, by Lakeside National Bank (hereinafter referred to as Grantor) to
TIiE CITY OF \lJHFAT RlrGE, a r.1Unicipal corporation, (hereinafter referred to as
"The City");
\^JHEREAS, Grantors are the cwners of the following described real property
situate, lying and being in The City of 1tmeat Ridge, County of Jefferson, State
of Colorado, located at 1-70 & Harlan Street, to-wit:
(see attached Exhibit A, attached hereto and made a part hereof)
,'iflliREAS, it is the intent of The City to develop, construct, and mintain
drainage and flood control improvements on the Property for the general health,
safety and welfare of Grantors and the other citizens of The City of 1'Vheat

I. Grantors CD hereby grant and convey to The City a perpetual eaSerrlent
to the Property, as described above, for the purpose of authorizing The City to
construct and rraintain hereon any flood control rnannels, structures, or other
improvements deemed necessary by Toe City to fully and successfully impleJnent
the Harlan Street Drainage Flood Control Project contemplated by Tne City.
2. The easement granted hereby includes, without limitation, a grant of
authority to The City; to cane upon the property for the purpose of surveying
and inspection; to construct such improvements, including channelization,
erribanKlTPnts, Faintenance roads, and other flood control improvements deened
necessary; to come upon the Property for purposes of inspecting and maintaining
such :inprovements; and for the purpose of allowing any drainage and flcod 'dater
to CCi'le upon and flow over said Property; as well as any other uses not
enumerated herein Itohich are consistent with the p.1rposes of this Easement.
3. As consideration for the conveyance herein specified, The City agres
to Pay Grantors the sum of $547.74.
4. 1:'he Grantors recognize and acknowledge that The City is currently
engaged in a city-wide program to construct flood control improvements on Harlan
Street Which would inure to the benefit of Grantors and all other citizens of
The city of ifueat Ridqe, and that The City is cooperating U1 this venture with
t.'le Urban Drainage and Flood Control District (DOFCD) to that end.
Grantors
therefore agree to cooperate wit.h 1~e City and UDFCD in any reasonable manner or
means which is consistent with the purposes of this Easement, even though any

rarticular use or improvement thereby contemplated may not be specifically set
forth herein.
5. Grantors agree that they shall construct rn improvements or buildings ::z-
of any kind whatsoever, including fencing, on the Property conveyed hereby
without the prior written CDnsent of 'l'he City, Which consent shall rnt be
unreasonably withheld if the same may be given without endangering the public
health or v.elfare or otherwise imraring the prrpose of this Drainage and Flcxxl
Control Easement.
6. The City agrees that, during the tenn of this Easement, it shall
repair and maintain the improvements constructed upon the Property hereby
CDnveyed, and The City shall likewise repair any damage \tihich it causes to
Grantors' remaining property during construction or repair of any improvements
made pursuant to this Easement.
7. During the tenn of this Easement, the Grantors shall have access to
any may utilize the Property conveyed hereby for any purpose which 1S not
inconsistent with, or Yklich \\QUId be detrimental to, the rurpose for Yklich this
Easement is granted.
8. The Easement granted hereby is perpetual, and shall be binding CXl the
heirs anLl successors of the parties, and shall becane a covenant running with
the land upon its recordation; provided however, that this Easement may be
terminated only by a writing signed by both parties, or their successors, which
writing shall be duly recorded and shall rnt be effective until so recorded.
IN WITNESS WHERffiF, the parties hereto have set their hands and seals to
the foregoing and attached Drainage & Flcxxl Control Easement the day and year
first above written.

A parcel of land in the NW 1/4 Section 24, Township 3 South, Range
69 West of the 6th Principal Meridian, Jefferson County, Colorado,
containing 3,043 square feet, more or less, and is mOt'e particularly
described as follows:
Beginning at a point on the east line of the tract of land
described in Book 2323 at Page 86 of the Records of Jefferson
County, Colorado, from whence the northeast corner of said
Section 24 bears N. 4027'14" E. a distance of 380.64 feet;
1. Thence S. 890 56' W. a distance of 53.00 feet;
