THIS AGREEMENT made in the City of Wheat Ridge, Count V of Jefferson,
State of Colorado, on MaV 7 , 1976, bV R. GLEN IPSEN and
DAWN T. IPSEN, residing at 12271 W. 32nd Avenue, Parties of the First
Part, and the CITY OF WHEAT RIDGE, a Colorado Municipal Corporation,
herein called Party of the Second Part.

WHEREAS, the Parties of the First Part represent and warrant that
they own and have fee simple title to that certain parcel of real estate
located in the City of Wheat Ridge, County of Jefferson, State of Colo-
rado, more particularly bounded and described as follows:
A tract of land located in the Southwest Quarter (S.W. 1/4), Northeast
Quarter (N.E. 1/4) Section 29, Township 3 South, Range 69 West of the
Sixth Principal Meridianl said tract being a portion of Tract "A" of
Applewood Village-Second Filing as recorded in Jefferson County Plat
Book 22, Page 16, said tract all being located in the City of Wheat
Ridge, County of Jeffersonl State of Colorado and being more particularly
described as follows: Beginning at the Center Section 29, Township 3
South, Range 69 West; thence North 89031'12" east along the East-West
centerline Section 29, Township 3 South, Range 69 West a distance of
305.000 feet; thence North 00044'06" West a distance of 40.000 feet to
a point on the Northerly Right-of-Way line of West 32nd Avenue; thence
North 89031'12" East along the Northerly Right-of-Way line of West 32nd
Avenue a distance of 65.052 feet to the Southwesterly corner of Lot 15,
Glen Brook Sub divisionl said corner being the true point of beginning;

East a distance of 81.360 feet; thence North 49004'18" East a distance of
41.720 feet; thence North 33052' 12" East a distance of 34.540 feet; thence

Right-of-Way line of West 32nd Avenue; thence South 89031'12" [vest along
the Northerly Right-of-Way line a distance of 86.596 feet to the
true point of beginning. The above described tract of land contains
236037 Square Feet or 5.42 acres more or less.

NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
The Parties of the First Part do hereby grant, assign, and set over
to the Party of the Second Part a permanent easement to maintain the
floodwaV and (loodwav improvements located thereon.
Except as herein granted, the Parties of the First Part shall con-
tinue to have the full use and enjoyment of the property.
To have and to hold the said easement unto the Party of the Second
Part and unto its successors and assigns forever.
IN WITNESS WHEREOF, the parties hereto have duly executed this
agreement.
