HomeMy WebLinkAbout10/15/1970 MINUTES October 15, 1970 The eightieth regular meeting of the Wheat Ridge City Council was called to order at 7 30 p.m by Mayor Albert E Anderson in the Council Meeting Room at 7390 West 38 Avenue Aldermen present were Dana Bowling, Jack Bramble, Joseph Donaldson, Robert Howard, Calvin Hulsey and Ray C Pepe Also attending were Mayor Anderson, Clerk Louise Turner, City Attorney Maurice Fox, Planning Director James Mier, Director of Administrative Services Walter Johnson, applicants and attorneys for applicants in rezoning cases and interested citizens Citizen Bernard O'Donnell of 10616 West 48 Avenue appeared to ask how it might be possible to expedite action on an Improvement District. WZ-70-19 Rezoning Case was heard Applicant Robert L Kirk requested a change from Agricultural-One (A-1) to Residential-One B (R-1B) for single family houses at 4020-4060 Nelson Street. Surrounding zoning was shown to be North - Agricultural-One (A-1), West - Agricultural-One (A-1), East - Residential-Three (R-3 ), and South - Agricultural-One (A-1), and surrounding land use shown to be single family dwellings Planning Commission recommended approval for the following reasons 1 Residential-One B (R-1B) would be compatible withe the sur- rounding land use 2 The Comprehensive Plan recommends low density Applicant Robert Kirk stated that he and others in the neighborhood wanted the property to be developed into single family houses and not apartments, and that Residential-One B (R-1B) would be the proper size lots for houses that would fit the neighborhood. Motion by Alderman Bramble "I move that Rezoning Case WZ-70-19 be tabled for consideration and advisement for one week - and a decision to be given on October 22, 1970" Motion was seconded by Alderman Bowling and passed 6-0. WZ-70-2o Rezoning Case was heard Applicant Robert Hartman requested a change from Restricted-Commercial (R-C) to Commercial-One (C-1) for motor vehicle and trailer sales and repair at 4075 Kipling Surrounding zoning was shown to be North - Restricted Commercial (R-C), South - Commercial-One (C-1), East - Kipling Street and Residential- One (R-1) east of Kipling, and West - Residential-One (R-1), and sur- rounding land use is East - Everett Junior High School, and North, South and West vacant. Signs had been posted in windows of a building on the property Planning Commission recommended denial becaust it is not compatible with existing land use and does not fall within the Comprehensive Plan which the City has adopted. Mr. Gerald Boatright, Attorney for the applicant stated that 1. Commercial-One (C-1) Zonign would not be a detriment to sur- rounding land uses. 2 The school to the East is not a residential type use It en- compasses retail sales of pop and candy, a restaurant and facilities rented for exhibits, assemblies and movies - all of which are commercial uses, so all surrounding land uses fall into commercial uses except the Residential-One (R-1) to the West which he felt would never be developed as residential 3 The Commercial-One (C-1) to the South was approved by the County as a uansitional area several years ago. -2- Mr. Francis McGinn of 3260 Garland, Real Estate Brokar, stated that in his opinion the best use of the land would be Commercial-One (C-1), 2 Commercial-One (C-1) would be a benefit to the area. 3. A convenience store in conjunction with trailer salas and re- pairs would be a c18an operation and fit in with no problem to neighbors 4 A school is more of a detriment to the area than an operation of the type proposed Mr. Boatright stated that no use allowed under Commercial-On8 (C-1) would be detrimental to the area. Alderman Bramble expressed concern that because the signs were posted inside a building the residents of the area might not have been ade- quately informed Attorney Fox stated that the legal requirem8nts of giving notice had been met. Motion by Alderman Bramble "I move that this hearing be continued to allow applicant to circulate a petition to show that property was properly posted " Motion was amended to read "I move this hearing be continued for one week." Motion was seconded by Alderman Bowling. Motion was amended to raad "I move this hearing be continued for three weeks and the property to be re-posted" Amendment was approved by the second and Motion passed 4-2 with Aldermen Howard and Hulsey voting "nay." WZ-7o-22 Rezoning Case was heard Applicant R J. Nicoll requested a change from Commercial-One (C-1) to Residential-Thr8e (R-3) for the purpose of putting apartments on 22,800 square feet on the NE corner of 44 Avenue and Holland Street Area involved is 1/3 acre. Surrounding zoning was shown to be Commercial-One (C-1) with the ex- ception of one small corner South of 44 Avenue which was Restricted- Commercial (R-C) Surrounding land use is predominately commercial with Residential-Three (R-3) use immediately to the North on property which is zoned Commercial-One (C-1). Planning Commission recommended approval because 1. It would be an upgrading of the present zoning. 2 The Comprehensive Plan indicates that this area be used for residential, and 3. Streets are not conducive to good commercial use at this time It was pointed out that a change could be considered spot zoning J.D. Colby of 1485 Holland, Lakewood, Attorney for the applicant stated 1 Plan was for seven units with two parking spaces per unit 2 Would be built by Casselburg Construction Company. 3 Residential use would not be inconsistent with the use to the North 4. It would be in keeping with the Comprehensive Plan and with sound zoning. 5. It would improve the property, enhance the area and add value to the community, and 6 Good commercial use of the property is not likely in the fore- seeable future Motion by Alderman Hulsey "I move that Rezoning Cas8 WZ-70-22 b8 tabled until n8xt week, October 22, 1970, for d8cision at that tim8." Motion was seconded by Alderman Donaldson and pass8d 6-0 -3- WZ-7o-23 Rezoning Case was heard. Applicant Ruth Martin requested a change from Residential-Two (R-2) to Residential-Three (R-3) for apartments at 5100 Tabor. Involved is 14,307 square feet. Surrounding zoning was shown to be ~Iorth and East - Residential- Two (R-2), West - Residential-One (R-1), South- a narrow strip of Agricultural-Two (A-2) belonging to the C & S rlailroad ROW, and South - of that strip }~ Industrial-Three (1-3). Planning Commission recommended denial for the following reasons 1. An apartment complex in this area is not compatible with surrounding bUilding . 2. Comprehensive Plan shows this to be a residential area. 3 This would create a traffic hazard on a narrow and blind corner Applicant Ruth Martin of 5130 Tabor stated 1 The property would lend itself better to multiple units than to doubles 2 That it would be a buffer zone for the Industrial-Three (1-3) to the South. 3 The Residential-One (R-1) to the West is not improved and the use is agricultural Part of that tract faces the railroad and would not be practical for single units 4. Twelve cars would not substantially add to the traffic Motion by Alderman Donaldson "I move that Case WZ-70-23 be taken under advisement for one week and a decision rendered on October 22, 1970." Motion was seconded by Alderman Bramble and passed 6-0. Mr Clyde Hobbs distributed to Council a report analyzing pedestrian problems at Wheat Ridge schools and reported that he had been assured of cooperation of the R-1 schools. Mayor Anderson reported that he, Mr. A. F. Williams and Alderman Howard would be a committee to study the Green Belt Area.
