3lf- 1 WITNESSETH, that the Party of the First Part, for himself, his heirs and

, assiqns, grants and conveys unto the Party of the Second Part its heirs and assigns,
an easement in, to, upon, and over all that real property described as follows:
A tract of land located in the Northwest Quarter (NW 1/4) Southeast Quarter (SE 1/4)
Section 29, TO\~nshiD 3 South, Range 69 West of the Si)':th Principal Meridian,
said tract being a portion of Lot One (1) of Mountain Shadows Subdivision First Filin~
as recorded in Jefferson County Plat Book 21 at Page 39, said tract beinq located in
the City of Wheat Ridoe, County of Jefferson, State of Colorado and being more
particularly described as follows:
Beginning at the center of Section 29, Township 3 South, Ranqe 69 West, thence
North 890 31' 12" East along the East-West centerline of Section 29,
Township 3 South, Ranf1e 69 West a distance of 166.45 feet; thence South 000 41 I 08"
East, a distance of 30.00 feet to a point on the Southerly Ri~ht-of-Way line of
West 32nd Avenue; thence North 890 31' 12" East alonq said Southerly Right-of-\~ay
line of West 32nd Avenue a distance of 134.00 ieet to the North Easterly corner of
said Lot One (1), said corner being the true point of beginning; thence South 190 00'
West along the Easter1v property line of said Lot One (1), a distance of 116.378 feet
to a point, thence South 890 31' West a distance of 20.55 feet to a point of
intersection of the easterly property line of said Lot One (1) and the Northerly
Right-of-Way line of the Denver Municipal \~ater vJorks Right-of-Hay, thence
North 480 05' 24" \-Iest along said Northerly line of the Denver Municipal I-Jater
Horks Right-of-Hay a distance of 3.05 feet; thence North 410 ~4' 36" East and
at right angle to said Denver Municipal Water Works Rioht-of-Hay a distance
of 45.41 feet; thence North 80 18' 04" East a distance of 74.63 feet to a point
on the Southerly Riqht-of-l-1ay line of West 32nd Avenue, thence North 890 31' 12"
East a distance of 20.00 feet to the true point of beginning.
Said easement is qiven for the sole purpose of inqress and egress
and construction purnoses, and it is aqreed and understood that it is
not to be construed as an easement qiven to the exclusion of the Partv of
the First Part, his heirs and assigns, or to others later granted a similar right.
The Party of the Second Part agrees to repair all damages occasioned
by the construction activities.
IN HITNESS WHEREOF, the parties hereto have duly executed this Agreement.
