PERMANENT EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
THAT SKELLY OIL COMPANY, a Delaware corporation licensed
to do business in the State of Colorado, hereinafter called the "Grantor",
for and in consideration of the sum of One Dollar ($1. 00) and other valuM
able considerations to it in hand paid by the CITY OF WHEAT RIDGE,
State of Colorado, hereinafter called the "City", receipt of which is
hereby acknowledged, has given and granted and by these presents does
hereby give and grant unto the said City easement on, along, over and
across the following described premises, tOMwit:
A tract or parcel of land located in the SW 1/4, Section 22,
T3S, R69W of the 6th Principal Meridian all being located
in the City of Wheat Ridge, County of Jefferson, State of
Colorado and being more particularly described as follows:
Beginning at the southwest corner of Section 22, T3S, R69W,
thence east along the south line of the SW 1/4, Section 22, T 3
S, R69W a distance of 40. 0 feet; thence north along the east
ROW line of Kipling Street and parallel with the west line of
the SW 1/4, Section 22, T3S, R69Wa distance of 34.3 feet to
the true point of beginning; thence continuing north along the
east ROWan Kipling Street and parallel with the west line of
the SW 1/4, Section 22, T3S, R69W a distance of 10.7 feet;
thence on a southeasterly direction a distance of 21. 2 feet,
to a point on the north ROW line of West 38th Avenue; thence
west along the north ROW line of West 38th Avenue and paralM
leI with the south line of the SWl/4, Section 22, T3S, R69W a
distance of 10.7 feet; thence on a northwesterly direction a
distance of 6. 1 feet to the true point of beginning,
The above tract of land conta ins 94.5 square feet, more or
less.
for the purpose of all utilities and curb and gutter.
And this easement is granted on condition that the use thereof by
City shall in no way impair, disturb or interfere with Grantor1s full and
complete use and enjoyment of that portion of its acces s drive located
within the easement area, it being the intention of Grantor and City that
Grantorrs use of its access drive shall not in any way be affected by the

And the Grantor hereby covenants with the Grantee that it has good
and lawful right to grant this easement; that it will warrant and defend the
title and quiet possession thereof against the lawful claims of all persons
whomsoever.
