KNOW ALL MEN BY THESE PRESENTS, that James P. Owings, 6401 West 47th /
place, Wheat Ridge, of Jefferson County, State of Colorado, here-
inafter called the "grantor" for and in consideration of the sum of
Two Thousand One Hundred Forty Dollars ($2,140) and other valuable
consideration to him in hand paid by the City of Wheat Ridge, here-
inafter called "City", does hereby give and grant to said City
PERMANENT RIGHT-OF-WAY and EASEMENT on, along, over and across the
60110wing described premises to-wit:
A portion of a tract of land described as the East ninety-six
(96) feet of Lot 1, LEPPLA SUBDIVISION NO.1, recorded as Recep-
tion No. 087783, at Jefferson County, Colorado, except that por-
tion conveyed by deed to the State Highway Commission of Colo-
rado, recorded in Book 817, Page 333 of Jefferson County records.
More particularly described as follows: From a POINT OF BEGIN-
NING at the Southeast corner of said Lot 1; thence North along
the east boundary of Lot 1 a distance of one hundred sixty (160)
feet to a point; thence West parallel to the South boundary a
distance of ten (10) feet to a point; thence South and parallel
to the East boundary a distance of one hundred twenty-five (125)
feet; thence Southwesterly to a point on the South boundary which
point is thirty-five (35) feet West of the Southeast corner of
Lot 1; thence East a distance of thirty-five (35) feet to the
POINT OF BEGINNING. AKA 6401 West 47th Place.

The purpose of this Permanent Easement shall be for constructing a
drainageway for stormwater runoff across the subject property to
Clear Creek. The drainageway shall consist of a buried 66-inch
diameter reinforced concrete pipe and manhole, to be located within
the Easement area, as shown on the attached exhibit.
This Easement is subject to easements and restrictions of record.
The premises shall be restored to original condition, or better.
This Easement shall impose no restriction or limitation upon the
owner, or future owners, heirs and assigns, as to the location of
any future building within the easement area provided that:
1. The location of that building shall conform to the set-back
requirement as established by City Ordinance at that time;
2. The plans for any future structure to be constructed on the
easement area shall be submitted,in advance, to the City
Engineer for approval. This approval shall ensure that no
portion of the structure, or construction activity therefor,
would cause damage to the drainageway conduit.
3. This Easement shall be effective upon the expiration of the
Temporary Construction Easement for this property, dated July
30,1985.
Further, this easement shall impose no restriction as to the plant-
ing of lawn, trees, or shrubs within the easement area.
And the Grantor(s) hereby covenant(s) with the Grantees that it has
good title to the aforedescribed premises; that it has good and
lawful right to grant this easement.
