hereinafter referred to as "Grantor".

WHEREAS, Grantor owns certain real property situate in the City of
Wheat Ridge, County of Jefferson, State of Colorado, to-wit: Lot 1
Stoneridge Subdivision, as filed January 13, 1978.
WHEREAS, Grantor wishes to dedicate to the City of Wheat Ridge, a
municipal corporation, (hereinafter referred to as "the City") an easement
for drainage purposes to the property described in the attached "Legal
Description. . ." including the "Excepting
. of Lot . . . already
dedicated on the Final Development Plan and Subdivision of Stoneridge",
and further wishes to covenant to the City that Grantor, as well as the
heirs, successors, and assigns of Grantor, will maintain said easement;
NOW, THEREFORE, Grantor does hereby:
1. Grant to City an easement over, upon, under and to that certain
real property described in the attached "Legal Description. . ." including
said "Excepting. . ." clause above, which is attached hereto and expressly
incorporated herein. Said easement shall be for drainage purposes, and
Grantor, as well as the heirs, successors and assigns of Grantor, shall not
erect or maintain thereon, any building, fence, retaining wall, or any
structure or improvement of any description whatsoever. Property-line
fence may be built when proper permit is reviewed and approved by both the
City Building Department and Public Works Department; however, should said
fence after being built, be deemed an impediment to drainage flows, said
fence will be removed or modified at the expense of the property owner as
directed by the City.
2. Covenant that the certain drainage improvement specified in that
certain document maintained by the City Engineer of the City of Wheat Ridge
as Huffstutler Engineering Service, Inc., Sheets 2 and 3 of 4, last dated
August 23, 1977, sealed and signed by Raymur H. Murray, P.E., identified
as Final Drainage Plan and Overlot Grading Plan; and, Gingery Associates,
Inc., Sheet 1 of 1, dated October 6, 1981, sealed and signed by Douglas C.
Stovall, P.E., identified as Drainage Plan, Number D.3045.003 and
plat recorded in the books and records of the Clerk and Recorder of q~O 2 4 0 1 9
County of Jefferson at Book 54, Page 30, Reception number 78003850, shall
be maintained by Grantor, and the heirs, successors and assigns of Grantor,
in a manner as originally designed and built, as represented in the documents
described in this Paragraph 2.

3. Covenant and agree that this Dedication and Covenant shall be per-
petual, and shall be a covenant running with the land, thereby binding Grantor
as well as the heirs, successors and assigns of Grantor.
4. Accept as consideration for within Dedication and Covenant
the sum of $1.00 in hand paid, the receipt, adequacy, and sufficiency of
which is hereby acknowledged.

and METROPOLITAN DENVER SEWAGE DISPOSAL DISTRICT NO. I,
hereinafter called respectively lessor and lessee, without
regard to number or gender.
WITNESSETH:
That lessor hereby leases to lessee, for the
purpose of storing materials, supplies excavated materials
and equipment and for such other purposes as the lessee deems
necessary in conjunction with the construction of the
connecting sewer lines, and for no other purpose, those
cer~ain premises situated in Jefferson County,
State of Colorado, and more particulary described as follows,
to-wit:

The term shall be for ? consecutive months
during the calendar year 1983 or 1984 at a rate of

lessee agrees to pay to lessor in advance of use or
occupancy. The lessee shall give lessor at least ten (10)

base period, then lessee shall pay for each month or fraction
thereof beyond said base period the sum of One Hllnorpo
Sixtv&no/100-Dollars ($ 160.00 ) per month, payable at the
end of each month or fraction thereof.
It is further mutually agreed between the parties
as follows:
1. The lessee shall have the right to remove
trees, bushes, undergrowth and other obstructions interfering
with the stated use of the leased premises , it being
mutually agreed that the total cost of this lease includes
compensation for the loss of trees, bushes, undergrowth and
other obstructions.
2. The lessee shall have the right of ingress to
and egress from the said premises over and across the lands
of the lessor by means of roads and lanes thereon if such
there be, otherwise by such route and routes as shall
occasion the least practical damage and inconvenience to the
lessor.
3. The lessee shall, at the termination of this
lease, as nearly as possible, restore the same premises to
its original condition less any trees or bushes that have
been removed.
4. The lessee shall indemnify and save the lessor
llarmlcss from and against any loss, damage and liability
occasioned by, growing out of or arising or resulting from
any tortious or negligent act on the part of the lessee, its
contractors, subcontractors, agents or employees.
5. The lessor agrees to warrant and defend the

title to said premises and th~t the lessee shall peaceably
and quietly hold, enjoy and occupy said premises during said
term without any hinarance, interruption, ejec~ion or
molestation by lessor or by any other person or persons
whomsoever.
6. The lessor shall indemnify and save the lessee
harmless from and against any loss, damage and liability
occasioned by, growing out of, or arising or resulting from
any default hereunder, or any tortious or negligent act on
the part of the lessor, the lessor's agents or employees.
7.
8. This lease and all the covenants , provisions
and conditions herein contained shall inure to the benefit of
and be binding upon the successors and assigns of the
parties.
