September 17, 1970
The seventy-sixth regular meeting of the Wheat Ridge City Council
was called to order at 7 30 p.m in the Council Meeting Room at
7390 West 38 Avenue by Mayor pro-tem Dana Bowling
Other Aldermen attending were
Calvin Hulsey and Ray C. Pepe
Joseph Donaldson, Robert Howard,
Alderman Jack Bramble was absent.
Others attending were
City Attorney Maurice

Clerk Louise Turner, Treasurer James Malone,
Fox, Finance Officer Walter Grande and inter-
WZ-70-21 Rezoning Case was brought up for decision. Applicant Curtis
Welin had requested a change from A-2 and R-C to C-1 for a motel site
at 12001 West 44 Avenue.
Motion by Alderman Howard "I move that Rezoning Case WZ-70-21 located
at 12001 West 44 Avenue be approved for the following reasons
1. Planning Commission recommended approval.
2 Surrounding Zoning would allow C-1
3 No one appeared in oppositon."
Motion was seconded by Alderman Hulsey
Alderman Pepe asked if land would be given for straightening 44 Avenue
as recommended by the Planning Department. Mr. Crum, Representative
of Ambassador Motels stated that a deed is in the hands of the Planning
Department - to be made out by the Department to suit its own purposes
at the proper time. Attorney Fox stated that a oral contract cannot
be enforced. That if a Zoning is passed subject to conditions - those
conditions do not have to be met Council could take the word of
applicant Council was polled and rezoning passed 5-0
Mr. Felix Lepore of the Park and Recreation Commission reported on an
adult recreation program which is to be begun late in September at
Everett Junior High School
In regard to conducting an oplnlon poll in conjunction with the General
Election, the City Clerk reported that separate voting machines would
not be available for City use and ttlat a City question could not be
put on the machines in use for the General Election. The regular
polling places could be used on election day. Ballot boxes and paper
ballots could be used and separate City Judges should be appointed.
Alderman Pepe's proposal previously presented as to the precedure for
conducting an opinion poll was pEsented to and approved by the City
Attorney.
The words "City Administrator" ware substituted for "City-Manager" in
paragraph one and on the proposed ballot.
Moti.Q.!2 by Alderman Pepe "I move that this proposal - pursuant to
Resolution No 24 be passed with the following changes that the
words "City Administrator" be substituted for "City Manager" in
paragraph one and on the proposed ballot." Motion was seconded by
Alderman Howard and passed 5-0
Treasurer James Malone presented the Budget and appropriations report
for August The report is filed in the General File
Ordinance No. 57 pertaining to adding a function tothe Clerk's Office
was brought up for second considerationr''"'''t'.40 ~cCT
Motion by Alderman Pepe "I move that Ordinance No. 57 be passed on
second reading and that it be published in the Wheat Ridge Sentinel and
posted." Motion was seconded by Alderman Hulsey and passed 5-0

Ordinance No. 60 was brought up for second considerationr The Ordinance
pertains to making the Police Pension Fund refundable
Motion by Alderman Donaldson "I move that Ordinance No 60 be approved
on second reading and be published in the Wheat Ridge Sentinel and posted "
Motion was seconded by Alderman Howard and passed 5-0.
Mayor pro-tem Bowling read a letter from Robert L. Kirk who stated there
had been a misunderstanding between him and his realtor and requested
a re-hearing with the Planning Commission on Rezoning Case WZ-70-19
A copy of the letter is attached to the Minutes.
Motion by Alderman Donaldson "I move that Mr Kirk's request be
granted and Case WZ-70-19 be referred back to the Planning Commission "
Motion was seconded by Alderman Hulsey and passed 5-0.
A Proclamation designating September 21-25 as League of Women Voters'
Week was presented to Mrs William Herbert.
Finance Officer Walter Grande presented the 1971 Budget to Council
Budget total given was $1,575,717.00 and mills assessed WEl'e 4 914.
Approval of purchase of riot equipment was brought up for discussion

Motion by Alderman Donaldson "I move that in accordance with the ..-y,Oh/4/:,n<:'/
Colorado Law Enforcement Assistance nooBci~tio~, Council approve the T~'~
purchase of riot equipment in the amount of $3,675.10 to be funded 75%
by the Federal Government." Motion was seconded by Alderman Howard
and passed 5-0
Motion by Alderman Howard "I move that Walter Grande be authorized
to negotiate for overlay and paving at Twilight and Dawn at a price
not to exceed $2,600.00" Motion was seconded by Alderman Pepe and
passed 5-0
