by FRED and JANET SWITZER PHILLIPS, 10545 W. 3 Place,~eat Ridge,
Colorado, (hereinafter referred to as Grantor) to the CITY OF WHEAT ~
RIDGE, a municipal corporation, (hereinafter referred to as Grantee). \"..-
In and for the consideration of the mutual covenants and benefits
described herein, Grantors do hereby grant, bargain, sell, assign and
convey to Grantee an easement to use and to enter upon the real prop-
erty described on Exhibit A, which is attached hereto and expressly
incorporated herein, for a sum of One Dollar ($1.00) and other valu-
able consideration. It is expressly understood and agreed by and
between the parties, and is expressly made a portion of the grant
hereby conveyed, that the easement hereby gcanted is for the purpose
of allowing Grantee or its designee to situate a utility upon the
property described in conjunction with the construction of flood con-
trol improvements which will be of benefit to Grantors and other citi-
zens of the City of Wheat Ridge, as well as to residents of surround-
ing areas.

The easement granted hereby shall entitle Grantee or its designee
to enter upon the described property for the purpose of installing a
36" drainage pipe connecting intake grates installed at the intersec-
tion of West 36 th place and Moore Court wi th Lena Gulch. Grantee
agrees that it shall be responsible to compensate Grantors for, or to
repair, any damages caused by Grantee's utilization of this easement
to Grantors' surrounding property.
Grantee agrees that a completion date for the installation of
this utility shall be not later than May 30, 1986.
Grantee agrees that in the event future alterations or repair of
the utility are required, that Grantee shall be responsible to compen-
sate Grantors for, or to make repairs to, surface damage to Grantor's
property, including driveways, sidewalks, fences, grass, vegetation,
or structures as descr ibed herein. The granting of this easement
shall not preclude the Grantois, their heirs, successors, or assigns,
from landscaping, planting grass, shrubbery, flowers, or other plan
material, or from erecting fences, moveable sheds or structures other
than any structure required by City building codes to have footing and
foundation upon the property conveyed hereby.

LEGAL DESCRIPTION OF LENA GULCH UTILITY EASEMENT NO. 3.106
That part of Lot 9, Block 1, Rolling Hills Subdivision, Jefferson County,
Colorado.
Being a 10 foot wide utility easement, 5 feet on either side of the
following described centerline;
Beginning at the northwest corner of said Lot 9 thence southerly along the
west line of Lot 9, 29 feet to the southerly centerline point;
thence on a deflection left of 1570, 27.028 feet to the northerly
centerline point which lies 11. 336 feet more or less from the west line of
Lot 9, containing 270 square feet or 0.0062 acres more or less,
Said Utility Easement is contained in the property described in Book 1618,
Page 73 of the Jefferson County records,
