PERMANENT EASEMENT
KNOW ALL MEN BY THESE PRESENTS, that James L. Heighton
6160 West 35th Avenue, Wheat Ridge of
Jefferson County, State of Colorado,
hereinafter called the "grantor", for and in consideration
of the sum of ONE DOLLAR ($1.00), and other valuable
consideration to him in hand paid by the City of
Wheat Ridge, hereinafter called "City" "grantees", receipt
of which is hereby acknowledged, has given and granted and
by these presents does hereby give and grant unto the said
grantees, their heirs, successors or assigns a PERPETUAL
EASEMENT on, along, over and across the following described
premises, to-wit:
The South ten feet of a tract of land known as Lot F
recorded in Book 2008 Page 493 at Jefferson County as the
East 100 feet of the West 218 feet of Block 4, Highland
Gardens, said Block 4 being the Southeast one-quarter of
the Northwest one-quarter of Section 25, Township 3 South,
Range 69 West.
AKA: 6160 West 35th Avenue, Wheat Ridge, Colorado
for the purpose of a drainage way for storm water runoff.
Subject to the following terms and conditions:
And the Grantor(s) hereby convenant(s) with the Grantees
that it has good title to the aforedescribed premises; that
it has good and lawful right to grant this easement; that it
will warrant and defend the title and quiet possession
thereof against the lawful claims of all persons whomsoever.
