second reading and posted and published" Motion was seconded by Alderman Bowling and passed 5-0 Motion by Alderman Bowling "I move that Council approve the following appointments made by the Mayor Leland Stewart to fill the vacancy left on the Planning Com- mission by the resignation of Dr. Donald Walker and George Christiansen and Eileen Pryor to be alternates on the Planning Commission" Motion was seconded by Alderman Donaldson and passed 5-0 Mayor Anderson designated Kent uavis as the Mayor's appointment to~e Civil Service Board. Two others will be appointed by the Council prior to July 26, 1970 Motion by Alderman Howard "I move that Council approve the following terms for members of the Personnel Committee Rocco Gioso and Harry Meerdink each for three year terms. Bill Thornton and Harry Smith each for two year terms, and Rev John McElderry for a one year term " Motion was seconded by Alderman Hulsey and passed 5-0.
