August 20, 1970
The seventy-second regular meeting of the Wheat Ridge City Council
was called to order by Mayor Albert E Anderson at 7 30 P m in the
Council Meeting Room at 7390 West 38 Avenue
Aldermen present were Dana Bowling, Jack W. Bramble, Joseph Don-
aldson, Robert Howard, Calvin Hulsey and Ray C. Pepe
Also attending were Mayor Anderson, Clerk Louise Turner, City
Attorney Maurice Fox, Director of Development Jerome Zohn, and
Director of Administrative Services Walter Johnson
The issuance of a 3.2 Beer Package Retail License for Woods Super
Market at 10019 West 26 Avenue was brought up for decision
Motion by Alderman Bowling "I move that the application for a
3 2 Beer License for Woods Super Market be approved" Motion was
seconded by Alderman Hulsey and passed 3-1 with Alderman Pepe voting
"nay" and Aldermen Bramble and Donaldson abstaining
WZ-70-15 Rezoning Case was brought up for decision. Applicant F L.
Hildenbrand had requested a change from R-1 and A-1 to R-2 on six
acres west of Pearson Street between 39 Avenue and 41 Avenue
Motion by Alderman Bowling "I move that Case WZ-70-15 be denied
because the Master Plan calls for low density which is R-1 and R-1A
and because no proof was submitted that the area cannot be developed
as R-1 and R-1A." Motion was seconded by Alderman Donaldson
Alderman Bramble asked that the Motion be amended to include "that
there were 278 names on petitions of people opposing the rezoning"
Motion was amended and the amendment approved by the second
After discussion, Council was polled and the Motion passed 6-0 to de-
feat the rezoning.
Rezoning Case WZ-7o-18 was brought up for decision. Applicant W D
Williamson had requested a change from A-2 to R-3 at 4380 Xenon
Motion by Alderman Pepe "I move that Case WZ-7o-18 be approved for
the following reasons
1 The Master Plan recommends medium density
2 The area is 11,500 square feet and five units can be
built and 3 It will be a buffer zone for the R-C to the north "
Motion was seconded by Alderman Bowling and the vote tied 3-3 with
Aldermen Donaldson, Howard and Hulsey voting "nay." Mayor Anderson
voted "nay" breaking the tie and defeating the Motion to approve the
rezoning.
A Public Hearing was held regarding the transfer of a 3-way liquor
license for Boerstler Farms at 1-70 Service Road and Kipling Case
was presented by Aftorney Michael Miller of 1701 Security Life Building
in Denver. No one appeared in opposition Complete proceedings
were recorded by Court Reporter Del Bohling
Motion by Alderman Pepe "I move that 3-way liquor license for Boerstler
Farms, a partnership, be granted" Motion was seconded by Alderman
Hulsey and passed 5-0. Alderman Bramble was absent
Citizen comments were made by the following people
Mr Allen Kirby of 2875 gray who requested maintenance of
an alley between Fenton and Gray and between 26 and 29 Avenue,
Mr Lee Stewart of 4480 Allison requested that legal notices
be published in the Wheat Ridge Sentinel

In answer to the question of whether or not the Sentinel is a legal
paper the City Attorney stated that it was
Motion by Alderman Bramble "I move that in the future all the City's
Ordinances be published in the Wheat Ridge Sentinel because it is a
legal Paper" Motion was seconded by Alderman Donaldson After
discussion, the Council was polled and vote tied 3-3 with Aldermen
Pepe, Bowling and Howard voting "nay" Mayor Anderson voted "aye"
to break the tie and the Motion passed
An Ordinance pertaining to Planned Unit Development was brought up
for discussion
Motion by Alderman Howard "I move that the introduction and reading
of the Ordinance pertaining to Planned Gnit Development be tabled
until the City Council can have a meeting with the Planning Commission
and any experts who may attend and go through this Ordinance section
by section" Motion was seconded by Alderman Hulsey and passed 3-1
with Alderman Pepe voting "nay" and Aldermen Bowling and Bramble absent
A meeting is to be arranged and was set tentatively for August 31, 1970
subject to the approval of the Planning Commission
Motion by Alderman Donaldson "I move that Walter Grande be appointed
to prepare and present the 1971 Budget." Motion was seconded by
Alderman Pepe who asked to gon record as saying "I hope we will
tighten our belts on the Budget." Council was polled and Motion passed
4-0 with Aldermen Bowling and Bramble absent
Motion by Alderman Hulsey "I move that next week's Council Meeting
be Tuesday instead of Thursday because of the Carnation Festival on
Thursday." Motion was seconded by Alderman Donaldson and passed 4-0
with Aldermen Bowling and Bramble absent
Meeting was adjourned at 10 00 P m
